Ordinance No. 2026-4847 An ordinance of the City of Sanford, Florida providing for the Planned Development rezoning for real property to amend the Jesus Image PD located at project address 2867 East Lake Mary Boulevard by adding real property totaling approximately a 19.76 acres in size and assigned Tax Identification Parcel Nos. 17-20-31-300-0010-0000, 17-20-31-501- 0000-0220, and 17-20-31-501-0000-0150, which is generally addressed as 3850 Sipes Avenue within City Limits (map of the property attached); providing for the taking of implementing administrative actions; providing for the adoption of a map by reference; repealing all conflicting ordinances; providing for severability; providing for non -codification and providing for an effective date. Whereas, Jesus Image, Inc., whose treasurer is Julie Noble, is the owner of certain real property which totals approximately 19.76 acres in size; and Whereas, the property owner's representative applicant, Constance D. Silver, P.E., LEED AP, Tri3 Civil Engineering Design Studio, Inc, has made application for the owner. A Citizens Awareness and Participation Plan (CAPP) meeting was held on August 25, 2025, to the satisfaction of the City relative to which the required CAPP report was submitted to the City; and Whereas, the subject property is located at 3850 Sipes Avenue and is assigned Tax Parcel Identification Nos. 17-20-31-300-0010-0000, 17-20-31-501-0000-0220, and 17-20-31-501-0000-0150 by the Property Appraiser of Seminole County; and Whereas, the subject property is a 28.24-acre site located on the south side of Lake Mary Boulevard, just east of Wyndham Preserve and approximately 1,200 feet west of Brisson Avenue. The property consists of three parcels arranged in a north —south configuration. The northern and middle parcels are separated by a 20-foot-wide, unnamed east —west right-of-way. The two southern parcels do not have direct access to Lake Mary Boulevard, but may be accessed through the northern parcel, which shares common ownership. The southernmost parcel also has direct access from Sipes Avenue; and Whereas, the applicant seeks to construct a House of Worship with associated accessory uses, including office space and a future daycare facility. The existing single-family residence along Sipes Avenue is proposed to remain. The proposed church use is consistent with the previously approved Planned Development (PD) zoning on the parcels to the north. However, the southern parcel remains under Seminole County Agriculture zoning. To bring this parcel into the City and establish a consistent regulatory framework, the applicant has submitted a companion Annexation and Comprehensive Plan Amendment request to change the future land use designation from Suburban Estates (SE) to Low Density Residential Single -Family (LDR-SF); and Whereas, the amended PD Master Plan increases the overall land area by 19.76 acres but does not increase the approved development intensity. The Master Plan identifies a 35,163-square-foot main place of worship on the 5.43-acre middle parcel, along with a 3,000-square-foot prayer house on the western portion of the southern 19.76-acre parcel being added to the PD. A future building is also shown on the northern parcel fronting East Lake Mary Boulevard, although no specific use or minimum square footage has been designated at this time. The proposed retention ponds have been relocated to the southwestern portion of the site, and the existing single-family residence along Sipes Avenue is proposed to remain; and Whereas, the property owner is seeking a proposed amendment to the Planned Development zoning to allow the subject property to function as an ancillary house of 21 prayer and to accommodate additional infrastructure supporting the existing Planned Development.; and Whereas, on November 8, 2021 (Ordinance 2021-4638), the City Commission approved a Comprehensive Plan Amendment amending the future lands use of the northern 5.43 acres property, proposed to be developed in conjunction with the subject property, from Suburban Estate (SE) (Seminole County) to Low Density Residential - Single Family (LDR-SF); and Whereas, the City's Planning and Development Services Department has conducted a thorough review and analysis of the demands upon public facilities and general planning and land development issues and has otherwise reviewed and evaluated the application and determined that it comports with sound and generally accepted land use planning practices and principles as well as whether the application is consistent with the goals, objectives and policies set forth in the City's Comprehensive Plan; and Whereas, on February 5, 2026, the City's Planning and Zoning Commission of the City of Sanford recommended that the City Commission approve the amendment to the Jesus Image PD by incorporating and rezoning a 19.76 acre parcel from A-1, Agriculture (Seminole County) to PD, Planned Development (City of Sanford) to allow to retain a single