Further consideration next given to the matter of removing the clock and traffic signal tower at the intersection of Park Avenue and First Street, which was ordered removed by the Commission at the meeting of February 10,1941. Thereupon, in view of the objections received from a number of citizens against the removal of the clock and tower, the Commission rescinded the action of February loth., and authorized the Clerk to purchase a rebuilt Simplex Induction Motor- driven Controller from Sanford Electric Contracting Company at a price of $45.75 to replace the old controller for this signal light. On motion of Commissioner Gut, seconded by Commissioner Higgins and carried, the Commission next authorized the following payments on the purchase of the following described properties which comprises a portion of the land and premises described in Resolution No. 589, passed and adopted by the City Commission under date of February 10,1941, providing for the purchase, establishing and construction of an airport or landing field for Sanford. Watson to act as agent for the City to complete the acquisition of the airport property and also to assist the City Attorney in furnishing approving opinions on the titles to such properties. Commissioner Lodge next introducted Resolution No. 592, end after being read in_ full the Clerk, moved its passage and adoption. `'econded by Commissioner Gut and carried by the following vote of the Commission Commissioner Hill Aye Higgins Aye of Gut Aye it Lodge Aye If Rollins Aye said Resolution No. 592 being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, AUTHORIZING THE PURCHASE BY SAID CITY OF THE LANDS AND PREMISES HEREIN DESCRIBED, AND THE EXECUTION BY THE MAYOR AND CITY CLERK, IN THE NAME OF THE CITY OF SANFORD, OF A CONTRACT FOR THE PURCHASE OF SAID PROPERTY. WHEREAS, the City of -'anford is in need of additional property for the storage and preservation of its trucks and other property used by it in the performance of its municipal functions and for other municipal purposes, and the following described lot, piece or parcel of land, situate in close proximity to other property belonging to the City,. to -wit: All North of railroad l Less railroad 'right -of -way) of Mock 8 Tier 9 and all North of railroad ( Less railroad right -of -way) of Block S Tier 10, of E.R.Trafford's Map of 6anford, as recorded in Plat book 1, Pages 56 to 64, and 112, 113, 115,116 and 117 Seminole County necords. has a large substantial building located thereon, and is suitable for the aforesaid needs and uses of the City , and the above described property has been offered by Cooledge Realty & Trust Company, Inc. of Atlanta, ueorgia, the owner thereof, to the City for the sum of $6300.00, payable $300.00 in cash, and the remainder of $6000.00 in instalments of 475.pu per month, beginning on the 1st. day of October 1941, with interest on said sum of $6000.00 at 6o per annum, from date of written agreement of purchase to October 1, 1941, and from October 1, 1941, at the rate of 6-10 per annum, said monthly payments to begin on the 1st. day of October ,1941, and to be applied first to the payment of interest and then to the payment of principal, with the right in the City to anticipate payment of the remainder of purchase price or any part thereof, and accrued interest, the city to pay taxes on said property for the year 1941, and all taxes, if any, thereafter assessed against said property until the purchase price is fully paid, and to save the party of the first part harmless from any claim made for taxes in the event said purchase price is not paid and the contract is terminated and said property is returned to the party of the first part, and the City Commission deems it advisable, expedient and for the best interests of the City for the City to accept the aforesaid offer to sell the above described property at the aforesaid purchase price of $6300.00. ( Seal) On motion of Commissioner Higgins, seconded by Commissioner Rollins and carried the Commission next authorized a donation in amount of $300.00 to the 6eminole County Baseball Association to apply on the deposit in amount of $000.00 required by the Florida State League to secure Sanford's franchise in the League for the ensuing year. Ordinance No. 310, entitled: AN ORDINANCE AMENDING SECTION TNO OF ORDINANCE NO.201 PASSED AND ADOPTED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, ON THE 8th. DAY OF NOVEMBER, 1937, SAID ORDINANCE BEING ENTITLED AS FOLLC S If AN ORDINANCE REQUIRING LICENSES TO BE OBTAINED ANNUALLY FOR CERTAIN BUSINESSES AND THE PAYMENT OF ANNUAL LICENSE TAXES THEREFOR TO THE CITY OF SANFORD, FLORIDA: PROVIDING FOR THE ISSUANCE OF SAID LICENSES, PRESCRIBING A LICENSE YEAR FOR SUCH BUSINESSES, AND PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE." introduced and placed on its first reading at the regular meeting of the City Commission of February 10,1941 was next placed on its second reading and read in full by the Clerk. At this time letters were read from the °anf ord w�rinisterial Association, Rev. W.P.Br�oks, Jr., pastor of the First Baptist Church, and the Woman's Society of Christian Service of the First Methodist Church, petitioning the Commission not to adopt the aforesaid Ordinance No. 310. Thereupon after considerable discussion, and on motion duly carried, said ordinance No. 310 was ordered tabled. Commissioner Higgins next introduced Ordinance No. 311, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, DECLARING AND DEFINING THE PORTION OF SAID CITY HEREIN DESCRIBED TO BE A " HOSPITAL ZONE ", PRESCRIBING THE KIND AND COST OF BUILDINGS THAT MAY BE ERECTED IN SAID " HOSPITAL ZONE "; PROVIDINGCERTAIN RESTRICTIONS AS TO THE USE OF THE PROPERTY IN SAID "HOSPITAL ZONE" AND FOR THE PRESERVATION OF PEACE AND QUIET IN SAID " HOSPITAL ZONE ", AND PROVIDING A PENALTY FOR THE VIOLATION OF THE PROVISIONS OF THIS ORDINANCE. And same was placed