LIMITED WARRANTIES: Contractor agrees to substantially complete the work contracted for in a workman -like manner and to repair or replace the specific items covered by the limited warranty herein, provided Owner has paid Contractor, in full, under this contract and furnishes Contractor written notice of the alleged defect or malfunction within the specified warranty period. Any water or power costs incurred by contractor's attempts to honor these warranties shall be borne by Owner. Defects and failures resulting from mistreatment, misuse, or neglect by Owner, or by natural causes, acts of God or normal wear and tear, are expressly excluded from these warranties. A. LIMITED STRUCTURAL WARRANTY: Artesian Pools, Inc. warrants the swimming pool structure, (shell), will not leak due to cracking. Whenever used throughout this contract, the term swimming pool structure (shell) will include "pool and / or spa". The shell does not include the plaster finish coat, tile, cantilever, or materials and equipment external to the pool. All warranties provided for herein inure to the benefit only of the original Owner, as identified at paragraph 1 of this contract, and only so long as that owner continually and without interruption owns the swimming pool. Any transfer of ownership of the property identified at paragraph 2 of this Contract, voids any and all warranties provided for herein. Upon payment to Contractor of a $200.00 fee and Contractor's inspection of the pool and subsequent approval, Contractor agrees to a one-time transfer of the limited structural warranty to a subsequent Owner. This transfer of the limited structural warranty can only be made to a transferee by the original Owner and will remain in effect for the transferee's lifetime, providing such transferee still owns the swimming pool. Request for transfer must be made in writing by the original Owner at the time of the transfer of the pool ownership. This Limited Structural Warranty does not cover damage to the pool shell caused by construction in the vicinity of the pool site, or natural phenomena. This Limited Structural Warranty is void if the pool is not kept full at all times. The Contractor's responsibility under this Limited Structural Warranty shall be to repair the shell so that it holds water, without cost to the original Owner, except that it is the Owner's responsibility to furnish water, power, access, and chemicals for the repair. The method of the repair shall be at the discretion of the Contractor. B. POOL FIXTURE AND MATERIAL INSTALLATION LIMITED WARRANTY: Artesian Pools, Inc. warrants for a period of one (1) year from the date of initial chlorination of the pool, subject to the limitations hereinafter set forth, that the following items furnished and installed by the Contractor are free of defects in material and equipment installation. Defects caused by misuse, neglect, failure to maintain proper chemical balance or other phenomena beyond the control of the Contractor are not covered. All warranties are to the original Owner providing said Owner still owns the swimming pool. 1. Tile: Color and texture may vary from sample. Some variations in shade are inherent in the product and are not a warranty item. Tile is warranted to be free from defects in material and workmanship for three (3) years from date of initial chlorination. 2. Grout: The Contractor warrants the grout to be free from defects in material and workmanship for one (1) year from the date of initial chlorination. Grout is not warranted against staining or discoloration. 3. Underground Plumbing: The Contractor warrants, for the lifetime of the original Owner, that the underground plumbing is free from defects in material or workmanship. . 4. Concrete Decking and Finish Coat Installation: The concrete decking is.warranted to be free from defects in material or workmanship for a period of three (3) years. The finished deck coating is warranted to be free from defects in material or workmanship for a period of one (1) year. It is anticipated the concrete deck and deck coatings may crack due to settling of deck, weather or conditions beyond the control of the Contractor. Cracks one-eighth of an inch in width or less with no substantial deviation in elevation are not covered. Stains or discoloration appearing after initial chlorination are not covered. 5. Paver Decks & Brick Coping: Paver decks and brick coping are warranted to be free of defects in material and workmanship for one (1) year from date of initial chlorination. 6. Shell Finish Coat Installation: The Contractor warrants the shell finish coat for a period of five (5) years from the date of initial chlorination to be free from defects in material and workmanship under normal use and service. The Contractor makes no express or implied warranty that the finish coat will not discolor or stain, as this problem is commonly due to conditions beyond the control of the Contractor, such as local water conditions, improper chemical use or lack of cleaning by Owner. 7. Installation of Finished Products Purchased by Contractor: The repair, replacement or servicing of the finished products purchased by Contractor are not covered by Contractor's warranty. These products are generally subject to manufacturers' warranties and the Contractor makes no express or implied warranties including the warranty of merchantability or fitness for a particular purpose beyond the description of the product. Responsibility of Artesian Pools, Inc. to the original Owner under this Limited Warranty is to provide necessary labor and material to repair the defective material or equipment installation covered hereby. For a period of one (1) year after chlorination there shall be no service charge for any warranty work required to be done by the Contractor under this warranty. However, if the requested service is not covered by the warranty and the Contractor agrees to perform the requested service, the Owner agrees to pay the Contractor for his usual service charge plus reasonable charges for labor and materials. THE CONTRACTOR MAKES NO OTHER EXPRESSED WARRANTIES OR IMPLIED WARRANTIES INCLUDING THE WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE IN REGARDS TO THE POOL STRUCTURE (THE SHELL), FIXTURES, EQUIPMENT, AND MATERIALS SOLD OR INSTALLED. 6. BUYERS RIGHT TO CANCEL: The Contractor shall not be obligated to commence construction of this pool until three days after the signing of this contract by the Owner, since this contract may be construed as a Home Solicitation Sale, Purchaser is hereby notified of his right to cancel, as provided under the Home Solicitation Sales Act. RIGHT TO CANCEL: This is a Home Solicitation Sale. If you do not want the goods or services contracted for, you may cancel this agreement by mailing a written notice to Contractor. This notice must indicate that you do not want the goods and services contracted for under this agreement and must be sent by Certified Mail postmarked no later than midnight of the third day after you signed this agreement. 7. OFFER.AND AGREEMENT: This contract shall be deemed an offer to Artesian Pools, Inc., and shall be null and void unless accepted by a duly authorized Officer of the Contractor. The salesman has no authority to bind the Contractor. All agreements and understandings are contained in this contract and the Owner warrants that there are no agreements or understandings other than those set forth in this document.
