HomeMy WebLinkAbout502ORDINANCE NO. 502, ,, AN 0PJINANCE OF THE CITY OF SANFORD, FLORIDA, RELATING TO FEDERAL OLD AGE AND SURVIVORS INSUI~NCE; E~CLARING THE POLICY AND PURPOSE OF TiE CITY OF SANFORD, FLOR/DA, TO EXTEND TO TIE EMPLOYEES AND OFFICI~?-q OF SAID CITY OF SANFORD, FLORIDA, NOT EXCL~ BY LAW, THE BENEFITS OF THE SYSTEM OF ~,:,~ERAL OLD AGE AND SURVIVOR'S INSURANCE, AS AUTHORIZED BY THE FEDERAL SOCIAL SECURITY ACT, AND AMEND- ME~TS THERETO, UPON THE BASIS OF APPLICABLE STATE AND FEDERAL LAWS OR REGULATIONS;AUTH- 0R[ZING AND DIRECTING THE MAYOR, OR OT~ER CETEF EX~]CUTIVE OFFICER, TO E]CECUTE AGREEMEi~TS A~D AMENDMENTS TH~RET0 WITH THE STATE AGENCY AJTHORIZED TO ENTER INT0 SUCH AGREEMENTS, FOR 60VERAGE OF SAID EMPLOYEES AND OFFICI~-q; PRO- YIDING FOR WITHHOLDINGS FROM SALARIES AND WAG- ES OF EMPLOYEES AND OFFICIALS OF S~AID CITY SO COVERED TO BE MADE AND PAID OVER AS PROVIDED BY APPLICABLE STATE OR FEDERAL LAWS OR REGULA- TIONS; PROVIDING THAT SAID CITY SHALL APPR0- PRIATE AND PAY OVER ~V~LOYER'S CONTRIBUTI(NS AS PROVIDED BY APPLICABLE STATE O! FEDERAL LAWS OR REGULATIONS; PROVIDING THAT SAID CITY SHALL .~:,:P RECORDS AND ~iAEE REPORTS AS REQUIRED BY APPLICABLE STATE OR FEDERAL LAWS OR REGULATIONS. BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANF~D, FLORIDA: Section 1. It is hereby declared to be the policy and pur- pose of the City of Sanford,Florida, to extend, effective as of ~an- uary l, 1951, to the employees and officials thereof, not excluded by law, and whether employed in connection with a governmental or pro- prietary function, the benefits of the system of 01d Age and Surviv- or's Insurance as authorized by the Federal Social Security Act and amendments thereto, including Public Law 73& of 81st Congress, and by Chapter 268&1, Florida Statutes, 1951; and to cover by such plan all services which constitute employment as defined in Section 2 of said Chapter 268&1, Laws of Florida, 1951, performed in the employ of said City by employees thereof. In pursuance of said policy, and for that purpose, the City shall take such action as may be re- quired by applicable State or Federal laws or regulations. Section 2. The Mayor, or other chief executive officer, of the City of Sanford, Florida, is hereby authorized and directed to execute all necessary agreements and amendments theret'o with the Chairman of the Florida Industrial Commission as the State A~ency for the State of Florida, or his authorized representative, for the purpose of extending the benefits provided by said system of Old Age and Survivor's Insurance to the employees and officials of this City as provided in Section i hereof, which agreement shall provide for such methods of administration of the plan by said City as are found by the State Agency to be necessary for the prOper and efficient administration thereof, and shall be effective with respect to ser- vices in employment ~vered by such agreement performed after the first day of January, A. D. 1951. Section 3. Withholdings from salaries, wages, or other compensation of employees and officials for the purpose provided in Section i hereof are hereby authorized to be made, and shall be made, in the amounts and at such times as may be required by ap- plicable State or Federal laws or regulations, a nd shall be paid over to the State Agency designated by said laws or regulations to receive such amounts. Section ~. There shall be appropriated from available funds, derived from the general operating fund of the City from ad valorem and other Sourcas, such amounts, at such times, as may be required to pay promptly the contributions required of the City as employer by applicable State or Federal laws or regulations, which shall be paid over to the lawfully designated~State Agen- cy at the times and in the manner provided by law and regulation. Section 5. The City shall keep such records and make such reports as may be required by applicable State Or Federal laws or regulations, aha shall adhere to the rules and regulations of the State Agency for the enforcement of said laws and regulations. Section 6. There is hereby excluded from this ordinance any authority to make any agreement with respect to any position or any employee Or official now covered, or authorized to be eov- - 2 - ered, by any other ordinance or law creating any retirement system for any employee or official of She said City. Section 7. The City of Sanford, Florida,does hereby adopt the terms, conditions, requirements, reservations, benefits, privileges, and other conditions thereunto appertaining, of Title II of the Social Security Act as amended by Public Law, No. 73~, 81st Congress, for and on behalf of all the officers end employees thereof and of its departments and agencies, save and except any of such officers and employees now covered or authorized to be cov- ered by any retirement system provided by law, end further except- lng any official or employee who occupies any position, office, or employment not authorized to be covered by applicable State or Fed- eral laws or regulations. Section 8. The City Clerk of the City of Sanford is here- by designated the custodian of all sums withheld from the compen- sation of officers and employees and of the appropriated funds for the contribution of the City and the City Clerk of said City is hereby made the withholding and reporting agent and charged with the duty of maintaining personnel records for the purposes of this ord- inance. Section 9. This ordinance shall take effect immediately upon its passage and approval and publication as required by law. PASSED ANDAPPROVED this ~th day cf ~une, 1952.
