HomeMy WebLinkAbout768 ORDINANCE NO. ~ ~ AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA PROVIDING FOR CONDEMNATION AND DEMOLITION OF DELAPIDATED, UN- SANITARY AND UNSAFE BUILDINGS OR STRUCTURES; PROVIDING FOR THE USE AND OCCUPANCY THEREOF; PRESCRIBING THE PROCEDURE TO CONDEMN SUCH BUILDINGS AND THE PROCEDURE FOR REMOVAL OR REPAIR OF THE SAME; PRESCRIBING PENALTIES FOR VIOLATION. BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1. That the City Commission of the City of Sanford, Florida is authorized to condemn and order to be demolished and removed, or to be put in a sound state of repair, any and all build- ings and structures within the City of Sanford found to be in a delapidated, unsanitary or unsafe condition. SECTION 2. The Building Inspector and the Fire Chief of the City of Sanford, Florida are hereby required to periodically inspect all buildings and structures within the City of Sanford, and if such officials find any building or structure to be in a delapidated, unsanitary or un- safe condition, to report such fact in writing to the City Commission, specifying in detail the condition of said building or structure. The City Commission shall thereupon determine whether or not a public hearing shall be held to condemn such building or structure, and in the event the City Commission determines such hearing will be held, it shall order placed upon such building or structure a notice of con- demnation, in essentially the form attached hereto marked Exhibit "A" and made a part hereof, and simultaneously therewith direct by registered mail, to the last-known address as shown by the tax assessment rolls of the City of Sanford, Florida, a notice to the owner of the property involved, that said building or structure thereon has been found by officials of the City of Sanford to be in a delapidated, un- sanitary or unsafe condition, and that the City intends to condemn the same; such notice shall further provide that a hearing will be held before the City Com~nission at a stated time not to exceed thirty (30) days from the date of such notice, and at a stated place, and that at such time and place a full determination will be made by the City Commission as to the condition of said building or structure; the property owner at such time shall have a full oppor- tunity to be heard and to present such evidence as the owner sees fit. At the time and place of such hearing the City Commission shall hear all evidence produced and determine whether or not said building or structure shall be condemned. SECTION 3. If the City Commission determines upon full hearing that said building or structure should be condemned, such fact shall be certified in writing to said property owner in- cluding reasonable specifications as to the deficiencies justifying such condemnation and a certificate of condemnation, in essentially the form attached hereto marked Exhibit "B" and made a part hereof, placed upon the building or structure certifying that the same is con- demned; the property owner shall be given a reasonable time, accord- lng to the size, condition and location of such building or structure, in which to cause said building or structure to be demolished and removed or placed in a state of sound repair pursuant to and in conformance with all applicable sanitary, electrical, plumbing and fire codes in force m the City of Sanford, Florida, and in the event of failure on the part of the property owner, within said time period, to effect such demolition and removal or repair, that said building or structure will be demolished and removed by the City of Sanford and the cost of the same assessed as a lien against the land. No building or structure condemned shall be occupied or used for any purpose during the period of time the same is condemned. SECTION 4. If, within the time stated in said notice, the said property owner fails to demolish and remove or repair said con- derrmed building or structure, and has not shown cause before the City Commission which justifies an extension of time, the City Commission shall forthwith cause said building or structure to be demolished or removed by the City and the cost of the same assessed as a lien upon the land. SECTION 5. Violation of this ordinance shall, in addition to the remedy hereinabove provided, be punishable by fine not exceeding Two Hundred and 00/100 Dollars ($200.00) or imprisonment not exceeding ninety (90) days, or by both such fine or imprisonment. Each day of any violation of this ordinance shall constitute a separate offense. SECTION 6. Any section, paragraph, sentence, clause and phrase of this ordinance which shall be declared unconstitutional by the valid judgment or decree of a court of competent jurisdiction shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections. SECTION 7. This ordinance is in addition to any rights, powers, 3 duties or obligations conferred by charter or law. SECTION 8. This ordinance shall become effective imme- diately upon its passage and adoption. PASSED AND ADOPTED on this the<::~.:~9 day of January, A.D. 1962.
