SCHOOL RESOURCE OFFICER AGREEMENT
THIS AGREEMENT, is made and entered into this~.O~?~--~day

COUNTY, FLORIDA, hereinafter referred to as "SCHOOL BOARD", and the CITY
OF SANFORD, FLORIDA, a municipal corporation, hereinafter referred to as
"CITY".
WITNESSETH:
WHEREAS, the parties are desirous of entering into an
Agreement for the performance of law enforcement functions provided by a
School Resource Officer hereinafter described; and
WHEREAS, the CITY is agreeable to provide personnel to
perform the duties and responsibilities of a School Resource Officer; and
WHEREAS, the SCHOOL BOARD is agreeable to compensate the CITY
for personnel provided.
WHEREAS, the parties have approved the School Resource Officer
Program as a pilot program and their approval is not to be construed as a
continuing or permanent obligation;
NOW, THEREFORE, in consideration of the mutual understandings
and covenants set forth herein, the parties agree as follows:
1. TERM. The term of this Agreement is from August 17, 1992
through June 11, 1993, the date of signature by the parties
notwithstanding, unless earlier terminated as provided herein.
2. PURPOSE. The purpose of this Agreement is to foster
better relations between students and law enforcement personnel; to deter
crime on or about school premises by the presence of a law enforcement
officer; to enforce local, state and federal laws; and to have a School
Resource Officer available for presentations to the students, faculty and
parents concerning law enforcement and various subjects related to the
law.
3. TERMINATION. This Agreement may be terminated by any
party at any time, with or without cause, upon not less than thirty (30)
days written notice delivered by Certified Mail, Return Receipt
Requested, or in person to the other parties.
4. SERVICES.
(a) The CITY agrees to provide to the SCHOOL BOARD three
(3) full-time School Resource Officers whose duties are described in
Exhibit A attached hereto.
(b) The SCHOOL BOARD agrees to compensate the CITY for
the services of the School Resource Officer, as set forth hereinafter, by
paying to the CITY the agreed upon compensation.
5. COOPERATION. It is agreed that the CITY shall have all
reasonable and necessary cooperation and assistance from the SCHOOL
BOARD, its officers, agents and employees so as to facilitate the
performance of this Agreement.
6. LIABILITY FOR SALARIES. The SCHOOL BOARD shall not be
liable for the payment of any salaries, wages or other compensation to
any School Resource Officer performing services pursuant to this
Agreement.
7. LIABILITY FOR INJURY OR SICKNESS. The SCHOOL BOARD shall
not be liable for the payment of any sums or indemnification to the CITY,
or any of its employees, for injuries or sickness arising out of
performance of duties of a school resource officer hereunderand the CITY
hereby agrees to hold harmless the SCHOOL BOARD against such claims.
For all purposes pursuant to this provision specifically and
to this Agreement in general, the School Resource Officers shall be
deemed employees solely of the CITY and shall at all times be deemed to
be acting within the course and scope of his employment as a City of
Sanford Police Officer.
8. INDEMNIFICATION. The CITY, its officers, agents and
employees shall not be deemed to assume any liability for the intentional
or negligent acts or omissions of the SCHOOL BOARD or any of its
officers, agents or employees, and said SCHOOL BOARD agree to hold
harmless, indemnify, and defend the CITY COMMISSION, its officers and
employees from any and all claims for damages arising therefrom.
The SCHOOL BOARD, its officers and employees shall not be
deemed to assume any liability for the intentional or negligent acts or
omissions of the CITY, or any of its officers, agents or employees, and
said CITY agree to hold harmless, indemnify, and defend the SCHOOL BOARD,
its officers and employees, from any and all claims for damages arising
therefrom.
9. EMPLOYEE STATUS. It is understood and agreed by the
parties that no School Resource Officer shall be deemed an employee of
the SCHOOL BOARD.
10. COMPENSATION AND PAYMENT.
(a) The SCHOOL BOARD hereby agrees to compensate the
CITY for all services provided hereunder by the CITY the sum of SIXTY
FOUR THOUSAND TWO HUNDRED EIGHTEEN DOLLARS AND 00/100 DOLLARS ($64,218).
Said sum is payable in ten (10) equal installments to the CITY with the
first installment due on October 5, 1992 and the remaining installments
due on the fifth (Sth) day of each succeeding month during the term of
this Agreement.
11. The Chief of Police, City of Sanford, is hereby
designated by the City as its employer charged with the responsibility to
administer this contract. The Superintendent is hereby designated by the
School Board of Seminole County, Florida, and charged with the
responsibility to administer this contract.
12. ENTIRE AGREEMENT
{a) It is understood and agreed that the entire
Agreement of the parties is contained herein and that this Agreement
supersedes all oral agreements and negotiations between the parties
relating to the subject matter hereof, as well as any previous agreements
presently in effect between the parties, relating to the subject matter
hereof.
(b) Any alterations, amendments, deletions or waivers of
the provisions of this Agreement shall be valid only when expressed in
writing and duly signed by the parties.
13. NOTICES. Whenever any party desires to give notice unto
the others notice may be sent to:

