An ordinance of the City of Sanford, Florida amending Section
2 -2 of the City Code of the City of Sanford relating to interest
rates charged upon amounts due to the City; providing for the
taking of implementing administrative actions; providing for
conflicts; providing for severability; providing for codification
and providing for an effective date.
Be it enacted by the People of the City of Sanford, Florida:
Section 1. Amendment to Section 2 -2, City Code; Interest Rates.
Section 2 -2 of the City Code of the City of Sanford is amended to read as follows:
Sec. 2 -2. Interest rate on obligations to City.
The interest rate due to the City and which shall be collected by the City with
regard to any sum due to the City under this Code shall be one percent per
month or the maximum interest rate authorized by law, whichever is less unless
a rate is established for a particular proiect or program by means of adoption of a
resolution or the terms and conditions of an agreement based upon the unique
characteristics of the proiect or program A lien against the user's property may
be filed and the lien may be pursued, in accordance with the provisions of
controlling law, to reimburse the city for any and all charges, judgments, fines,
penalties, sums due from orders entered in the code enforcement processes of
the city (to include, but not be limited to, the charges incurred by special
magistrates and attorneys fees of the city). and other financial obligations due to
the City; provided, however, that this provision shall not apply to contracts in
which the City is a party and the terms and conditions of the contract provide
contrary to the provisions of this Section and other matters over which controlling
State or Federal law takes precedence.
Section 2. Conflicts.
All ordinances or part of ordinances in conflict with this Ordinance are
hereby repealed
Section 3. Severability.
If any section, sentence, phrase, word, or portion of this Ordinance is
determined to be invalid, unlawful or unconstitutional, said determination shall not

be held to invalidate or impair the validity, force or effect of any other section,
sentence, phrase, word, or portion of this Ordinance not otherwise determined to
be invalid, unlawful, or unconstitutional.
Section 4. Codification.
Section 1 of this Ordinance shall be codified in the City Code of the City of
Sanford, but all other sections of this Ordinance shall not be codified.
Section 5. Effective Date.
This Ordinance shall take effect immediately upon passage and adoption.