on its first reading and read in full by the Clerk. Thereupon Commissioner Higgins moved that the rules be waived and said Ordinance No. 311 be placed on its final passage and adoption. Seconded by Commissioner Rollins. Thereupon the question recurred upon the waivure of the rules. The roll was called and the vote stands as follows: Commissioner Hill Aye 11 Gut Aye 1 1 f n r 1 MINUTES 429 CITY COMMISSION, SANFORD, FLORIDAFebruary 24 at 7: 30 P M 19_ 4.1 Commissioner Higgins Aye " Lodge Aye " Rollins Aye Thereupon the Chairman announced that the City Commission of the City of Sanford, Florida, by unanimous vote, had passed and adopted said Ordinance No. 311, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, DECLARING AND DEFINING THE PORTION OF SAID CITY HEREIN DESCRIBED TO BE A If HOSPITAL ZONE", PRESCRIBING THE KIND AND COST OF BUILDINGS THAT MAY BE ERECTED IN SAID " HOSPITAL ZONE ", PROVIDING CERTAIN RESTRICTIONS AS TO THE USE OF THE PROPERTY IN SAID " HOSPITAL ZONE" AND FOR THE PRESERVATION OF PEACE AND QUIET IN SAID " HOSPITAL ZONE ",AND PROVIDING A PENALTY FOR THE VIOLATION OF THE PROVISIONS OF THIS ORDINANCE. On motion duly adopted Ordinance No. 311 was next ordered PUBLISHED in the Sanford Herald. In connection with interest due march 1, 1941, on Series A and B Refunding bonds dated March 1, 1937, and on advice from the Clerk that sufficient funds are on hand for the purpose, Commissioner Higgins moved that the Clerk be authorized to transmit to the Centrel Hanover Bank & Trust Company , New York City, funds in amount sufficient to pay interest coupons due March 1, 1941, on the outstanding Series A and B Refunding Bonds. Seconded by Commissioner Rollins and carried. Inspector Duncan next reported that a building located on Lot 27 of Cottage Hill is in a dilapidated condition and a fire hazard and recommended that it be condemned. Thereupon the City Attorney wes instructed to prepare a resolution condemning this building, for passage at the next meeting of the Commission. Further request next received from Mr. H.J.Lehmsn, manager of the Sanford. State Farmers' Market that the City install a traffic caution signal light at the intersection. of French Avenue and Thirteenth Street, but in view of the fact that no funds are avail- able at this time for the installation of this traffic signal, the request was ordered. filed, Mr George Weinstein next appeared with reference to the balance of delinquent personal taxes in amount of $101.70 against his store at 102 E.First Street, stating that he is selling out his entire stock of merchandise and fixtures and requested that he be allowed to pay the aforesaid taxes in instalments from time to time from the proceeds of such sale. Request granted. Application next received from R.L.Cornell to purchase Lots 5,6 and 7 of Amended Plat of iiiaonolia Heights, these lots having been acquired by the City through foreclosure of tax and street paving liens. Thereupon after careful consideration, the Commission authorized the sale of the aforesaid lots to Mr. Cornell at a price of 4100.00 each, subject to any unpaid State and County taxes. Chief of iolice 'uilliams next reported on the accident with the 1939 Ford Sedan used by the Police Department, which occurred on the night of February 20th., stating that the accident was caused by the front spring breaking and throwing the car out of control of the driver; Also stating that as a result of the accident Policeman Dunn was injured and had to be admitted to the rernald - Laughton Hospital for medical treatment, and the car damaged to such an extent that it will cost approximately $150.00 to repair. After careful consideration it was the opinion of the Commission that the 1939 Ford Sedan used by the Police Department was damaged to such an extent that it should be replaced by anew automobile, and on motion duly carried, the Clerk was instructed to obtain bids from the local automobile dealers for furnishing such automobile and accept payment therefor as follows: 4cj0 MINUTES CITY COMMISSION, SANFORD, FLORIDA,_' E.bLL1rZry 24 at 7: 30 P 919 41 Allowanced on the Ford Sedan as initial payment, and accept a promissory note payable on or before 3ctober 1, 1941 for the balance, Said bids to be received by the Commission at 10`30 o'clock A.M. February 26th. The Clerk was next instructed to handle the expenses for hospitalization and medical services for Policeman Dunn in accordance with the requirements of the 'Workmen's Compensation Act. In response to the request to J.M.Goggans, District Manager of the Work Projects Administration at Orlando, that the Fort Mellon Park community building project be opened for immediate construction, a letter was next read from him advising that there is not suff ucient labor on the relief rolls not assigned to other projects to permit starting work on the community building at this time. bequest next received from G.e.Spencer, Attorney for W.W.C.Smith to be allowed to sell the old dilapidated building located on Lot 2 Block D Markham Park Heights, and apply the proceeds from such sale toward the payment of delinquent City taxes against thiE property. This house heving been condemned by the City Commission at the meeting of February 10,1941. Request -ranted. The following requests next received for the City to_remove trees from parkways: J.N.Gillon, 1201`Palmetto Ave for the removal of six eucalyptus trees. G.C.Hinchcliffe, 700 Laurel Ave. for the removal of four oak trees. C.'l ;.Sullivan, 300 Magnolia Ave., for the removal of one oak tree. CD Thereupon, after careful consideration, andin view of the expense to the City for furnishing labor and equipment in the removal of trees, the Commission instructed that a charge of $3.50 be made for each tree removed. Upon recommendation of Supt. Moughton, request for the removal of the aforesaid trees was granted, provided the property owners pay the cost for the service.