SCHOOL RESOURCE OFFICER
DUTIES AND RESPONSIBILITIES: In addition to the routine
duties and responsibilities of a Sanford City, Police Officer, the School
Resource Officer will have the following specific duties and
responsibilities:
(a) The Officer will be under the supervision of and
accountable directly to the Sanford Police Chief.
(b) The Officer will be responsible for reporting for
his/her tour of duty properly attired, and shall possess the necessary
equipment to fulfill his/her daily assignments.
(c) The School Resource Officer's primary responsibility
shall be his/her assigned school, (Lakeview Middle School, Sanford Middle
School, Crooms, Ooldsboro & Elementary Roamer) and related feeder schools.
(d} The Officer will have the responsibility of
originating the proper event report on any incident ofI a police nature,
and follow the existing procedures that apply to this investigation.
(e) The Officer will be required to be familiar with the
operation of audio-visual equipment necessary in the presentation of
programs.
(f) Upon arrtval at the school, the Officer should
report to the principal or staff member appointed by the principal,
(g) The Officer will coordinate all activities at the
school with the principal or his/her agent.
(h) The Officer will make a report on any violation
referred to him/her by the principal or his/her agent.
(i) The Officer will be required to perform other police
duties which are assigned by a supervisor; such as, special
investigations, special assignments, etc.

(j) The Officer will make contact reports on the various
students which he/she has occasion to counsel. All communications
between the Officer and students shall be deemed confidential
communications. The officer shall be bound by the terms, conditions and
limitations of Section 228.093, Florida Statutes. No students will be
contacted with respect to involvement of criminal activities without the
prior knowledge of the principal and parents. The Officers shall not
initiate a criminal investigation on the basis of information received
from students without knowledge of the student's principal and student's
parents,
(k) The Officer will work with the students, faculty and
parents presenting the various programs available through the department.
(1) The Officer will integrate with the students in the
following ways: between class breaks, during lunch periods, before and
after school, at school activities such as football and basketball games
and in classrooms.
(m) The Officer will serve as a referral resource for
the students, faculty and parents to the many social agencies and
facilities available to the public.
(n) The Officer will attempt to identify those students
displaying early signs of delinquent behavior in order to guide them away
from deviate behavior. However, no criminal investigation shall be
initiated without the prior knowledge of the student's principal and
student's parents.
(o) The Officer will patrol neighborhood areas after
school hours, meeting the people in the neighborhood of students in their
home environment.
(p) The Officer will be available to present various
subjects related to the law that will enable the students to better
understand the many facets of law enforcement.
(q) The Officer will encoura9e individual and small
group discussions with students to further establish rapport of a
positive nature.

{r} The Officer will attend various student, faculty or
parent meetings to maintain good community relations and to solicit the
support and understanding of the School Resource Officer Program.
{s} The Officer and the school principal will develop
plans and strategies to prevent and/or minimize dangerous situations
which might result in the event of student unrest.
{t} In the event of emergencies or civil disturbances
off school premises requiring the presence of the School Resource
Officers, the officers will be required to respond and such response will
in no way alter the compensation paid by the SCHOOL BOARD.
{u) All issues of policy shall be resolved by the Police
Chief and the Superintendent or his designee.