family home and allow a proposed House of Worship with ancillary and associated uses at project address 2867 East Lake Mary Boulevard and 3850 Sipes Avenue subject to a Development Order containing the following conditions set forth in detail below; and Whereas, professional City planning staff, the City's Planning and Zoning Commission and the City Commission have determined that the proposed amendment of the Planned Development as set forth in this Ordinance is consistent with the Comprehensive Plan of the City of Sanford, the land development regulations of the City of Sanford, and the controlling provisions of State law; and Whereas, the City Commission of the City of Sanford, Florida has taken, as implemented by City staff, all actions relating to the amendment set forth herein in accordance with the requirements and procedures mandated by State law and all prior land use actions of the City are hereby ratified and affirmed; and Whereas, this Ordinance is enacted pursuant to the home rule powers of the City of Sanford as set forth in Article Vill, Section 2 of the Florida Constitution, Chapter 166, Florida Statutes, and other controlling law. Now, therefore, be in enacted by the People of the City of Sanford, Florida: Section 1. Legislative Findings and Intent. (a). The City Commission of the City of Sanford hereby adopts and incorporates into this Ordinance the City staff report and City Commission agenda memorandum relating to the application relating to the proposed rezoning of the subject property as well as the recitals (whereas clauses) to this Ordinance. (b). The City of Sanford has complied with all requirements and procedures of Florida law in processing and advertising this Ordinance. 41 (c) This Ordinance is internally consistent with the goals, objectives and policies of the Comprehensive Plan of the City of Sanford. (d) The exhibits to this Ordinance are incorporated herein as if fully set forth herein verbatim. Section 2. Planned Development Amendment/Conditions Approved. (a). Upon enactment of this Ordinance the following described property, as depicted in the map attached to this Ordinance, and totaling 19.76 acres in size, the planned development shall retain a single family home and allow for a proposed House of Worship with ancillary and associated uses at project address 2861 E Lake Mary Boulevard and 3850 Sipes Avenue subject to a Development Order containing the following conditions as follows: 1. Pursuant to Article 4 Section 4.0, B.6.c of the Land Development Regulations (LDR) of the City of Sanford, this rezoning shall expire 3 years from the effective date of this Ordinance if all improvements have not been completed or an extension granted. 2. All other Conditions in Development Order No. 21-44 shall remain in effect. 3. The property shall be developed generally in accordance with the land uses and development standards identified on the Jesus Image Church PD Master Plan dated as revised, November 7, 2025, unless otherwise specifically set forth in any associated development order; provided, however, that all subsequent development orders shall be consistent with the provisions of this Ordinance. 4. Any development standards within the PD that are not expressly addressed on the Master Plan shall default to the applicable requirements of the GC-2, General Commercial zoning district, including dimensional standards, buffering, landscaping, and any required commercial -to -residential transition measures. Development must also comply with the Lake Mary Boulevard Gateway Corridor requirements in Schedule U, relevant sections of Schedule J, Landscape, Buffer and Tree Requirements, along with all other relevant provisions of the City's Land Development Regulations. No Conditional Uses shall be permitted unless otherwise identified and approved as part of the rezone. 5. A commercial component, a minimum of 1,800 square feet, meeting the architectural requirements of Schedule G, Sanford LDR, shall be located within the first 100 feet of the Lake Mary Boulevard frontage. 5� 6. North —south parking lot drive aisles shall not exceed 300 linear feet without an east -west drive aisle break, where double rows of parking is proposed. The Planning and Zoning Commission voted to recommend the removal of this condition, as it is no longer feasible, due to the stage of construction, as it appears that said condition was not included in the original development order. 