I A Background: On August 11, 2005, the Historic Preservation Board (HPB) unanimously approved two variances for 919 Oak Avenue: 1. A seven and one-half (7.5) foot variance to the side yard setback for the construction of a six (6) foot high privacy fence at the side of the rear yard along 10"' Street; 2. A variance of one (1) foot to the side yard setback to construct a detached garage. The property owners are Thomas and Mary Kunkel. The Board's approval is conditional upon the affirmation of the City Commission. Discussion: The Historic Preservation Board approved the variances for 919 Oak Avenue based on the following findings: • The existing house and rear deck have a nonconforming side setback on the I Oh Street side of the property. The proposed garage will line up with the house and deck. The fence is offset by six (6) from the house and proposed garage to provide interest along 10t1i Street and to break up the continuous construction line that would occur were the fence on the same plane as the house and garage. • Similar variances have been granted to residents of the historic district in order to allow them to enjoy their back yards. Therefore, the variance would not confer a special privilege to the applicant. • The proposed location and design of the garage encourage routine use of the alley. This routine use protects the neighborhood and reduces crime. • The design of both the fence and the garage are in harmony with the purpose and the intent of Schedule S. On June 27, 2005, the City Commission affirmed a similar HPB variance of two (2) feet to the side yard setback for the construction of a detached garage at 1011 Oak Avenue. Budget Impact: None. ` Recommendation: The City Manager and Planning and Development Services Director recommend that the City Commission affirm the Historic Preservation Board's decision to approve a one (1) foot variance to the side yard setback to construct a garage and a seven and one-half (7.5) foot variance to construct a fence at 919 Oak Avenue. Every 3 months, four times a year, the mamrfacturer shall mail to this office: a copy of the tested reports with confirmation that the specimen were selected from Coils at the manufacturer production facilities. And a notarized statement from the manufacturer that only coils with yield strength of 28000 psi or mon shall be used to make door panels for Dade County under this Notice of Acceptance ADVERTISEMENT: The NOA number preceded by the words Mu=4)ade County, Florida, and followed by the expiration date may be displayed in advertising literature.
