OCCUPANT LOAD AND MEANS OF EGRESS CAPACITY
§1003.1 Occupant load
§1003.1.1 For determining the means of egress required, the minimum
number of persons for any floor area shall in no case be taken less than
specified in Table 1003.1.
EXCEPTIONS:
1. In a special purpose factory -industrial occupancy, the occupant load
shall be the maximum number of persons to occupy the area under any
probable conditions.
2. The occupant load for towers shall be the number of persons expected
to occupy the space, with spaces not subject to human occupancy
because of machinery or equipment excluded from the gross area
calculation.
§1003.1.2 The occupant load of any occupancy may be determined in
accordance with §1003.1 when the necessary aisles and means of egress
are provided as approved by the building official. An aisle, egress and
seating diagram shall be provided to the building official to substantiate
the occupant load.

1. The occupant load for an area having fixed seats installed shall be
determined by the number of fixed seats. Capacity of seats without
dividing arms shall equal one person per 18 inches (457 mm). For
seating booths, one person per 24 inches (610 mm).
2. See §202 for definitions of gross and net floor areas.
3. The occupant load of floor areas of the building shall be computed on
the basis of the specific occupancy classification of the building.
Where mixed occupancies occur, the occupant load of each occupancy
area shall be computed on the basis of that specific occupancy.
4. For the purpose of determining occupant load in mercantile occupancies
where, due to differences in grade of streets on different sides, two
or more floors directly accessible from streets exist, each such floor
shall be considered a street floor. The occupant load factor shall be
one person for each 40 ft^2 (3.7 m^2) of gross floor area of sales
space.

ASSEMBLY OCCUPANCY - GROUP A
§304.1 Scope
§304.1.1 Group A occupancy is the use of a building or structure, or any
portion thereof, for the gathering together of 50 or more persons for such
purposes as civic, social or religious functions or for recreation, or for
food or drink consumption or awaiting transportation. Assembly
occupancies also include special amusement buildings regardless of
occupant load.
§304.1.2 Group A occupancy shall include, among others, the following:

§304.2.1 Assembly occupancies shall be divided into two
subclassifications as set forth in this section, both of which shall
comply with the requirements for Group A occupancy unless otherwise
specified:
1. A-1: Large Assembly shall include theaters and other places of
assembly with an occupant load of 1,000 or more persons. Large
Assembly shall also include theaters and other places of assembly
with a stage requiring proscenium opening protection and with an
occupant load of 700 or more persons.
2. A-2: Small Assembly shall include theaters and other places of
assembly with or without a stage requiring proscenium opening
protection and with an occupant load of 50 or more persons, but with
an occupant load less than designated for Large Assembly.
§304.2.2 Occupancy of any room or space for assembly purposes by fewer
than 50 persons in a building or other occupancy and incidental to such
other occupancy shall be classified as part of the other occupancy and
shall be subject to the provisions applicable thereto.
§304.2.3 Restaurants and drinking establishments not located within
another occupancy with an occupant load of less than 50 persons shall be
classified as Group M, Mercantile.

§1004.1 Arrangement of exits
§1004.1.1 Exits shall be so located that the distance from the most
remote point in the floor area, room or space served by them to the
nearest exit, measured along the line of travel, shall be not more than
the travel distance specified in Table 1004.

§704.1 Occupancy separation requirements
§704.1.1 The minimum fire resistance of construction separating any two
occupancies in a building of mixed occupancy shall be the higher rating
required for the occupancies being separated, as specified in Table 704.1.

2. Rated separation is not required for day-care occupancies in assembly

3. In apartment occupancies containing a day -care occupancy, where the
two exit accesses from the day-care occupancy enter the same corridor
as the apartment occupancy, the exit accesses shall be separated in the
corridor by a smoke barrier having a fire resistance rating of not less
than 1 hour. The fire rated smoke barrier shall be located so that
there is an exit on each side.
4. Fire rated separation is not required for day-care homes in assembly
occupancies used primarily for worship.
§704.1.2 Accessory occupancies
§704.1.2.1 Portions of buildings used as accessory offices or for
customary nonhazardous uses necessary for transacting the principal
business in Group S and Group F occupancies need not be separated from
the principal use. Group F occupancies producing, using or storing low
hazard contents as listed in §312.2.2 or as approved by the building
official need not be considered mixed occupancies. Height and area

being build per plans and specs and more importantly per code. We have previously issued the
attached report to owner. Additionally Tom Adams structural Engineer of record from CEG also
issued his attached letter. At this time, because of the gross deviations from the Contract
Document and the lack of any submittals as evidence as to what was constructed in the field, The
Scott Partnership Architecture, Inc. and its Consultants, Construction Engineering Group are
required to not accept any liability for this project. This project is deemed to be not constructed
per the Contract Document and not acceptable to this office or that of CEG. We would like to
have ourselves and CEG removed from the permit as Architect and Engineer of Record
respectively. It is our opinion that this project so deviates from the design and the Florida
Building Code that it will certainly have to be re -permitted, but likely torn down and re -built.

