CITY COMMISSION MEMORANDUM 26-003
JANUARY 12, 2026 AGENDA
TO: Honorable Mayor and Members of the City Commission
PREPARED BY: Owen Christopher Smith, Project Planner
SUBMITTED BY: Norton N. Bonaparte Jr., ICMA-CM, City Manager
SUBJECT: Partial Right Of Way Vacation; Avocado Avenue; 300 Block of Avocado
Avenue; Ordinance No. 2025-4841
SYNOPSIS:
A petition to vacate a partial of the right-of-way of Avocado Avenue by the petitioner, AVCON,
Inc., c/o Ryan Von Weller (agent/developer) for Sanford Housing Authority (who is the requesting
property owner) by means of the enactment of Ordinance No. 2025-4841.
FISCAL/STAFFING STATEMENT:

BACKGROUND:
The petitioner/developer, in an effort to develop the vacant property (former Cowan Moughton and

The developer, Wendover Husing Partners, intend to construct an 80-dwelling unit multi -family
housing complex (Carisbrooke Terrace) of these effected parcels including a smaller neighboring
parcel to the south in a phased construction approach and as such, the vacate would be required for
the area between the two phases.
As part of this approval, and as it is apparent that many utilities within the aforesaid right-of-way,
and as such the City will require the developer to relocate all utilities as maybe required by and to
the satisfaction of the City. The developer will also be required to provide any future utility
easements as may be required by the relocation of utilities, right-of-way vacation or planned
development requirements and such instruments will be in a form acceptable to the City Attorney.
The City Clerk sent letters to the area utility providers requesting information regarding utilities
and a recommendation regarding the request to vacate. All utility providers were given a "no
1
response date" of November 6, 2025 at which time the City considers the no -response as indication
that "no utilities within the vacate request area exist" and therefore, "no objection" is expressed to
the requested vacate.
