AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING,
VACATING, AND ABANDONING THAT CERTAIN 14' WIDE EAST-WEST
ALLEY LYING BETWEEN W. 8TH STREET AND WILLIAM CLARK
COURT AND BETWEEN MULBERRY AVENUE AND POMEGRANITE
AVENUE AND RETAINING A UTILITY EASEMENT OVER THE EASTERLY
148.86 FEET; PROVIDING FOR SEVERABILITY, CONFLICTS AND
EFFECTIVE DATE.
WHEREAS, an application has been filed with the City of Sanford to close, vacate
and abandon that certain 14' wide east-west alley lying between W. 8th Street and William
Clark Court and between Mulberry Avenue and Pomegranite Avenue; and
WHEREAS, a public hearing was held on September 13, 2004, for consideration
and determination as to whether or not the closing, vacating and abandoning of that
certain 14' wide east-west alley lying between W. 8th Street and William Clark Court and
between Mulberry Avenue and Pomegranite Avenue should be allowed; and
WHEREAS, the City Commission has determined that the closing, vacating and
abandoning of that certain property does not conflict with the Comprehensive Plan of the
City of Sanford, Florida, and that the public health, economy, comfort, order, convenience,
and welfare will be promoted by such closing, vacating and abandoning.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
CT_~=.~T. LO_N__~ That certain 14' wide east-west alley lying between W. 8th Street and
William Clark Court and between Mulberry Avenue and Pomegranite Avenue, more
particularly described as follows:
That certain 14' wide east-west alley lying between lots 1 - 5 and lots
6 and 9, Block 10, Tier 20, Seminole Park, as recorded in Plat Book 2,
Page 75, Public Records of Seminole County, Florida
be and the same is hereby closed, vacated, and abandoned; however, retaining a utility
easement over the easterly 148.86 feet thereof.
_S_E_C_T_L~I~: If any section or portion of a section of this Ordinance proves to be
invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect
of any other section or part of this Ordinance.
~ That all Ordinances or parts of Ordinances in conflict herewith be and
the same are hereby revoked.
SECTION 4: That this Ordinance shall become effective immediately upon its
passage and adoption.