I visited the site on April 11, 2005 and issued a status report to the owner. Additionally Tom
Adams structural Engineer of record from CEG also issued his letter. At this time, per AIA A-201 1997
paragraph 14.2.2, because of the gross deviations from the Contract Document and the lack of any
submittals as evidence as to what was constructed in the field, The Scott Partnership Architecture, Inc.
is advising the owner that there is adequate information available to terminate with cause the Contract
with the General Contractor, Waterford Quality Homes. This project is deemed to be not constructed
per the Contract Document and not acceptable to this office or that of CEG, likewise the owner is not
accepting this structure. The following are a few of the deviations that are cause to condemn this
structure.
1. 2500# concrete used in lieu of 3000# as required, City should have been copied on test reports.
2. #40 steel used in all footing, walls, tie beams, bond beams and filled cells, in lieu of #60 steel as
required.
3. Top and bottom chord of trusses designed as 2" x 6" installed as 2" x 4" not acceptable.
4. 25 gallons of water added to the NE corner of the slab, not acceptable, City should have been
copied on test reports.
5. Truss anchorage way undersized and approximately 25% embedment into tie beam. Not
acceptable. Cannot very pullout load.
At this time we are asking the City of Sanford, to deem this project condemned so that the owner may
initiate demolition and re -construction under separate permit.

As you know, we met Mr. George Hart, (the owner's representative) at the
project site to review the progress of construction. From my visual observations
and discussions with Mr. Hart, the following is a list of deficiencies that were noted
while on site.
The specified truss anchorages have been changed from LTA1 straps to
MTSM16 straps. I noticed that several of these MSTM16 straps have not
been installed properly. There are screws missing from the bottom parts of
the straps. Also the girder truss anchors have been changed from the
specified HGT to an MGT anchor. A copy of the truss shop drawings should
be provided to us so that we may review these changes. The contractor
must provide a letter from the local inspecting agency (the city of Sanford
building department) stating that these anchors have been inspected
and properly installed.
2. All trusses have been provided with 2x4 top and bottom chords. Our
structural drawings specify 2x6 top and bottom chords. The contractor will
have to provide a signed and sealed letter from the truss manufacturer's
engineer that they have field inspected these trusses and they will carry
the intended loads.
3. There is a truss on the northeast side of the building that has had the heel
cut and the support condition modified. It appears a "plywood" gusset
has been applied to the modified heel of the truss and the support for the
truss has been changed to a face mounted hanger that has been
screwed to the masonry wall. A sketch of this modification should be
supplied to CEG so that we evaluate the adequacy of the connection of
the truss to the wall. Also the contractor must provide a signed and
sealed letter form the truss manufacturer's engineer stating that the
modified truss heel is adequate to carry the intended loads.
4. The window and door bucks have not been attached to the cmu walls
per the structural drawings. The contractor must provide a letter from the
local inspecting agency (the city of Sanford building department) stating
that these anchors have been inspected and properly installed.
5. Saw cuts were not installed in the slab on grade. Weld wire mesh was
VE'ed before construction began. Fibermesh does not appear to have
been added to the concrete mix. Random cracks in slab will occur.
Cracks in floor finishes such as the will be likely.
6. Foundation thickness measured at 13" instead of the specified 18". Also,
Mr. Hart indicated that grade 40 reinforcing was used instead of grade 60
as specified on the structural documents. The decreased depth and
lower strength reinforcing could lead to future cracks in the footings and
walls. The contractor must provide a letter from the local inspecting
agency (the city of Sanford building department) stating that these
footings were inspected and the width (2'-1 ") was maintained for the
bearing of this footing. Also a copy of the compaction or density tests for
the foundation bearing levels should be provided.
7. 1 observed that the dowels that were installed for the brick ledge that was
not poured contiguous with the monolithic footing were not installed per
the provided sketch. At least 3" of cover needs to be maintained around
the epoxied anchors. These anchors need to be installed into the vertical
face of the existing footing. (All excess concrete and soil need to be
removed from the side of the monolithic footing.) All soils below this brick
ledge foundation need to be compacted to 98% of the modified proctor
maximum dry density. Currently, the installation of the dowels and
reinforcing is not acceptable and should be removed and properly
installed. An inspection agency shall be hired to inspect the bearing
levels of the soils for proper compaction and installation of the anchors
per the sketch SKI.
8. Per conversations with Mr. Hart, it appears that a 2500 psi concrete mix
was used for the foundations. At the time of visit, we found several of the
batch tickets in the permit box which indicated that 20 to 25 gals of water
were also added to the truck mix at the time of placement. Sample
cores, (at least 4) should be taken from the slab and foundation and
tested to determine if the concrete has sufficient strength to carry the
intended loads.
