HomeMy WebLinkAbout895ORDINANCE NO. 895 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING CHAPTER 11, THE CODE OF THE CITY OF SANFORD, FLORIDA, 1954, SECTION 11-12.1 THEREOF, SUCH SECTION IMPOSING A FEE FOR THE COLLECTION OF REFUSE, AS DEFINED THEREIN, PRESCRIBING THE AMOUNT OF SUCH FEE AND DEFINING USAGES UPON WHICH SAID FEE IS BASED, AND PROVIDING FOR THE METHODS OF BILLING FOR THE SAME, AND THE PENALTY FOR FAILURE TO PAY SUCH FEE, SAID AMENDMENT CHANGING THE FEE FOR RESIDENTIAL OCCUPANCY AS PROVIDED IN SUBSECTIONS (a), (b)3., AND (d), AND CHANGING THE FEE FOR BUSINESS OCCUPANCY AS PROVIDED IN SUBSECTIONS (e), (f) AND (g), AND PRESCRIBING COLLECTION FEES FOR SUCH OCCUPANCY; REPEALING ORDINANCE NO. 710. BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1. That Chapter 11 of The Code of the City of Sanford, Florida, 1954, Section 11-12.1, Subsections (a), (b)3., (d), (e), (0 and (g) thereof, be and the same are hereby amended in words and figures as follows: "(a) For each single-family residence, which term shall embrace only a single building and its premises for single-family occupancy, and exclude any rental occupancy other than single-family, each church, each lodge, which term shall embrace only nonprofit, fraternal organizations maintaining buildings for their lodge purposes, and each nursery, such term embracing only educational huildings used for instruction of children of pre-public school age, the fee to be paid to the city shall be one dollar and fifty cents per month with an allowance of not more than two receptacles, as required by section 11-2 of The Code of The City of Sanford, Florida, 1954, per usage." "(b) 3. A single duplex residential building with its premises, the fee to be paid to the city shall be two dollars per month with an allowance of not more than four receptacles , as required by section 11-2 of The Code of the City of Sanford, Florida, 1954, per entire usage. ' '(d) For each quarters occupancy, which term shall embrace only several single-family rental buildings of one ownership on the same premises and serviced as to other utilities through a single utility meter or bill, the fee to be paid to the city shall be four dollars per month for the entire occupancy with an allowance of not more than two receptacles per building, as required by section 11-2 of the Code of the City of Sanford, Florida, 1954, per usage." School, tourist court, trailer park, motel, hospital; or 2. Combination of business occupancy on the same premises with residence, quarters, apartments or lodge as above defined; or 3. Combination of quarters on the same premises with residence as above defined, the fee to be paid to the city shall be four dollars per month." "(g) The monthly fee provided in subsections (a) through (f) shall cover the uniform refuse collection service provided for all usages similarly situated throughout the City of Sanford. Upon application of an owner to theCity Manager, or upon his own investigation, the City Manager is hereby vested with authority when the daily average collection of refuse exceeds 16.000 cubic yards, to establish the monthly refuse collection fee therefor and so notify the user that such fee has been established and that the final establishment of such fee will be presented to the City Commission for final approval at a regular meeting, which meeting shall not be less than ten (10) days after such notification, and that such user can appear and be heard at such meeting. The said fee established by the City Manager shall become the fee when approved by the City Commission." -3- SECTION 2. All ordinances or parts of ordinances in conflict herewith specifically including Ordinance No. 710, be and the same are hereby repealed. SECTION 3.
