THIS DEVELOPMENT ORDER is made and entered into ttfi~
City of Sanford (thereinafter called "City") a munici~alG
corporation under the laws of the State of Florida and Roberta M.
Padgett and Walter Padgett (hereinafter called "Developer") and
Roberta M. Padgett and Walter Padgett, (hereinafter called "O~er")
relating to and touching and concerning the following described
property:

The development approval sought is consistent with the City of
Sanford Comprehensive Land Use Plan and will be developed
consistent to and in compliance with applicable land development
regulations and all other applicable City regulation's and
ordinances.
FINDINGS OF FACT:

Requested Development Approval: Historic Bed ~d Bre~fast
The owner of the property and the developer have expressly
agreed to be bound by and subject to the development conditions and
co~itments stated below and have covenanted and agreed to have
such conditions and co~itments run with, follow and perpetually
burden the aforedescribed property.

NOW, THEREFORE, it is ORDERED ~D AGREED T~T:
(1) The aforementioned application for development.approval
is G~TED .....

(2) All development shall fully comply with all of the codes
and ordinances in effect in the City at the time of issuance of
permits including all impact fee ordinances.
(3) The conditions upon this development approvai and the
commitments made as to this development approval, all of which ha~eco
been accepted by and agreed to by the developer and the owner~fbO
the property are as follows:
1. Use of the property at 420 Oak Avenue shall be limited ~:~
a. Single Family Residence
or
b. A Bed and Breakfast Inn.
2. ~en operated as a Bed and Breakfast Inn, it shall be
o~er occupied and o~er operated.
3. The nu~er of guest rooms shall not exceed three.
4. The architectural signifance and integrity of the
structure, "Queen ~ne Victorian," shall be maintained.
5.The minimum daily rate shall not be below $50.00 per
night.
(4) This Development Order touches and concerns the
aforedescribed property and the conditions, co~itments and
provision of this Development Order shall perpetually burden, run
with and follow the said property and be a servitude upon and
binding upon said property unless released in whole or part by
action of the City by virtue of a doc~ent of equal dignity
herewith. The o~er and the developer of the said property have
expressly covenanted and agreed to this provision and all other
terms and provisions of this Development Order.
(5) The terms and provisions of this Order are not severable
and in the event any portion of this Order shall be found to be
invalid or illegal, then the entire Order shall be null and void.
IN WITNESS ~EREOF the parties have hereunto set their hands
and seals the day and year first above written.
