GRANT OF RIGHT-OF-WAY
THIS INDENTURE, made this i t~ day of ~L.Y ., 2002, A.D., between Thomas B.
Bali, lit of the County of Seminole and State of Florida, party of the first part or "Bali", and the
CITY OF SAN FORD, FLORIDA, a municipal corporation, situate in Seminole County, Flodda, party
of the second part or "City";
WITNESSETH, that party of the first pad, for and in consideration of the sum of One Dollar and
other valuable consideration to party of the first part, in hand paid by party of the second part,
receipt whereof is hereby acknowledged, has granted and conveyed, and by these presents does
grant and convey to party of the second part, its successors, assigns, and licensees, a perpetual
right-of-way easement under, upon, over and across the property situate in Sanford, Seminole
County, Florida, more particularly described as:
A portion of Section 27, Township 19 South, Range 30 East, Seminole County,
Florida; being more particularly described as follows: (see attached sketches of
description)
The south 50 feet of the following described properties:
I acre homestead located in Block 36, M.M. Smith's Subdivision as per plat thereof
as recorded in Plat Book 1, Page 55 of the Public Records of Seminole County,
Florida, and; Block 36, (less one acre for Homestead Exemption), M.M. Smith's
Subdivision as per plat thereof as recorded in Plat Book 1, Page 55 of the Public
Records of Seminole County, Flodda.
The above properties relate to Tax Parcel Identification Numbers 26-19-30-5AE-360Ao0000, and
26-19-30-5AE-3600-000 for public right-of-way and utility purposes, including, specifically street,
roadways, storm and sanitary sewers and for the installation, inspection, servicing, repair,
maintenance, and replacement of all utilities now existing or hereafter to exist on said property,
such right-of-way including, but not limited to, the dght of free ingress and egress over and across
said property for any of the purposes aforesaid, together with the right to open the rights-of-way
to the party of the second part and to the general public.
Ball hereby warrants that he has good and marketable title to the properties hereby conveyed and
that the said properties are free and clear from all liens and encumbrances.
The City agrees that it will reasonably provide to Ball's remainder properties to the properties
herein conveyed reasonable water and sewer utility stub outs to reasonably serve the said
remainder property of Ball.
The City agrees that it will provide to Ball reasonable commercial standard curb cuts at reasonable
locations on the remainder property of Ball to conform to minimum separation requirements as
stated in the City's Land Development Regulations and consistent with sound and generally

accepted engineering practices and principles.
The City agrees that it will demolish the house structure and swimming pool located at the
northeast quadrant of the intersection of Jewett Lane and Meisch Road provided that Ball provides
lawful access into and right of entry upon said parcel.