7. Uses within the existing residential structure on the southern parcel along Sipes Avenue shall be limited to a single-family dwelling or to those accessory uses permitted as part of a House of Worship within single-family residential zoning districts, as identified in Schedule B — Permitted Uses of the Sanford LDR. 8. A decorative and functional fountain shall be installed if the pond is a wet retention pond as part of development approval; which approval shall provide for ongoing maintenance requirements and responsibilities upon the appropriate party, but not the City. 9. Any dispute relative to the aforementioned matters shall be resolved by the Planning and Zoning Commission, after a public hearing, by means of a development order or denial development order relating thereto. (b) The City Manager, or designee, is hereby authorized to execute all documents necessary to formalize approval of the amendment taken herein and to revise and amend the Official Zoning Map or Maps of the City of Sanford as may be appropriate to accomplish the action taken in this Ordinance. Section 3. Incorporation of Maps. The maps attached to this Ordinance are hereby ratified and affirmed and incorporated into this Ordinance as a substantive part of this Ordinance. Section 4. Conflicts. All Ordinances or part of Ordinances in conflict with this Ordinance are hereby repealed. Section 5. Severability. If any section, sentence, phrase, word, or portion of this Ordinance is determined to be invalid, unlawful or unconstitutional, said determination shall not be held to invalidate or impair the validity, force or effect of any other section, 6� sentence, phrase, word, or portion of this Ordinance not otherwise determined to be invalid, unlawful, or unconstitutional. Section 6. Non -Codification. This Ordinance shall not be codified in the City Code of the City of Sanford or the Land Development Code of the City of Sanford and/or the Code of Ordinances of the City of Sanford, Florida; provided, however, that the actions taken herein shall be depicted on the zoning maps of the City of Sanford by the City Manager, or designee. The applicant is requesting that a Future Land Use (FLU) change of approximately 5.51 acres of the subject parcel from Suburban Estates (SE) to Low Density Residential (LDR). The City of Sanford Land Development Regulations allow a house of worship within an LDR future land use. The City's Comprehensive Plan Policy FLU 1.2.2 indicates that support community facilities and accessory land uses may be located in an LDR future land use. Policy 1.1.1 of the Comprehensive Plan states that the following numerical criteria for any land use amendment shall be met: 1. The amendment shall be consistent with the State Comprehensive Plan (Chapter 187 F. S.) and Growth Policy Act (Chapter 163 F. S.). The applicant shall make note that the Growth Policy Act relates to "urban infill and redevelopment areas", which are not applicable to this request per Sections 163.2511- .2520, F.S. Therefore, the following comments relate only to the State Comprehensive Plan: a. Being centrally located in the community allows this project to be served by "existing local transportation facilities" including the Orlando Sanford International Airport, SR 417, and 1-4 (see Section 187.201 (15) (b) 1.; and Section 187.201 (19) (b) 9., F.S.). It is also noted that the Sanford Airport Authority has requested that Sun Rail connect to the Orlando Sanford International Airport in the future. b. The project will be served by locally available utility services and other "existing public infrastructure", which will not require on -site potable wells or septic tanks or "the expenditure of public monies". In order to demonsrate consistency with the Comp Plan, the applicant will address the following Comp Plan Policy considerations: 1. Trip generation characteristics, impact on existing and planned transportation facilities and ability to achieve a functional internal circulation and off-street parking system, with landscaping amenities: The applicant shall demonstrate how internal circulation of the proposed improvements coincide with the existing PD owned by Jesus Image, Inc. A traffic impact statement is submitted with this application further demonstrating that the proposed improvements would have no impact to the flow of traffic on E. Lake Mary Boulevard. A proposed landscape plan meeting the City's land development code is provided with this application. 2. Relationship to surrounding land uses and natural systems: As previously stated, the property is surrounded by low density residential to the south and west, and to the east by a stormwater detention pond and 100-ft wide drainage canal maintained by Seminole County. Use of this land as an ancillary use to the existing Jesus Image church is the best use for this land. 3. Public facilities and services shall be available concurrent with development of the site. a. This project will utilize many public services, all of which are available at the site, including reclaimed water for irrigation. Utility services include reclaimed water, potable water and sanitary sewer provided by the City of Sanford. b. Police, fire and emergency services will be serviced by the local providers and will have adequate access to the property. 