AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
CLOSING, VACATING, AND ABANDONING THAT CERTAIN
TEN FOOT (10') DRAINAGE AND UTILITY EASEMENT
LYING AT THE REAR PROPERTY BOUNDARY OF
PROPERTY LYING BETWEEN ROCKHILL DRIVE AND
MONTEREY OAKS DRIVE AND BETWEEN UPSALA ROAD
AND BRUSHCREEK DRIVE; PROVIDING FOR
SEVERABILITY, CONFLICTS AND EFFECTIVE DATE.
WHEREAS, an application has been filed with the City of Sanford to close, vacate and ~
abandon that 10 foot drainage and utility easement lying at the rear property boundary of property m
lying between Rockhill Drive and Monterey Oaks Drive and between Upsala Road and Brushcreek
Drive; and
WHEREAS, a public hearing was held on August 9, 2004, for consideration and
determination as to whether or not the closing, vacating and abandoning of that 10 foot drainage and
utility easement lying at the rear property boundary of property lying between Rockhill Drive and
Monterey Oaks Drive and between Upsala Road and Brushcreek Drive, should be allowed; and
WHEREAS, the City Commission has determined that the closing, vacating and abandoning
of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida,
and that the public health, economy, comfort, order, convenience, and welfare will be promoted by
such closing, vacating and abandoning.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: That 10 foot drainage and utility easement lying at the rear property boundary
of property lying between Rockhill Drive and Monterey Oaks Drive and between Upsala Road and
Brushcreek Drive, more particularly described as follows:
That certain 10 foot drainage and utility easement lying at the rear property
boundary of lot 9, Monterey Oaks Phase l, PB 56, Pages 33 & 34.
be and the same is hereby closed, vacated, and abandoned.
~ If any section or portion of a section of this Ordinance proves to be invalid,
unlawful or unconstitutional, it shall not be held to impair the validity, rome or effect of any other
section or part of this Ordinance.
~ That all Ordinances or parts of Ordinances in conflict herewith be and the same
are hereby revoked.
That this Ordinance shall become effective immediately upon its passage and
adoption.
