Acceptance This proposal becomes a binding AGREEENT between Buyer(s) and Preferred Fence, L.L.C. (the
Company) when signed below by Buyer(s).
it is understood and agreed that the Company -is relying upon the prompt and timely performance by
the Buyer(s) of any and all duties and obligations of the Buyer(s) of any and all duties and obligations
of the Buyer(s) hereunder, including, but not limited to, PAYMENT on the date and in the manner specif-
ically stated herein, time being of the essence. In the event the Buyer(s) breach(es) this agreement.
the Buyer(s) agree(s) that the Company shall be entitled to any COURT COSTS and reasonable
ATTORNEY'S FEES incurred in the enforcement of this agreement, plus interest on the unpaid bal-
ances from the due date in this agreement until payment is received by the seller at the highest rate of
interest allowed by law in the State of Florida.
Alteration This AGREEMENT may not be altered except by the written consent of the parties.
Lien- By virtue of the improvements made pursuant to this contract upon the subject real property, the
Company has the right to file a NOTICE TO OWNER under Section 713.06, Florida Statutes, and a
CLAIM OF LIEN under Section 713.08, Florida Statutes, to enforce its mechanics lien in the event pay-
ment by the Buyer(s) is not made pursuant to this contract.
Cancellation Should Buyer(s) cancel the AGREEMENT, Buyer(g) recognize(s) that the Company has suffered dam-
ages resulting from ordering appropriate supplies and preparing its performance. Cancellation prior to
the commencement of work is therefore subject to a charge of 25% of the contract price.,
Additional Terms The parties.agree..that upon .installation the materials supplied pursuant to this contract become part of
the REAL;PROPERTY and an IMPROVEMENT thereon.
Furthermore, Buyer(s) represent(s) to the Company that he, she or they hold(s) legal title to the sub-
ject real property or is (are) authorized to act as age.nt(s) for the true owner(s).
Further, Buyer(s) is (are) solely responsible for locating, staking and clearing fence lines. Buycr(s) also
agree(s),.to_be solely responsible for damage of any nature to underground obstructions and to indem-
nify the Company. from any liability which it'might.incur pursuant to the services involved in the per-
formance of this AGREEMENT.

On. May 8, 2007 the Development Review Team recommended conditional
approval, which was granted on May 16, 2007 by the Administrative Official
allowing a 6 foot high PVC fence in the street front side yard stipulating that the
fence must stay in line with the curve of the sidewalk, setback 10 feet or
constructing the fence such that it is on a straight line at least 10 feet from the
sidewalk:
Application of the setbacks shall apply to the proposed 6 foot high PVC only. All
prop osed construction shall be permitted and inspected by the Building Division.
Should the property be redeveloped or new construction be considered on the
property in the future, then all applicable area and dimensional requirements (i.e.,
setbacks) shall apply.
Be on notice that appeals of the above decision may 'be made to the City
Commission by any person aggrieved or by any officer, board or agency of the
City including the City commission within thirty (30) calendar days of the
Administrative Official's action. Appeal applications may be obtained in the
office 'of the Plaming and Community Development, if you choose to -tile an
appeal, please submit the original and one copy of the Notice of Appeal to the
City Clerk.
