AN ORDINANCE OF THE CITY OF SANFORD,
FLORIDA, REGULATING PRODUCE PEDDLERS;
DEFINING THE SAME; PROVIDING EXCEPTIONS;
PROVIDING PENALTIES FOR VIOLATION.
BE IT ENACTED BY THE PEOPLE OF THE (ITY OF SANFORD, FLORIDA:
SECTION 1. That a produce peddler within the meaning hereof
is defined as any person, firm or corporation selling or offering for sale
perishable agricultural commodities from any wagon, truck, push-cart,
motor vehicle or portable conveyance or structure or by means other than
from an established building structure containing sanitary facilities as
required in Chapter 19, The Code of the City of Sanford, Florida, 1954,
as amended, and meeting the requirements of Chapter 12, The Code of
the City of Sanford, Florida, 1954, as amended.
SECTION 2. It shall be unlawful within the corporate limits
of the City of Sanford to sell or offer for sale any perishable agricultural
commodities by any person, firm or corporation defined as a produce
peddler within the definition stated in Section 1 hereof; provided, how-
ever, that this ordinance shall not apply to bona fide farmers marketing
perishable agricultural commodities grown upon a farm owned or con-
trolled by said farmers so long as the said sales are conducted from a
vehicle which remains stationary for periods of not more than two (2)
hours at any given location.
SECTION 3. Violation of this ordinance shall be punishable
by fine and/or imprisonment as provided in Chapter 1, The Code of the
City of Sanford, Florida, 1954, as amended.
SECTION 4. That all ordinances or parts of ordinances in
conflict herewith be and the same are hereby repealed.
SECTION 5. That this ordinance shall become effective
immediately upon its passage and adoption.
