JOINT PLANNING AGREEMENT
THIS SECOND AMENDMENT TO THE 2015 SEMINOLE COUNTY/CITY OF
SANFORD JOINT PLANNING AGREEMENT is made and entered into this CO day of
V +_- .2026 between SEMINOLE COUNTY, a political subdivision of the State of
Florida, whose address is 1101 East First Street, Sanford, Florida 32771 ("COUNTY") and the
CITY OF SANFORD, a Florida municipal corporation whose address is Post Office Box 1788,
Sanford, Florida 32772-1788 ("CITY''), collectively referred to as the "Parties".
WITNESSETH:
WHEREAS, the Parties entered into the 2015 Seminole County/City of Sanford Joint
Planning Agreement ("JPA"), as authorized by Chapter 163, Florida Statutes, on October 15, 2015
to coordinate comprehensive planning, land use, annexation, and infrastructure service delivery
within the Sanford/Seminole County Joint Planning Area ("Joint Planning Area"). and
WHEREAS, the Parties adopted the First Amendment to the JPA on August 28`h, 2018
amending density limitations a specific property within the Joint Planning Area, and
WHEREAS, Section 10 of the J PA sets forth the term of the JPA, which expired on October
15, 2025: and
WHEREAS, the Parties would like to extend the term and amend the JPA to allow time
for the Parties to review, negotiate and potentially adopt a new agreement addressing multiple
areas of coordination between the Parties; and
WHEREAS, extending the term of the JPA will facilitate continued intergovernmental
cooperation and avoid uncertainty in land use matters during the extended period.
NOW, THEREFORE, in consideration of the premises, mutual covenants, agreements,
and promises contained herein and other good and valuable consideration, the receipt and

sufficiency of which is hereby acknowledged by the Parties, the Parties hereby covenant and agree
as follows:
Section 1. Recitals. The foregoing recitals are true and correct and form a material part of
this Second Amendment to the 2015 Seminole County/City of Sanford Joint Planning Agreement
("Second Amendment") upon which the Parties have relied.
Section 2. Amendment. Section 10 of the JPA is amended to read as follows, deletions
shown in strikethrough and additions shown in underline:
This Agreement supersedes and supplants any prior existing Agreements between
CITY and COUNTY regarding land development practices. This Agreement shall
be in effect for a five (5) year period beginning the date on which it is fully executed
by both parties. This Agreement shall automatically be renewed for a subsequent
five (5) year period unless one (1) of the parties thereto gives the other ninety (90)
days in advance notice, in writing, of its intention not to renew the Agreement. After
the automatic five (5) vear renewal neriod expires on October 15. 2025. the
Agreement automatically extends to October 15.2026. Thereafter. the Parties can
agree to extend the Agreement for additional six (6) month time periods if the
Parties are activelv working on and makine substantial nroeress with negotiating
and finalizing a new or amended agreement. The six (6) month extensions must be
in writine and agreed to by both the Countv Manager and the Citv Manager. Board
of Countv Commissioner and Citv Commission annroval is not reouired.
Section 3. Except as specifically amended by the Second Amendment, the remainder of
the JPA shall remain in full force and effect.

