CONSTRUCTION CONTRACTING
Owners of property when acting as their own contractor and providing direct, onsite supervision
themselves of all work not performed by licensed contractors, when building or improving farm
outbuildings or one -family or two-family residences on such property for the occupancy or use of such
owners and not offered for sale or lease, or building or improving commercial buildings, at a cost not to
exceed $25,000, on such property for the occupancy or use of such owners and not offered for sale or
lease. In an action brought under this part, proof of sale or lease, or offering for sale or lease, of any such
structure by the owner -builder within 1 year after completion of same creates a presumption that the
construction was undertaken for purposes of sale or lease. This subsection does not exempt any person
who is employed by or has a contract with such owner and who acts in the capacity of a contractor. The
owner may not delegate the owner's responsibility to directly supervise all work to any other person
unless that person is registered or certified under this part and the work being performed is within the
scope of that person's license. For the purposes of this subsection, the term "owners of property"
includes the owner of a mobile home situated on a leased lot. To qualify for exemption under this
subsection, an owner must personally appear and sign the building permit application.
State law requires construction to be done by licensed contractors. You have applied for a permit under
an exemption to that law. The exemption allows you, as the owner of your property, to act as your own
contractor with certain restrictions even though you do not have a license. You must provide direct,
onsite supervision of the construction yourself. You may build or improve a one -family or two-family
residence or a farm outbuilding. You may also build or improve a commercial building, provided your
costs do not exceed $25,000. The building or residence must be for your own use or occupancy. It may
not be built or substantially improved for sale or lease. If you sell or lease a building you have built or
substantially improved yourself within 1 year after the construction is complete, the law will presume that
you built or substantially improved it for sale or lease, which is a violation of this exemption. You may
not hire an unlicensed person to act as your contractor or to supervise people working on your building. Ii
is your responsibility to make sure that people employed by you have licenses required by state law and
by county or municipal licensing ordinances. You may not delegate the responsibility for supervising
work to a licensed contractor who is not licensed to perform the work being done. Any person working
on your building who is not licensed must work under your direct supervision and must be employed by
you, which means that you must deduct F.I.C.A. and withholding tax and provide workers' compensation
for that employee, all as prescribed by law. Your construction must comply with all applicable laws,
ordinances, building codes, and zoning regulations.

Planning & Zoning Staff:
This letter is a request to approve barbwire attachment to the previously approved site
plan including a 6 foot vinyl coated fence along the south and east sides of the above
listed property.
The following are written explanations of how and why our request meets the City of
Sanford's standards as shown on Attachment "A".
1. In the City of Sanford's codes and regulations Section Eon page J-10 states "The
term chain link fence shall specifically include barbed wire, chicken wire, hog
wire, chain link fence and other similar wire type fencing materials as determined
by the Administrative Official."
Response: The proposed 6 foot vinyl coated chain link fence was approved to be
added to the south and eastern sides of the above listed properties at the January
2005 meeting. As listed above — the term chain link includes barbwire.
2. Section E Item 1 on Page J-10 states, "All Development. Chain link fences shall
be prohibited within the required front yard; provided, however, that such fencing
shall be permitted along side parcel lines with in the front yard as a foundation for
shrubbery or other landscape decorations."
Response: The issue of the chain link fence being installed in the "front yard" was
approved at the meeting on January 6, 2005.
3. Section E Item 3 on page J-11 states, "Residential Areas. Barbed wire, razor
wire, concertina and other types of sharp edged fencing shall not be located in or
adjacent to residential zonings."
Response: As shown on Attachment "B" to this package, all adjacent properties city
and county are industrial and commercial.
4. Section E Item 4 page J-I I, "Prohibited in Buffer. Barbed wire and/or chain link
fencing are prohibited in all required buffer areas."
Response: Along proposed fencing is outside of the required 10 foot buffer area for
both Old Lake Mary and Country Club Roads.
5. Section E Item 5 page J-11, "Permit required. All fences shall be required to be
permitted."
Response: This request is apart of the permit application to install the barbwire and
chain link fence.
In addition to meeting all requirements of the City of Sanford, we have enclosed
Attachment "C" which is a site plan of the property and the proposed fence along with
color codings of the already existing barbwire in the area. The Yellow designates the
proposed fence and the pink designated the existing chain link with barbwire. The
property already has 2/3 covered with standard chain link and barbwire. The added areas
will be vinyl coated chain link and barbwire extensions. In additional all surrounding
properties have barbwire chain link fence as shown in Attachment "D" pictures.
As you are aware, the property will be a storage yard for Cato Environmental Services,
Inc. landscape and lawn maintenance contractor. Sue to the nature of our business and
the high volume of easily removed hand equipment (edgers, weed -eaters, chainsaws,
back pack blowers, etc.) we are at high risk. Attachment "E" shows a current police
report from last week showing 5 pieces of equipment last were stolen from our current
location, which only has a 6 R wood fence without barbwire.
As we have itemized above, we are truly in compliance with all City of Sanford Codes
and Regulations to install a chain link fence with barbwire. We are using vinyl coasted
material as well as a heavy landscape buffer of 4" cal Live Oaks and 30" Viburnum

