Ordinance No. 2026-4851
An ordinance of the City of Sanford, Florida, further amending the
City of Sanford Comprehensive Plan for a total of 6.95 acres in size
within the City Limits consisting of eight (8) Future Land Use
Amendments to assign a City Future Land Use designation
equivalent to those in unincorporated Seminole County at the time
of annexation providing for the rezoning of real property located
within the City limits (table of the subject properties attached as
Exhibit "A"); amending Future Land Use Map; providing for
assignment of the land use designation for the properties;
providing for adoption of maps by reference; providing for the
taking of implementing administrative actions; providing for the
adoption of maps and exhibits by reference; providing for
ratification of prior actions; providing for severability; providing for
conflicts; providing for non -codification and providing for an
effective date.
Whereas, the City Commission of the City of Sanford enacted Ordinance Number
18-4461 adopting a Comprehensive Plan ("the Plan"), which Plan has been subsequently
amended from time -to -time and in accordance with State law; and
Whereas, the City Commission of the City of Sanofrd has followed the procedures
set forth in Section 163.3187, Florida Statutes, in order to further amend certain
provisions of the Plan as set forth in this Ordinance relating to a Future Land Use Map
Amendment; and
Whereas, the City of Sanford (the "City") has long been engaged in, and is also
committed to, a comprehensive annexation program which addresses the needs of the
citizens of the City and expands the tax base of the City and provides for an array of
other benefits; and
Whereas, the City is also committed to ensuring that the provisions of the City's
Comprehensive Plan are updated on an ongoing basis as properties are annexed into
the City Limits of the City to include, but not be limited to, the assignment of appropriate
land use designations to properties; and
Whereas, the City is also committed to ensuring that the provisions of the City's
Land Development Regulations are updated on an ongoing basis as properties are

annexed into the City Limits of the City to include, but not be limited to, the assignment
of appropriate zoning districts/classifications to properties; and
Whereas, the City is also committed to ensuring that the provisions of the Joint
Planning Agreement with Seminole County are correctly implemented and adhered to;
and
Whereas, the City's Planning and Zoning Commission recommended approval of
this Ordinance to amend the Future Land Use map of the Comprehensive Plan and
incorporate the properties referenced herein (attached hereto as Exhibit "A") at its
meeting on March 5, 2026; and
Whereas, the pertinent goals, objectives and policies of the Comprehensive Plan
support the approval of the amendments set forth in this Ordinance; and
Whereas, City staff reviewed and recommended approval of the of this Ordinance
to amend the Future Land Use map of the Comprehensive Plan and incorporate the
properties referenced herein and has accomplished all actions required under the Code
of Ordinances of the City of Sanford and State law; and
Whereas, the City Commission of the City of Sanford, Florida has taken all actions
in accordance with the requirements and procedures mandated by State law; and
Whereas, the City Commission of the City of Sanford, Florida hereby determines
that it is to the advantage of the City of Sanford and in the best interests of the citizens of
the City of Sanford to amend the Future Land Use Map for the aforedescribed property;
and
Whereas, the Plan, as amended by this Ordinance, is consistent and in
compliance with the provisions of State law, including, but not limited to, home rule powers
of the Constitution of the State of Florida, Sections 163.3177 and 163.3187, Florida
Statutes.
Now, Therefore, be it Enacted By the People of the City Of Sanford, Florida, as
follows:
Section 1. Legislative and Administrative Findings/Amendment to the Future
Land Use of Comprehensive Plan.
(a). The recitals set forth above in the "whereas clauses" are hereby adopted as
legislative findings of the City Commission of the City of Sanford.
(b). The Future Land Map as set forth in Ordinance 18-4461, as previously
amended, is hereby further amended by amending the Future Land Use Map designation
assigned to the following property and which is depicted on the Future Land Use Map
and further described in the attached Exhibit "A" to this Ordinance.
(c). The associated rezoning request was completed by means of Ordinance
Number 26-4852.
Section 2. Conflicts.
All ordinances or part of ordinances in conflict with this Ordinance are hereby
repealed.
Section 3. Severability.
If any section, sentence, phrase, word, or portion of this Ordinance is determined
to be invalid, unlawful or unconstitutional, said determination shall not be held to invalidate
or impair the validity, force or effect of any other section, sentence, phrase, word, or
portion of this Ordinance not otherwise invalid, unlawful, or unconstitutional.
Section 4. Codification.
The provisions of this Ordinance shall not be codified, but the annexed property
shall be incorporated and included in all appropriate maps of the City Limits of the City of
Sanford by the City Manager, or designee(s), and the City Manager, or designee(s), is/are
hereby directed to take any and all appropriate actions relative to the land use planning
documents of the City pertaining to the property annexed pursuant to this Ordinance.
Also, all maps of the City shall be modified to address this annexation and all previous
annexations.
Section 5. Effective Date.
(a). The City will provide a certified copy of this Ordinance to the Florida
Department of State by the Clerk of the City of Sanford in accordance with Section 125.66,
Florida Statutes.
(b). This Ordinance will take effect upon filing a copy of this Ordinance with the
Department of State by the Clerk of the City of Sanford; provided, however, that the
effective date of the plan amendment set forth in this Ordinance, if the amendment is not
challenged in a timely manner, will be no earlier than thirty-one (31) days after the
adoption date of the amendment. If challenged within the appropriate time period, this
amendment will become effective on the date the State Land Planning Agency or the
State Administration Commission enters a final order determining the adopted
amendment to be in compliance. No development orders, development permits or land
uses dependent upon this amendment may be issued or commence before it has become
effective.