4. There have been changes in population, land use or economic development trends and/or projections that warrant a different land use designation. a. The area lying south of the Orlando Sanford International Airport between Sanford Ave. and Cameron Ave. has been a largely rural area for over 30 years. Tourism in Central Florida created SR 417 and SR 429, which connect Sanford with the tourist attractions and Disney. The interlocal agreement also indicates that "public" uses (such as houses of worship) are compatible with the Orlando Sanford International Airport. d. The applicant is proposing to preserve a 100-ft strip of land along the west side of the subject boundary as a natural vegetative buffer. e. Access to the property shall be made via E. Lake Mary Blvd which has been improved for public use. 5. There have been sufficient changes in the character of the area or adjacent lands to warrant a different land use designation. a. Attendees were invited to the front of the room to review three mounted exhibit boards detailing: 1) the original approved Jesus Image site plan; 2) proposed modified parking plan; and 3) the proposed additional 5.51-acres showing the relocated retention pond and prayer chapel. At 6:10 the presentation commenced with Mr. Moms conducting the first part of the meeting. The purpose of the CAPP meeting was explained and that under 200 of neighboring properties had been informed by mail of the meeting. Next, an explanation of the original City of Sanford approved site plan (now under construction) including the process of amending the Future Land Use and rezoning adding the church owned 5.51-acres to the existing PD. Questions were encouraged and asked throughout the presentation. The second part of the meeting was conducted by Ms. Silver who gave a detailed explanation of the proposed additions and changes to the site plan. The presentation covered: 1) the interior balcony buildout with additional seating in the Sanctuary; 2) additional parking required for the northern parcel; 3) relocation of the retention pond and its outfall with the addition of the southern parcel; 4) the new prayer chapel; 5) buffer and masonry wall details; 6) landscaping plan requirements; 7) abandonment and reassignment of a Seminole County pond access easement; and 8) a non -developed greenspace areas. Citizen Comments and Closing Discussion 1) There was a question raised about the proposed project drainage plan and its outfall to the Seminole County maintained drainage canal which was answered by the Ms. Silver the Civil Engineer. Several residents raised an area of concern in the adjacent Seminole County retention pond. As this is a County maintained pond not controlled by Jesus Image, information was given by Mr. Morris on how to best address those issues with Seminole County. Citizen's complained about the lack of maintenance of the canal, the smell, the presence of snakes and easterly bank erosion of the canal affecting their properties. 2) A question was asked about property access by owners to south. 3) Detail was sought on the proposed buffer and landscaping plan including existing Seminole County ROW which were explained by the Civil Engineer. Ms. Silver also addressed the environmental review process. 4) A concern was raised about current construction at times extending into the evening hours. These concerns were addressed by Ms. Mabe of Jesus Image with a commitment to monitor future activity. 5) Several residents made comments on truck and bus traffic on roads south of Lake Mary Boulevard. These comments did not relate to the Jesus Image project. 6) Several residents indicated the proposed additional property and new site plan were an improvement to the site plan that was submitted with the first CAPP meeting that was postponed. Residence to the south were very pleased that efforts were being made to save as many trees on the 5.51-ac site as possible and that the County maintained retention pond would remain. 7) Ms. Mabe, Ms. Silver and Mr. Morris urged the attendees to personally call, text or email them if questions, concerns or ideas arose during in coming months. The meeting closed with an explanation of the City's staff review, public hearing and approval process. When annexed, the proposed use will have an impact on public facilities and services and will generate no tax revenue for the City as a house of worship. BACKGROUND: The 28.24-acre site is located on the south side of Lake Mary Boulevard, just east of Wyndham Preserve and approximately 1,200 feet west of Brisson Avenue. The property consists of three parcels arranged in a north —south configuration. The northern 3.04-acre parcel and middle 5.43 acre parcel are separated by a 20-foot-wide, unnamed east —west right-of-way. The southern 19.76 acre parcel will have access to Lake Mary Boulevard through the northern parcels, which share common ownership and a portion for of the parcel will remain with access to Sipes Avenue. The southernmost parcel contains a 6.13 acre lake/drainage conservation easement in the middle of the property that is part of a Navy Canal Regional Stormwater Facility, a joint project between Seminole County and St. Johns River Water