SUBJECT: Action taken by the Plans Review Committee on Tuesday, May 26, 1998
regarding the approved R.O.W. Use Agreement for 950 Grove Manor Drive.
The Plans Review Committee considered the letter from Ruth and Kathy Stamm requesting the
City to rescind or modify the Right-of-Way Use Agreement approved for 950 Grove Manor Drive (M.
Swafford) that allows a six foot privacy fence to be configured in the Cooke Avenue ROW. The
objection raised by the Stamms is the height of the fence as it approaches the road which
effectively screens the view of their house, thus creating a safety concern for them. At present,
the configuration of a wood fence is permitted up to and along street-front property lines.
Attached are photos of similarly configured fences on the same street and general area of the
subject property. Having the ~ence in the Cooke Avenue ROW obviously places the fence closer to
the Stamm'a house than it otherwise would be if it were configured along the adjoining property
line where it is permitted (approximately 24 feet closer). To mitigate their safety concern, the
Stamms propose the height of the fence be lowered for approximately 40 feet from where it
currently ends near the road to allow visibility to and from their house. Staff does not support or
object to changing the existing fence height since a similarly configured fence could be erected 24
feet away. However, staff suggests in wake of the proposed fence regulations restricting the
height of all fences in side yards from the building line and front yards to only 4 feet, the City
Commission consider applying a reduced height standard in this case as deemed appropriate or
in accordance with any proposed policy change.