Business Impact Estimate
This form should be included in agenda packet for the item under which the proposed ordinance
is to be considered, and must be posted on the City's website by the time notice of the proposed
ordinance is
Rezone of eight properties totaling 6.95 acres in order to assign a City zoning
classification equivalent to those in unincorporated Seminole County at time of
annexation for Annexation Statutory Compliance.
The City is of the view that the following exception(s) to the Business Impact Estimate
requirement, that are checked off in a box below, apply to the above -referenced proposed
ordinance. Although, the City is implementing the procedure required by statutory law to
ensure that no inadvertent procedural issue could impact the enactment of the proposed
ordinance.
® The proposed ordinance is required for compliance with Federal or State law or
regulation;

an exemption noted above may apply, the City hereby publishes the following information:
1. Summary of the proposed ordinance (must include statement of the public purpose,
such as serving the public health, safety, morals, and welfare):
The proposed ordinance is intended to assign a City zoning classification equivalent to
those in unincorporated Seminole County at time of annexation for Annexation Statutory
Compliance.
2. Estimate of direct economic impact of the proposed ordinance on private, for -profit
businesses in the City:
Properties have already been annexed into the City and will be assigned City Zoning
classification no direct economic impact is estimated.
3. Estimate of direct compliance costs that businesses may reasonably incur:
Not estimated to add any direct cost as properties are already annexed into the City.
4. Any new charge or fee imposed by the proposed ordinance:
No new charge as properties are already annexed into the City.
5. Estimate of the City's regulatory costs, including estimated revenues from any new
charges or fees to cover such costs:
It is impossible to quantify any potential regulatory costs of the proposed development.
6. Good faith estimate of the number of businesses likely to be impacted by the proposed
ordinance:
It is unknown if any businesses will be impacted by the development of the site.

SUBJECT: Request to consider an amendment to the City of Sanford Comprehensive
Plan for a total of 6.95 acres consisting of eight Future Land Use map
amendments to assign a City future land use designation equivalent to those
in unincorporated Seminole County at time of annexation; After
Annexation Statutory Compliance; Ordinance No. 2026-4851
SYNOPSIS:
This is the annual Citywide Comprehensive Plan Map Amendment of 2026.
FISCAL/STAFFING STATEMENT:
None.
BACKGROUND:
In 2015, the City of Sanford updated the Sanford/Seminole County Joint Planning Agreement
(JPA), which included Exhibit B, describing equivalent Future Land Uses between the City and
Seminole County in their respective Comprehensive Plans. The designations have been deemed
equivalent due to their similar intensities and densities of allowable development.
This Comprehensive Plan Amendment consists of eight individual and distinct Future Land Use
map amendments with a total of 6.95 acres. No text amendments are included. All the amendments
are due to annexations from October of 2023 to April of 2025 and will have the equivalent future
land use designations in the City as in the County. The impacts of development on public facilities
and service have already been accounted for in the County for all amendments due to annexations.
LEGAL REv1EW:
The City Attorney may or may not have reviewed the staff report and the specific analysis provided
by City staff but has noted the following that should be adhered to.
This matter is not a quasi-judicial matter as amendments to local government comprehensive plans
are legislative in nature. That being said, if a proposal to amend the City Comprehensive Plan is
to be recommended for denial, it would be appropriate to state the reason for such a
recommendation to be considered by the City Commission - such as the proposal is internally
inconsistent with a goal, objective or policy of the Comprehensive Plan or inconsistent with
controlling State law or the like.
RECOMMENDATION:
On March 5, 2026, in line with the recommendation of staff, the Planning and Zoning Commission
unanimously recommended that the City Commission adopt an ordinance to amend the
Comprehensive Plan to modify the future land use map for eight properties totaling 6.95 acres to
assign a City future land use designation equivalent to those in unincorporated Seminole County
at time of annexation.
The City Commission approved Ordinance No. 2026-4851 on first reading, on March 23, 2026.
Additional comments or recommendations may be presented by staff at the meeting.