Vehicular access to off-street parking, loading, unloading and service area space
subject to the following provisions:
All of the provisions of the Schedule relating to vehicular access points to
off-street parking, loading, unloading and service area space shall be
complied with throughout the entire depth of the required buffer.
b. All such vehicular access shall be required to be generally perpendicular to
the street right-of-way line throughout the entire depth of the required buffer.
2. Public utilities, as needed.
3. Permitted public service structures.
4. Walkways with improved surfaces.
Permitted signs.
Required landscaped areas.
D. Vehicular Encroachment Prohibited. All off-street parking and/or loading, unloading and
service areas and all other vehicular circulation areas shall be located, designed and arranged
so as not to encroach upon any required buffer. In addition, all off-street parking spaces
located adjacent to a required buffer shall be provided with appropriate tire stops, curbs, or
other vehicular bumper guards designed to prevent any encroachment of vehicles upon the
required buffer.
E. Fencing. These land development regulations apply to all types, styles and fence materials
that are generally referred to and commonly known as fencing or fences. Fencing shall
1 contribute to the overall character of a neighborhood.
The term "chain link fence" shall specifically include barbed wire, chicken wire, hog wire,
chain link fence and other similar wire type fencing materials as determined by theAdministrativeOfficial.
All Development. Chain link fences shall be prohibited within the required front
yard; provided, however, that such fencing shall be permitted along side parcel lines
within the front yard as a foundation for shrubbery or other landscape decoration.
Any such chain link fence located within a front yard shall be no greater than four (4)
feet in height and all parts of the fence and its supporting structure shall be vinyl
coated and of a color approved by the Administrative Official.
2. All Development. Fencing and gates within front yards shall be of a decorative type
and semi -transparent. Fences within the front yard shall not be solid or shadow-
boxed. Fences shall in no case be greater than four (4) feet in height. All fencing
shall be made out of attractive long-lasting materials.

Recommended fence types include wood or metal picket, ornamental wrought iron or
aluminum, decorative PVC or vinyl.
Residential Areas. Barbed wire, razor wire, concertina and other types of sharp -
edged fencing shall not be located in or adjacent to the following residential zoning
districts: SR-1, SR-lA, SR -IAA, SR-2 or MR-], MR-2 and MR-3 and residential
areas within PD and RMOI Zones.
Prohibited in Buffer. Barbed wire and/or chain link fencing are prohibited in all
required buffer areas.
Permit Required. All fences shall be required to be permitted.
Variances. The Board of Adjustment shall have the authority to consider variances
to the fencing provisions for single family and two family dwellings. The Planning
and Z oning C ommission m ay c onsider v ariances t o the f encing p rovisions for
multiple family dwellings and nonresidential uses. In the process of reviewifig such
variances, the existing characteristics of the subject neighborhood shall be
considered, a specially a nd p articularly w ith regard to the incidence of 1 awfully
existing chain link fences already established in such neighborhoods.
F. Grade Changes in Buffers. If a topographical grade change occurs within a buffer that is
adjacent to a residential development or a residential zoning district, the grade change shall
be gradual. The grade change may either terminate at the property line in the natural pre -
construction grade elevation of the site and of the adjacent sites or may terminate in one (1)
or two (2) retaining walls, provided that the retaining walls are each limited to three (3) feet
in height. All retaining walls shall be designed by a certified structural engineer.
SECTION 3.3 VISUAL SCREEN
A visual screen shall be provided as required by the provisions of this Schedule. The required visual
screen shall be approved by the Planning and Zoning Commission and shall be maintained in good
condition and in conformity with this Schedule for as long as the use continues to exist. The
required visual screen shall be free of all advertising or other signs. Two (2) types of visual screen
shall be defined as follows:
A. Type One, Masonry Wall. A Type One visual screen shall mean a continuous, non -
perforated and solid masonry wall at least six (6) feet in height, except where a lesser or
greater height is required by these land development regulations. Such required wall shall be
constructed, of cement block, brick or other similar masonry material. If the wall is
constructed of cement block, with the exception of decorative concrete block, the side
facing the abutting use shall be faced with stucco or another similar decorative finish. If no
solid wall or fence exists on the adjoining property, the landscape material shall be placed on
the side of the wall adjacent to the adjoining property. The landscape buffer area shall be
planted with two (2) rows of canopy trees. The trees shall be four (4) inches in diameter at
breast height at planting. The trees shall be spaced every twenty-five (25) feet in each row.
Between rows, the trees shall be staggered so as to be midway between each other, an equal