Management District that addresses water quality improvements to Lake Jesup (ORB 4785, Page 899) On November 8, 2021, the City Commission adopted Ordinance No. 2021-4639, rezoning approximately 8.47 acres at 2861 East Lake Mary Boulevard to establish the Jesus Image Planned Development (PD). The approved PD Master Plan identified a 40,430-square-foot main place of worship and a 1,600-square-foot prayer house on the 5.43 acre middle parcel. The northern parcel, fronting East Lake Mary Boulevard, was designated as a commercial outparcel and included a 1,920-square-foot commercial building. The staff report for the existing PD approval identified that the applicant's original design proposed only parking along East Lake Mary Boulevard. Following discussions with staff, the applicant agreed to revise the plan to include a building fronting East Lake Mary Boulevard, which could consist of office space, a small religious retail store, a daycare facility, or another general commercial use. Additionally, the parking layout was also modified by the applicant to ensure that north —south drive aisles do not exceed 300 linear feet without an east —west drive -aisle, improving internal circulation and promoting more efficient traffic flow within the parking areas. This requirement was a deviation from the Lake Mary Boulevard Overlay which limits parking bays to 40 spaces without a drive aisle break (LDR, Schedule U, Section 2.0, E). The minimum commercial square footage along the Lake Mary Drive frontage and for the 300-foot parking aisle length limitation was subsequently removed as part of staff s recommended conditions after the applicant incorporated the requirements within the PD Master Plan. As part of the current PD Amendment request the applicant proposes to construct a House of Worship with associated accessory uses, including office space and a future daycare facility. The existing single-family residence along Sipes Avenue is proposed to remain. The proposed church use is consistent with the previously approved Planned Development (PD) zoning on the parcels to the north. However, the southern parcel remains under Seminole County Agriculture zoning. To bring this parcel into the City and establish a consistent regulatory framework, the applicant has submitted a companion Annexation and Comprehensive Plan Amendment request to change the future land use designation from Suburban Estates (SE) to Low Density Residential Single -Family (LDR-SF). The applicant originally proposed annexing and rezoning only 5.51 acres of the 19.76-acre parcel for inclusion in the existing 8.47-acre PD. Staff advised that the City cannot annex and rezone only a portion of a parcel unless it is first legally split through Seminole County. Rather than dividing the property, which would have separated the existing single-family home, the applicant revised the request to include the entire 19.76-acre parcel in the PD amendment. This approach keeps the single-family residence and the proposed church on the same unified parcel. The amended PD Master Plan increases the overall land area by 19.76 acres but does not increase the approved development intensity. The Master Plan identifies a 35,163-square-foot main place of worship on the 5.43-acre middle parcel, along with a 3,000-square-foot prayer house on the western portion of the southern 19.76-acre parcel being added to the PD. A future building is also shown on the northern parcel fronting East Lake Mary Boulevard, although no specific use or minimum square footage has been designated at this time. The proposed retention ponds have been relocated to the southwestern portion of the site, and the existing single-family residence along Sipes Avenue is proposed to remain. The placement of the church and house of prayer is designed to minimize impacts on the larger residential lots to the east. Additional buffering and the proposed six-foot wall along the western boundary further enhance compatibility with the adjacent residential subdivisions. The proposed development is located within Planning Sub -Area 4 of the 2015 City of Sanford/Seminole County Joint Planning Agreement (JPA) and the rezone has been found to be consistent with the 2015 Joint Planning Agreement. Supportive community facilities and accessory land uses as defined in the LDRs may be located within areas designated LDR-SF. The Lake Mary Boulevard Corridor study supports land uses intended for mixed commercial and residential supportive uses along this segment of Lake Mary Boulevard. Development within the LDR-SF designation shall be required to meet the following general criteria together with the performance criteria established in Policy FLU 1.1.7 in this Element: • Compatible with the quality and character of existing low density single family neighborhoods; • Compatible with existing and anticipated future developments; • Compatible with natural features of the land and other policies within the Comprehensive Plan impacting