AN ORDINANCE OF THE CITY OF SAN FORD, FLORIDA,
AMENDING ORDINANCE NO. 3573 SAID ORDINANCE
BEING A ZONING PLAN FOR A PLANNED DEVELOPMENT
AND AMENDING THE PLANNED DEVELOPMENT MASTER
PLAN PERTAINING TO THE VENETIAN BAY PLANNED
DEVELOPMENT; RELATING TO CERTAIN PROPERTY
APPROXIMATELY LYING BETWEEN SEMINOLE
BOULEVARD AND NARCISSUS AVENUE AND BETWEEN
RIVERVIEW AVENUE AND RACHELLE AVENUE
(SPECIFICALLY DESCRIBED IN TEXT); PROVIDING FOR
SEVERABILITY, CONFLICTS AND EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Sanford pursuant to Ordinance No.
3573 and Development Order Number 00-0022 (as recorded at Official Records Book
3991, Page 612, Public Records of Seminole County, Florida) approved the Venetian Bay
Master Plan for a Planned Development consisting of ninety-two (92) single family
residential lots; and
WHEREAS, the owners of subject property desire to amend the plan previously
approved by the City Commission.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1:
a. Ordinance No. 3573 of the City of Sanford, Florida, passed and adopted on
December 18, 2000, said Ordinance being the Planned Development Ordinance of the City
of Sanford, Florida, approving the Planned Development Zoning Classification being
assigned to the below described property is hereby amended:

SECTION 2: The rezoning action herein is subject to the conditions provided for
and agreed to in the Development Order #02-001~].
SECTION 3: Severability. If any section or portion of a section of this Ordinance
proves to be invalid, unlawful or unconstitutional it shall not be held to impair the validity,
force or effect of any other section or part of a section of this Ordinance.
SECTION 4: Conflicts. All ordinances or parts of ordinances in conflict herewith
be and the same are hereby revoked.
SECTION 5: Effective Date. This Ordinance shall become effective immediately
upon the execution and recording of the Development Order referenced above, provided
that said Development Order is fully executed and delivered to the City Clerk for recording
within ninety (90) days of the date of adoption of this Ordinance, otherwise this Ordinance
shall be null and void and of no force and effect.

On May 13, 2002 City of Sanford issued this Development Order relating to and
touching and concerning the following described property:

Requested Development Approval: Amend the approved Venetian Bay Planned Development Master
Plan and Development Order 00-0022
The development approval sought is consistent with the City of Sanford Comprehensive
Plan and will be developed consistent with and in compliance to applicable land development
regulations and all other applicable regulations and ordinances.
The owner of the property has expressly agreed to be bound by and subject to the
development conditions and commitments stated below and has covenanted and agreed to have
such conditions and commitments run with, follow and perpetually burden the afore described
property.
ORDER
NOW, THEREFORE, it is ORDERED AND AGREED THAT:
(1) The aforementioned application for development approval is GRANTED.
(2) All development shall fully comply with all of the codes and ordinances in effect in
the City of Sanford, Florida at the time of issuance of pennits including all impact
fee ordinances.

