AN ORDrNANCE OF THE CITY OF SANFORD, FLORIDA,
ESTABLISHING A NE~V PROCEDURE FOR THE VACATING
AND ABANDONING OF ROADS, STREETS, ALLEYS AND
EASEMENTS IN THE CITY OF SANFORD, FLORIDA, AND
PROVIDING FEES THEREFOR, SAID ORDINANCE REPLACING
ORDINANCE NO. 598 OF THE CITY OF SANFORD, FLORIDA.
BE IT ENECTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA:
SECTION 1. Any person or persons or body corporate desiring
the abandonment or vacating of any road, street, alley or easement within
the corporate limits of the City of Sanford0 Florida, shall file a request for
such abandonment and/or vacating with the City Manager of the City of Sanford,
Florida, stating therein a description of the road, street, alley or easement
to be abandoned. At the time of filing such a request the applicant would
deposit a fee to cover the costs of the proceeding in an amount to be determined
and adopted from time to time by the City Commission. Upon such request,
the City Commission shall authorize a public hearing at a definite date, time
and place to be held to consider the advisability of such abandonment. The
City Commission shall caused to be published one notice of such public hearing
in a newspaper of general circulation in the City of Sanford, Florida, at least
two weeks prior to the date stated therein for such hearing. In addition to the
publication of notice, notice shall be sent by Certified Ma[lo Return Receipt
Requested, to all property owners within the Block or Blocks on either side
of that portion of the road, street, alley or easement to be vacated or abandoned.
After such public hearing, any action of the C[ty~Commlss[on as herein
authorized shall be established by an Ordinance duly adopted and entered upon
the Minutes of the City Commission of the City of Sanford, Florida. Notice
of the adoption of such Ordinance shall be published one time in a newspaper
of general circulation in the City of Sanfordo Florida, w ithin thirty days following
its adoption, and the Ordinance as adopted shall be recorded in the Official
Records of Seminole County, Florida.
SECTION 2: Ordinance No. 596 and all other Ordinances or
parts o~ Ordinances in conflict herewRh be and the same are hereby
repealed.
SECTION 8: This Ordinance shall become effective immediately
upon its passage and adopt[on.