natural resources. Any development standards within the PD that are not expressly addressed on the Master Plan shall default to the applicable requirements of the GC-2, General Commercial zoning district, including dimensional standards, buffering, landscaping, and any required commercial -to -residential transition measures. Development must also comply with the Lake Mary Boulevard Gateway Corridor requirements in Schedule U, along with all other relevant provisions of the City's Land Development Regulations. The commercial outparcel fronting Lake Mary Boulevard remains a required component of the PD and shall be developed consistent with the configuration and intent shown on the originally approved Master Plan. Staff -recommended Conditions 5 and 6, shown below, were not included in the prior PD approval because the original PD Master Plan addressed these elements. The amended PD Master Plan removes these previously agreed -upon components: 5. A commercial component, a minimum of 1,800 square feet, meeting the architectural requirements of Schedule G, Sanford LDR, shall be located within the first 100 feet of the Lake Mary Boulevard frontage; 6. North —south parking lot drive aisles shall not exceed 300 linear feet without an east -west drive aisle break, where double rows of parking is proposed. Given the removal of these elements from the amended PD Master Plan, staff recommends reaffirming the requirement for a commercial outparcel to maintain consistency with the original development intent and ensure compatibility with the Lake Mary Boulevard corridor. Apart from the two removed elements noted above, staff recommends approval of the PD amendment, subject to all staff -recommended conditions. Update Following Planning and Zoning Commission On February 5, 2026, the Planning and Zoning Commission heard the PD Amendment request. During the presentation, the Applicant stated their intent is to preserve existing trees along the southern portion of the 19.76-acre addition, as depicted in the colored renderings included with the CAPP summary. The Applicant also identified the possible need to install a stormwater discharge pipe from the retention pond to the canal, which may impact a portion of the designated tree preservation area. If required, the pipe would be routed along the north side of the preservation area, adjacent to the existing drainage easement/pond, to minimize impacts to trees closest to neighboring properties. Staff recommends this commitment be a condition of approval. Public comments included concerns regarding modified traffic patterns originating from the proposed house of worship accessing Sipes Avenue. Currently, only the existing single-family residence has direct access to Sipes Avenue. To address this concern, the Applicant has requested that Staff recommend a condition prohibiting direct vehicular access from Sipes Avenue to the primary house of worship, recognizing that an access easement to Seminole County exists for maintenance of the drainage easement/pond that runs east to west. During the hearing, it was determined that the staff -recommended condition limiting parking bays to no more than 300 feet before a driving aisle would be overly burdensome given that curbing has already been installed. As such, that condition was removed. Staff finds that the Applicant's additional tree -preservation commitment provides sufficient public benefit to support this deviation from the Lake Mary Overlay and the previously approved Master Plan. Planning and Zoning Commission Recommendation On February 5, 2026, in line with the recommendation of staff, the Planning and Zoning Commission unanimously recommended (6-0) that the City Commission adopt an ordinance to amend the Jesus Image PD by incorporating and rezoning a 19.76 acre parcel from A-1, Agriculture (Seminole County) to PD, Planned Development (City of Sanford) to allow to retain a single family home and allow a proposed House of Worship with ancillary and associated uses at project address 2861 E Lake Mary Boulevard and 3850 Sipes Avenue subject to a Development Order that incorporates the following staff -recommended conditions, with amendments noted below the original list: 1. Pursuant to Article 4 Section 4.0, B.6.c of the Land Development Regulations (LDR) of the City of Sanford, this rezoning shall expire 3 years from the effective date of this Ordinance if all improvements have not been completed or an extension granted. 2. All other Conditions in Development Order No. 21-44 shall remain in effect. 3. The property shall be developed generally in accordance with the land uses and development standards identified on the Jesus Image Church PD Master Plan dated as revised, November 7, 2025, unless otherwise specifically set forth in any associated development order; provided, however, that all subsequent development orders shall be consistent with the provisions of this Ordinance. 