(3) The conditions upon this development approval and the commitment made as to
this development approval, all of which have been accepted by and agreed to by
the owner of the property are as follows:
(a) This Development Order will supercede all requirements as previously
required for Venetian Bay Subdivision in Development Order 00-0022
recorded on Official Records Book 3991 Page 0612 on January 17, 2001.
(b) All development shall be in compliance with the Revised PD Master Plan for
Venetian Bay signed and sealed by the project engineer on February 15,
2002;
(c) All development shall be in accordance to Sanford's Land Development
Regulations
(d) All development shall be in accordance with the Mutual Release and
Settlement Agreement for the Richard De Fordham, et al. vs. St. John's River
Water Management District, et al.
(e) A fifteen foot (15') City of Sanford City Services Easement is to be dedicated
on the south side of US 17-92 (Seminole Boulevard) Right of Way.
(f) The Development shall require the construction of a six foot (6') solid
masonry wall along Narcissus Avenue (Lots 18 through 35), Riverview
Avenue (LoB 35 through 42), and an unnamed right-of-way (Lots 42 through
47).
(g), The property owner (developer) will dedicate a 34.6 foot Natural Landscape
Buffer Tract along the west side of the northern portion of the subdivision
(Tract "G) and also a 10 foot natural vegetative buffer along the west 10 feet
of lots 56 through 66.
(h) No six foot (6') solid masonry wall is to be constructed along Tract "G" (Lots
55 through 66) (the "Natural Vegetative Buffer Tract").
(i) No two-story buildings shall be constructed on Lots 42 through 47 and Lots
55 through 66.
(j) The Developer shall record on both the Plat and within the Declaration of
Covenants, Conditions and Restrictions for Venetian Bay Subdi~ision the
following: There shall be no curing of trees and other natural vegetation in
the ten-foot (10') "Natural Landscape Buffer Easement" on the west side of
Lots 55 through 66."
(k) The Developer shall record on both the Plat ~.nd within the Dec!ar;:~on of
Covenants, Conditions and Restriction for Venetian Bay Subdivision the
following: "There shall be no two story residences constructed on Lots 42
through 47 and Lots 55 through 66."
(l) The Developer agrees to record in the public records of Seminole County,
Florida a "Conservation Easement" for Tract "G" in the form attached
hereto as Exhibit B.
(m) An appropriate entrance feature shall be required to be submitted and
reviewed by staff prior to subdivision improvement plan approval.
(n) At least 30% of the total area shah be maintained as open space.
(o) Submittal of the Preliminary Subdivision Plan shall indicate footprint of
maximum building area for each lot.
(p) All lots adjacent to existing single family lots on the west side of the project
shall have a minimum depth of one hundred and fifteen feet (115').

(q) Drainage easements will be determined at the time of subdivision
improvement plans.
(r) Dedicate right of way on Narcissus Road, Riverview Avenue, and unnamed
road between Palm Drive and Riverview Avenue to meet minimum of City of
Sanford and or Seminole County Requirements.
(s) The Developer shall grant and otherwise convey to the City of Sanford aH
rights, ownership and interest to land, both dry and/or submerged, that is
lecated on the north side of the right-of-way of U.S. Highway 17 & 92.
(t) No stormwater from the project that is collected and piped to the project's
two detention ponds will be discharged to the wetland located at the
northwest portion of Venetian Bay. The discharge from both detention ponds
shall be piped to the intersection of Seminole Boulevard and the subdivision's
Entrance Road. The runoff will then be piped via a bore and jack under
Seminole Boulevard directly to the St. John's River (Lake Monroe).
(u) An inlet would be constructed at the southeast corner of Riverview Avenue
and the unnamed right-of-way with the stormwater from the east half of the
Riverview Avenue right-of-way piped to the entrance road to connect with the
outfall from the southern detention pond.
(v) Mitigation of wetlands will be per SJRWMD requirements. Please provide
copies of their site evaluation, and mitigation determinations and evidence of
compliance.
(w) The development density shall be limited to a maximum of four (4) dwelling
units per acre.
(x) Construction and related equipment shall access the site from US Highway
17/92.
(y) A single continuous wood fence shall be constructed 10 feet to the east of
the westerly property lines along Lots 56 thru 66 during the
construction of the subdivision and said fence shall be permanently
maintained by the property owners.
(4) This Development Order touches and concerns the afore described property and
the conditions, commitments and provisions of this Development Order shall perpetually burden,
run with and follow the said property and be a servitude upon and binding upon said property
unless released in whole or part by action of the City of Sanford by virtue of a document of equal
dignity herewith. The owner of the said property has expressly covenanted and agreed to this
provision and all other terms and provisions of this Development Order.
(5) The terms and provisions of this Order are not severable and in the event any
portion of this Order shall be found to be invalid or illegal then the entire order shall be null and
void.
