Residential Swimming Pool Contract:
1. PARTIES: Agreement between Artesian Pools, Inc., hereinafter called the Contractor, and
hereinafter called the Owner.

event, prior to the utilization of the pool by the Owner. Extras are in addition to the contract price and shall be paid on installation. Progress payments and payments for
extras am payments for completed work, and if not paid within 10 days from their due date they shall bear interest at the rate of 18% per annum until paid.
The contract price is for all materials, equipment, and labor required for the construction of the swimming pool graphically described in the pool plan signed by the
Owner and generally described in the specifications section below. Furthermore, if Owner finances pool with Contractor, this agreement is subject to the Home Improve-
ment Installment Contract and Mortgage executed by Owner(s).

5. LIMITED WARRANTIES: 'Artesian Pools, Inc. agrees to substantially complete the work contracted for in a workman like manner and to repair or replace items
covered by these limited warranties provided the Owner has paid all amounts due the Contractor under the contract and furnishes the Contractor written notice of defect
or malfunction within the warranty period.
A. LIMITED STRUCTURAL WARRANTY: Artesian Pools, Inc. warrants to the original Owner "or his transferee" for the lifetime of the original purchaser, the swimming
pool structure, (the shell), will not leak due to cracking. The shell does not include the finish coat, tile, cantilever or materials and equipment external to the pool. Upon
inspection and acceptance (by the Contractor) of the pool structure and the payment of a $125.00 fee the Contractor agrees to a one time transfer of the limited structural
warranty to a transferee from the original Owners for the transferee's lifetime.
This Limited Structural Warranty does not cover damage to the pool shell caused by construction in the vicinity of the pool site, or natural phenomenon. This Limited
Structural Warranty is void if the pool is not kept full at all times.
The Contractor's responsibility under this Limited Structural Warranty shall be to repair the shell so that it holds water, without cost to the original Owner, except that
it is the Owner's responsibility to furnish water, power, access, and chemicals. The method of repair shall be at the discretion of the Contractor.
B. POOL FIXTURE AND MATERIAL INSTALLATION LIMITED WARRANTY: Artesian Pools, Inc. warrants for a period of one (1) year from the date of initial chlorina-
tion of the pool, subject to the limitations hereinafter set forth, that the following items furnished and installed by the Contractor are free of material defects in material and
equipment installation. Defects caused by misuse, neglect or failure to maintain proper chemical balance or other causes or phenomenon beyond the control of the
Contractor are not covered. THREE YEAR TILE AND DECK WARRANTY. LIFETIME UNDERGROUND PLUMBING WARRANTY.
1. Tile: Color and texture may varyfrom sample. Waterline tile is warranted to be free from defects in material and workmanship for three years from date of initial chlorination.

Concrete Decking and Finished Coatings Installation: It is anticipated the concrete deck and deck coatings may crack due to settling of deck or weather. Cr_ "one ---quarter inch in width or less with no substantial deviation in elevation are not covered. Stains or discoloration appearing after initial chlorination are not covered.

Shell Finish coat Installation: The Contractor warrants the shell finish coat for a period of five years from the date of initial chlorination, to be free from defects in
material and workmanship under normal use and service but, the Contractor does not warrant, either expressly or implied, that the finish coat will not discolor or stain inasmuch
as this problem is commonly due to conditions beyond the control of the Contractor, such as local water conditions or improper chemical use or lack of cleaning. 4. Installation of Finished Products Purchased by Contractor: The repair, replacement or servicing of the finished products purchased by Contractor is not covered
by Contractor's warranty. These products are generally subject to manufacturer's warranties and the Contractor makes no express or implied warranties including the
warranty of merchantability or fitness for a particular purpose beyond the description of the product. Responsibility
of Artesian Pools, Inc. to the original Owner under this Limited Warranty is to provide necessary labor and material to repair the defective material or equipment
installation covered hereby. For a period of one (1) year after chlorination there shall be no service charge for any warranty work required to be done by the Contractor
under this warranty. However, if the requested service is not covered by the warranty and the Contractor agrees to perform the requested service the Owner agrees
to pay the Contractor for his usual service charge plus reasonable charges for labor and materials. THE
CONTRACTOR MAKES NO OTHER EXPRESS WARRANTIES, OR IMPLIED WARRANTIES INCLUDING THE WARRANTY OF MERCHANTABILITY AND FIT- NESS
FOR A PARTICULAR PURPOSE IN REGARDS TO THE POOL STRUCTURE, (THE SHELL) FIXTURES, EQUIPMENT, AND MATERIALS SOLD OR INSTALLED. 6.
BUYERS RIGHT TO CANCEL: The Contractor shall not be obligated to commence construction of this pool until three days after the signing of this contract by the Owner. Since this contract may be construed as a Home Solicitation Sale, Purchaser is hereby notified of his right to cancel under the Home Solicitation Sales Act. RIGHT
TO CANCEL: This is a Home Solicitation Sale. If you do not want the goods or services contracted for, you may cancel this agreement by mailing a notice to seller. This
notice must indicate that you do not want the goods and services and must be postmarked by midnight the third day after you signed this agreement. 7. OFFER AND AGREEMENT: This contract shall be deemed an offer to Artesian Pools, Inc., and shall be null and void unless accepted by a duly authorized officer of
the Contractor within ten days of the date and year noted above the Owner's signature(s). The salesman has no authority to bind the Contractor. All agreements and understandings
are contained in this contract, and the Owner warrants that there are no agreements or understandings other than are set forth in this document. Accep- tance
of the terms of this contract by Contractor is to be communicated to the Owner by transmitting a copy of this contract to them showing acceptance by the sellers by the
execution of a duly authorized officer of the Contractor or by commencing construction. NOTICE
