BUYER'S RIGHT TO CANCEL
You may cancel this Agreement by providing written notice to Florida Pools, 1123 Seminola Blvd., Casselberry, FL 32707, in person, by telegraph,
or by mail. This notice must indicate that you do not want the goods or -services and must be sent by certified mail postmarked before midnight of
the third (31') business day after signing this Agreement.
If you cancel this Agreement, the Seller may not keep all or part of any cash downpaymenl. Any property traded in, any payments made by you
under the Agreement and any negotiable instrument executed by you will be returned within ten (10) business days following receipt by the Seller
of your cancellation notice, and any security interest arising out of the transaction will be cancelled.
If you cancel, you must make available to the Seller at your residence, in substantially as good condition as when received, any goods delivered to
you under this contract; or you may, if you wish, comply with the instructions of the Seller regarding the return shipment of the goods at the Seller's
I expense and risk.
If you do make the goods available to the Seller and the Seller does not pick them up within twenty (20) days of the date of your notice of
cancellation, you may return or dispose of the goods without any further obligation. If you fail to make the goods available to the Seller, or if you
agree to return the goods to the Seller and fail to do so, then you remain liable for perforniancc of all obligations under this Agreement.

Florida Pools and Buyer hereby elect binding arbitration as their exclusive method of settling all controversies and claims existing between them
relating to this Agreement without regard to whether such claims or controversies arise under contract, tort, statute, regulation, ordinance, or other
law. Arbitration proceedings shall be conducted in accordance with the Rules for Swimming Pool Arbitration adopted by the Bludsworth Central
Florida Chapter of the National Spa and Pool Institute (NSPI) Arbitration Committee and said Rules are hereby incorporated by reference into the
terms of this Agreement. Additional information may be obtained by writing the chairman of the Bludsworth Central Florida Chapter at the address
referenced in the RULES FOR SWIMMING POOL ARBITRATION. Arbitration proceedings under this Agreement shall be commenced by either
party by sending a written request for arbitration to the Chairman of the Central Florida Chapter of NSPI Arbitration Committee, together with any
filing fees required. Requests for arbitration shall be submitted on "Request for Arbitration" forms that can be obtained from the local NSPI and
must set forth the issues in dispute, and or the amount claimed as damaged, and the relief sought.
Notwithstanding the foregoing, Buyer and Florida Pools agree that Florida Pools retains the right to file a claim of lien against the property and to
protect this lien until ultimate resolution of the dispute.
Buyer acknowledges that he has read and received a complete, legible copy of this Construction Agreement (Part 1), including the items and
conditions contained on the reverse side hereof, and a complete, legible copy of each other document which Florida Pools has required or requested
Buyer to sign. Buyer acknowledges receipt of the Swimming Pool Specifications and the Exclusive Service Agreement (designated as Parts 2 and
4 of this Construction Agreement). Buyer shall receive a copy of the Plans (designated as Part 3 of the Construction Agreement) as soon as they are
completed.

ASTM F1346-91 (Standard Performance Specifications for Safety covers for

All doors and windows providing direct access from the home to the pool will be
equipped with an exit alarm that has a minimum sound pressure rating of 85
decibels at 10 feet;

RETAINING WALL- -
The ground drops off going towards the back yard so that the existing ground is approximately
12" 'to 24" lower than the proposed pool deck. The contractor proposes to "turn down" the deck
along the backside of the deck and the side towards the house as far as it is needed. The
contractor proposes a monolithic pour of the turndown area and the remainder of the deck using
a fiber additive in the concrete. In the area of the turndown, the contractor proposes that the wall
will be 8" thick and contain 145 reinforcing bar in its base and 143 bar at the top of the
turndown and 143 bar vertically at 36" on center between the horizontal # 3 bar and the
horizontal # 5 bar.
When the base of the turn -down extends
into the original around soil, a pilaster will
not be required.
They will install 4" diameter pilasters every 5
feet under the turndown and as a part of the
turndown that will be either 2' into the ground
or to the indigenous material, which ever is
deeper. They will also install a #3 reinforcing
bar in the pilaster and tie it into the reinforcing
bar in the base of the vertical pour. All other
construction procedures and specifications
will be in accordance with the contractor's
specification sheet on file with the building
department.
Based on this data, I feel that the construction
procedure to be utilized in this instance
complies with sound construction practice, is
in accordance with the Florida Building Code,
Building 2004, and Florida Building Code,
Residential 2004 and will not derogate the
quality of the pool deck being constructed for
the home owner and is acceptable.
