4247 Police Chief opt out of Police Pension FdPage 11 Ordinance No. 2011 -4247 An Ordinance of the City of Sanford, Florida relating to the police officers' retirement system; amending Section 66 -32, City Code, pertaining to membership in the police officers' retirement system; providing for a savings provision; providing for conflicts; providing for severability; providing for codification and providing for an effective date. Be It Enacted By The People Of The City Of Sanford, Florida: Section 1. Amendment to Section 66 -32. Section 66 -32 of the City Code of the City of Sanford is amended to read as follows: (1) Conditions of Eligibility (a) All police officers employed by the Citv as of the 9#90iye date A rip 127. 1998 and all future new police officers, shall become members of this system as a condition of employment. Notwithstanding the requirements of this Subsection, the Chief of Police who is employed by the City on the effective date of this Ordinance may, within sixty (60) days of the said effective date, and any future Chief of Police may, within sixty (60) days of the commencement of his or her employment as Chief of Police, notify the City Manager, in writing, of his or her election to not be a member of the system. In the event of any such election, he or she shall be barred from future membership in the system and any contributions made after employment and prior to optina out shall be refunded. Thereafter, contributions to the plan made in accordance with the provisions of Section 66 -35 shall not be required. A Chief of Police makina an election to not be a member of the system shall not be eliaible to be elected as a member trustee on the board or vote for a member trustee and shall not be eligible for any other benefits from the plan. (b) All Future new police officers shall be required to complete a medical examination as prescribed by the City. Page 12 Section 2. Savings. The prior actions of the City of Sanford relating to the administration of the police officers retirement system and relates matters are hereby ratified and affirmed. Section 3. Conflicts. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed. Section 4. Severability. If any section, sentence, phrase, word, or portion of this Ordinance is determined to be invalid, unlawful or unconstitutional, said determination shall not be held to invalidate or impair the validity, force or effect of any other section, sentence, phrase, word, or portion of this Ordinance not otherwise determined to be invalid, unlawful, or unconstitutional. Section 5. Codification. Except for Section 1, the provisions of this Ordinance shall not become and be made a part of the Code of Ordinances of the City of Sanford, Florida. Section 6. Effective Date. This Ordinance shall become effective immediately upon enactment by the City Commission.
