WHEREAS, an application has been filed with the City of Sanford to close, vacate
and abandon that certain unnamed thirty (30) foot right of way lying between St. Johns
Parkway and the Central Florida Greeneway and between Bevier Road and Maritime
Drive; and
WHEREAS, a public hearing was held on May 10, 2004, for consideration and
determination as to whether or not the closing, vacating and abandoning of that certain
unnamed thirty (30) foot right of way lying between St. Johns Parkway and the Central
Florida Greeneway and between Bevier Road and Maritime Drive should be allowed; and
WHEREAS, the City Commission has determined that the closing, vacating and
abandoning of that certain property does not conflict with the Comprehensive Plan of the
City of Sanford, Florida, and that the public health, economy, comfort, order, convenience,
and welfare will be promoted by such closing, vacating and abandoning.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
~ That certain unnamed thirty (30) foot right of way lying between St.
Johns Parkway and the Central Florida Greeneway and between Bevier Road and
Maritime Drive, more Particularly described as follows:
THAT CERTAIN UNNAMED 30 FOOT RIGHT OF WAY LYING
SOUTH OF LOT 11 AND NORTH OF LOT 10 OF M.M. SMITHS
SUBDIVISION, AS RECORDED IN THE PUBLIC RECORDS OF
SEMINOLE COUNTY PLAT BOOK 1, PAGE 55. TOGETHER WITH
THAT 30 FOOT RIGHT OF WAY LYING EAST OF LOT 10 AND
WEST OF LOT 23 LYING NORTH OF THE FORMER SEA
COASTLINE RAILROAD 100 FOOT RIGHT OF WAY. BOARD
be and the same is hereby closed, vacated, and abandoned.
~ If any section or portion of a section of this Ordinance proves to be
invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect
of any other section or part of this Ordinance.
~ That all Ordinances or parts of Ordinances in conflict herewith be and
the same are hereby revoked.
~ That this Ordinance shall become effective immediately upon its
passage and adoption.