4. Any development standards within the PD that are not expressly addressed on the Master Plan shall default to the applicable requirements of the GC-2, General Commercial zoning district, including dimensional standards, buffering, landscaping, and any required commercial -to -residential transition measures. Development must also comply with the Lake Mary Boulevard Gateway Corridor requirements in Schedule U, relevant sections of Schedule J, Landscape, Buffer and Tree Requirements, along with all other relevant provisions of the City's Land Development Regulations. No Conditional Uses shall be permitted unless otherwise identified and approved as part of the rezone. 5. A commercial component, a minimum of 1,800 square feet, meeting the architectural requirements of Schedule G, Sanford LDR, shall be located within the first 100 feet of the Lake Mary Boulevard frontage. 6. North —south parking lot drive aisles shall not exceed 300 linear feet without an east -west drive aisle break, where double rows of parking is proposed. 7. Uses within the existing residential structure on the southern parcel along Sipes Avenue shall be limited to a single-family dwelling or to those accessory uses permitted as part of a House of Worship within single-family residential zoning districts, as identified in Schedule B — Permitted Uses of the Sanford LDR. 8. A decorative and functional fountain shall be installed if the pond is a wet retention pond as part of development approval; which approval shall provide for ongoing maintenance requirements and responsibilities upon the appropriate party, but not the City. 9. Any dispute relative to the matters shall be resolved by the Planning and Zoning Commission, after a public hearing, by means of a development order or denial development order relating thereto. Modifications were made to staff s original recommendation, as outlined below. The Planning and Zoning Commission voted to remove the condition requiring that north —south parking -lot drive aisles not exceed 300 linear feet without an east —west break, as the requirement is no longer feasible at this stage of construction and was not included in the original Development Order. In addition, following citizen input, staff recommends the following additional conditions: 1. It shall be prohibited for the main house of worship to have ingress or egress access from Sipes Avenue. Access along Sipes Avenue shall be limited to a. the existing single-family residence and b. maintenance for the Navy Canal Regional Stormwater Facility. 2. All existing non-invasive trees south of the drainage conservation -easement pond, as depicted within the Tree Preservation Area on the August 25, 2025 Citizen Awareness Participation Plan colored rendering, shall be preserved to the greatest extent possible. If installation of a stormwater discharge pipe from the retention pond to the canal is required, the pipe shall be routed along the north side of the Tree Preservation Area, adjacent to the existing drainage easement/pond, to minimize impacts to trees closest to neighboring properties, unless the Applicant demonstrates at the time of engineering plan review that such an alignment is infeasible. Any tree removal necessary for installation of the stormwater discharge pipe shall be limited to the minimum number required and mitigated in accordance with the City's Land Development Regulations. LEGAL REVIEW: The City Attorney has not reviewed the staff report and the specific analysis provided by City staff, but has noted the following: Section 166.033, Florida Statutes, as amended in the recent Legislative Session, in Chapter 2021-224, Laws of Florida (deriving from Committee Substitute for Committee Substitute for House Bill Number 1059) provides as follows (please note emphasized text): "(1) When reviewing an application for a development permit that is certified by a professional listed in s. 403.0877, a municipality may not request additional information from the applicant more than three times, unless the applicant waives the limitation in writing. Before a third request for additional information, the applicant must be offered a meeting to attempt to resolve outstanding issues. Except as provided in subsection (4), if the applicant believes the request for additional information is not authorized by ordinance, rule, statute, or other legal authority, the municipality, at the applicant's request, shall proceed to process the application for approval or denial. (2) (a) When a municipality denies an application for a development permit, the municipality shall jzive written notice to the applicant. The notice must include a citation to the applicable portions of an ordinance. rule, statute, or other legal authority for the denial of the permit. (b) If a municipality makes a request for additional information and the applicant submits the required additional information within 30 days after receiving the request, the municipality must review the application for completeness and issue a letter indicating that