Dear Mr. Trautman:
This department is in receipt of your Application for Variance regarding an 11% decrease in the
50% minimum open space requirement for the above referenced property at 162 Brushcreek
Drive to allow the installation of a pool.
Upon review of the request it has been determined the request is less than 15% of the requirement
and has been determined to be a De minimus variance meeting the following criteria:
• Special conditions and circumstances exist which are peculiar to the land, structure or building
involved and which are not applicable to other lands, structures or buildings in the same district.
• The literal interpretation of the provisions of the land development regulations would deprive the
applicant of rights commonly enjoyed by other properties in the same district under the terms of the
land development regulations.
• The special conditions and circumstances do not result from the actions of the applicant.
• Granting the variance will not confer on the applicant any special privilege that is denied by the
land development regulations to other lands, structures, or buildings in the same district.
• The reasons set forth in the application justify granting the variance, and that the variance is the
minimum variance that will make possible the reasonable use of the land, building, or structure.
• The granting of the variance will be in harmony with the general purpose and intent of the land
development regulations and will not be injurious to the neighborhood, or otherwise detrimental to
the public welfare.
Your request to decrease the required open space by an addition 11% as shown on the attached
drawings is hereby approved. This approval in no way overrules or relieves the owner from
compliance with any deed restrictions or Homeowner Association requirements that may be
attached to this property.
Be on notice that appeals of the above decision may hern4de to the City Commission by any
person aggrieved or by any officer, board or'agericy."of the C1. yJncluding the City Commission
within thirty (30) calendar days of the Administrative Official's action. The applicant shall be