RESOLUTION NO. 2026 -3482
A RESOLUTION OF THE CITY OF SANFORD, FLORIDA, APPROVING
AND AUTHORIZING EXECUTION OF AN EXTENSION TO THE 2015
SEMINOLE—SANFORD JOINT PLANNING AGREEMENT BETWEEN
THE CITY OF SANFORD AND SEMINOLE COUNTY; PROVIDING FOR
FINDINGS, AUTHORIZATION, AND AN EFFECTIVE DATE.
WHEREAS, the City of Sanford and Seminole County entered into a Joint Planning
Agreement (JPA) on October 15, 2015, as authorized by Chapter 163, Florida Statutes,
to coordinate comprehensive planning, land use, annexation, and infrastructure service
delivery within the agreed -upon Joint Planning Area; and
WHEREAS, the JPA established policies and procedures for managing growth,
resolving boundary disputes, and promoting orderly annexation consistent with each
party's Comprehensive Plan; and
WHEREAS, the City and County have subsequently adopted amendments and
interlocal addenda, including the First Amendment to the 2015 JPA and the 2024
Interlocal Agreement for De Minimis Utility Service Boundary Adjustments, reaffirming
their mutual intent to coordinate planning and service delivery; and
WHEREAS, the current JPA is scheduled expired on October 15, 2025; and
WHEREAS, both parties desire to extend the effectiveness of the 2015 JPA to
allow additional time for review, renegotiation, and possible adoption of an updated
agreement addressing future land use, annexation procedures, and service coordination;
and
WHEREAS, extending the JPA will promote continued intergovernmental
cooperation and avoid uncertainty in growth management during the review period.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SANFORD, FLORIDA, AS FOLLOWS:
Section 1. Findings.
The foregoing recitals are true and correct and are hereby adopted as legislative
findings and made part of this Resolution.
Section 2. Approval of Extension.
The City Commission hereby approves the Extension of the 2015 Seminole —
Sanford Joint Planning Agreement, nunc pro tunc to October 15, 2025, substantially in
the form attached hereto as Exhibit "A", extending the term of the Agreement for an
additional six (6) months, through October 15, 2026, with the option for the City and
County Managers to approve additional six month extensions, or until superseded by a
successor agreement executed by both parties.
Section 3. Authorization.
The City Manager is hereby authorized to take any and all actions as may be
necessary to further implement the provisions of this Resolution by means of such
additional administrative actions as may be deemed appropriate.
Section 4. Transmittal.
A certified copy of this Resolution and executed Extension Agreement shall be
transmitted to the Seminole County Board of County Commissioners for corresponding
approval and execution.
Section 5. Savings.
The prior actions of the City relating to the JPA are hereby ratified and affirmed.
Section 6. Conflicts.
All resolutions or parts in conflict with this Resolution re hereby repealed.
Section 7. Severability.
If any section, sentence, phrase, word or portion of this Resolution is determined
to be invalid, unlawful, or unconstitutional, said determination shall not be held to
invalidate or impair the validity, force or effect of any other section, sentence, phrase,
word or portion of this Resolution not otherwise determined to be invalid, unlawful or
unconstitutional.
Section 8. Effective Date.
This Resolution shall become effective immediately upon enactment

SUBJECT: Resolution No. 2026-3482; Seminole County/City of Sanford Joint
Planning Agreement - Extension
SYNOPSIS:
The Joint Planning Agreement (JPA) between Seminole County and the City of Sanford has
reached its expiration date and City Staff propose to extend the existing JPA for an additional six
months, with the option for the City Manager and County Manager together to administratively
approve additional six month extensions, to allow staff time to modify the regulatory framework
while continuing to benefit from its guiding policies.
FISCAL/STAFFING STATEMENT:
There are no anticipated costs to the City to implement the proposed extension. However,
additional planning staff may be needed to updated the JPA in a manner that would be both
expeditious and be more effective for city processes.
BACKGROUND:
Seminole County and the City of Sanford entered into the existing Joint Planning Agreement (JPA)
on October 15, 2015. This agreement expired on October 12, 2025. Over the past decade, the JPA
has effectively supported both jurisdictions by establishing shared goals and coordinated policies
for transitional areas between the County and the City. It has also fostered improved collaboration
between our two governmental entities in guiding development that strengthens our physical,
environmental, economic, and social communities.
The JPA was intentionally structured with an expiration date to acknowledge the potential for
evolving development conditions and shifts in community vision. This built-in sunset provision
encourages County and City staff to periodically reassess the agreement to ensure it continues to
meet its intended objectives. In alignment with this purpose, staff are currently working in
partnership with Seminole County planning staff to revise the existing regulations and develop a
new agreement that better reflects our shared vision and future development priorities.
Staff are concerned that allowing a lapse in the effectiveness of the JPA, between the expiration
of the current agreement and the adoption of a new one, could result in development that does not
align with the goals of either jurisdiction. Therefore, staff recommend extending the existing JPA
to maintain continuity and safeguard coordinated planning efforts while the new agreement is
finalized.
LEGAL REVIEW:
The Joint Planning Agreement extension resolution has been reviewed by the City Attorney.
RECOMMENDATION:
Staff recommends that the City Commission approve Resolution No. 2026-3482.
SUGGESTED MOTION:
" I move approve Resolution No. 2026-3482 to extend the Joint Planning Agreement for an
additional six months, with the option for the City and County Managers together to approve
additional six month extensions, or until superseded by a new agreement."