all required information has been submitted or specify with particularity any areas that are deficient within 30 days after receiving the additional information. (c) If a municipality makes a second request for additional information and the applicant submits the required additional information within 30 days after receiving the request, the municipality must review the application for completeness and issue a letter indicating that all required information has been submitted or specify with particularity any areas that are deficient within 10 days after receiving the additional information. (d) Before a third request for additional information, the applicant must be offered a meeting to attempt to resolve outstanding issues. If a municipality makes a third request for additional information and the applicant submits the required additional information within 30 days after receiving the request, the municipality must deem the application complete within 10 days after receiving the additional information or proceed to process the application for approval or denial unless the applicant waived the municipality's limitation in writing as described in paragraph (a). (e) Except as provided in subsection (5), if the applicant believes the request for additional information is not authorized by ordinance, rule, statute, or other legal authority, the municipality, at the applicant's request, shall proceed to process the application for approval or denial. (3) As used in this section, the term "development permit" has the same meaning as in s. 163.3164 but does not include building permits. (4) For any development permit application filed with the municipality after July 1, 2012, a municipality may not require as a condition of processing or issuing a development permit that an applicant obtain a permit or approval from any state or federal agency unless the agency has issued a final agency action that denies the federal or state permit before the municipal action on the local development permit. (5) Issuance of a development permit by a municipality does not in any way create any right on the part of an applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the municipality for issuance of the permit if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. A municipality shall attach such a disclaimer to the issuance of development permits and shall include a permit condition that all other applicable state or federal permits be obtained before commencement of the development. (6) This section does not prohibit a municipality from providing information to an applicant regarding what other state or federal permits may apply." The above -referenced definition of the term "development permit" is as follows: "(16) 'Development permit' includes any building permit, zoning permit, subdivision approval, rezoning, certification, special exception, variance, or any other official action of local government having the effect of permitting the development of land." (Section 163.3164(16), Florida Statutes). Thus, if this application is denied, a denial development order must be issued which must cite to the applicable portions of each ordinance, rule, statute, or other legal authority supporting the denial of the application. For example, if a goal, objective or policy of the Sanford Comprehensive Plan were to be the basis for a denial, then such goal, objective or policy must be part of the motion proposing the denial. A denial development order would be drafted to implement the actions of the City Commission in the event of such occurrence. Accordingly, any motion to deny must state, with particularity, the basis for the proposed denial. The term "development order" is defined as follows and, as can be seen, refers to the "granting, denying, or granting with conditions [of] an application": "(15) `Development order' means any order granting, denying, or granting with conditions an application for a development permit." (Section 163.3164(15), Florida Statutes). The City Commission approved Ordinance No. 2025-4847 on first reading, on March 9, 2026. The City Clerk published notice of the Public Hearing in the Sanford Herald, on March 13, 2026. RECOMMENDATION: On March 9, 2026, the City Commission unanimously approved Ordinance No. 2026 4847 on first reading to amend the Jesus Image PD by incorporating and rezoning a 19.76 acre parcel at 3850 Sipes Avenue from A-1, Agriculture (Seminole County) to PD, Planned Development (City of Sanford) allowing retention of an existing single family home and a proposed House of Worship with ancillary and associated uses at project address 2861 E Lake Mary Boulevard and subject to a Development Order that incorporates the following conditions: 1. Pursuant to Article 4 Section 4.0, B.6.c of the Land Development Regulations (LDR) of the City of Sanford, this rezoning shall expire 3 years from the effective date of this Ordinance if all improvements have not been completed or an extension granted. 2.
