A RESOLUTION AUTHORIZING THE PURCHASE 3Y THE CITY OF SANFORD, FLORIDA OF CERTAIN REAL PROPERTY FROM RAPLH B. CHAPMAN, TO BE USED AS A PART OF THE AIRPORT OR LANDING FIELD BEING ESTABLISHED BY THE CITY OF S,tN FORD, AND TO PROVIDE FOR THE PP,64ENT THEREFOR. WHEREAS, the following described lot, piece or parcel of land, situate in Seminole County, Florida is contiguous to the airport or landing field now being established by the City of Sanford, Florida, to -wit: The West 660 feet of the northwest quarter ( NWI) of the northeast quarter (NE4 -) of Section Five (5) , Township Twenty (201 South , Range Thirty -one (31) East, less the East 93 feet of�the South 572 feet of said. West 660 feet lying and being in Seminole County and State of Florida. which said lot-, piece or parcel of land is owned by Ralph B.Chapman, and the City Commission of the City of Sanford, Florida deems it advisable, expedient and for the best interests of said City to acquire the above described lot, piece or parcel of land to be used as a. part of said airport or landing field, and the said Ralph B.Chapman has offered to sell said lot, niece or parcel of land to the City of Sanford, Florida, for the sum of $1,508.79, to be paid as follows: $508.79 in cash, and the balance of $1000.00 in annual installments of $100.00 each, with interest after maturity at 6% per annum, to be evidenced by the promissory note of the City of Sanford, Florida to the said Ralph 3. Chapman; the taxes to become due the City of Sanford, Florida, upon that certain lot, piece or parcel of land, situate in the City of Sanford, Florida, and described as the East Half of Lots 1 and. 2 of 31ock 12 of Tier 2 of Sanford, Florida, according to E.R. Trafford's Map thereof, now owned by the said Ralph B.Chapman, together with any personal property taxes which may become due to the City of Sanford, Florida, by the said Ralph B.Chapman , to be deducted annually from each annual payment, while said -property is owned by the said Ralph 3.0hapman , or his personal representatives, heirs or devisees , until said note is paid. in full. NOW , THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that the City of Sanford, Florida, -ourchase of and from Ralph B.Chapman the above described lot„ piece or parcel of land for the sum of $1,50.79 to be paid as hereinafter stated, said property to be conveyed to the City of Sanford free and clear of all encumbrances, except State and County taxes for 1941, and by general warranty deed , and that the City of �'anford nay said Ralph B.Chanma.n, upon the delivery of said deed of conveyance, the sum of $509.79 in each, and that the Mayor and City Clerk be, and 510 MINUTES CITY COMMISSION, SANFORD, FLORIDA,__ _._____ Jr 1 P M 1 9_ 41 they are hereby authorized and instructed to execute and deliver to the said Ralph B.Chapman the promissory note of said City for the sum of 41000.00 , nayable in annual installments of $100.00 each, beginning on the first day of November , 1041, with interest on any unpaid Installment after maturity at the rate of 6% per annum, said promissory note to contain a provision for the deduction from each annual installment raid_ on said note, of taxes to become due the City of Sanford, Florida, beginning with the year 1941, upon the last above des- cribed 1 -0t, piece or parcel of land owned by him, together with personal property taxes to become due the City by him, said provision to remain in full force and effect while said Ralph B.Ohapman his personal representatives, heirs or deviseeea_, own said property, , until said note shall have been raid in full. Consideration next given to the request of Mr. Chanman to farm the aforesaid property described in the foregoing Resolution No. 607 until such time it is needed for enlarging the airport. Thereupon Commissioner Higgins moved that the City alloy Mr Chanman to farm this prone as a tenant at will , under the provisions that he will surrender possession of it within five days, upon notice from the City, and without any claims against the City for crop loss caused from immediate surrender. Seconded by Commissioner Lodge and carried. Commissioner Higgins next introduced Resolution No. 608 , entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD FLORIDA, AUTHORIZING THE EXECUTION AND DELIVERY OF REFUNDING BONDS OF THE CITY OF SANFORD, FLORIDA, DATED MARCH 1st, 1941 IN EXCHANGE FOR CERTAIN OUTSTANDING BONDS OF SAID -CITY AND DIRECTING THE CANCELLATION AND DESTRUCTION OF CERTAIN UNDELIVERED REFUNDING BONDS OF THE CITY DATED MARCH LST. 19j7 UPON THE EXECUTION AND DELIVERY OF THE AFORESAID REFUNDING SONDS DATED MARCH LST. 1941 TO THE EXCHANGE AGENT HEREIN NAMED. BE IT FURTHER RESOLVED, that said Sanford Atlantic National Bank is hereby authorized and directed to send executed bond No. 1 of each of said Series C, D, and E. of said refunding bonds to Messrs Thomson, Wood & Hoffman, bond counsel., of New York City, New York, for examination and to be returned to said exchange agent with approving opinion of said attorneys of the validity of said bonds, no exchanges of said refunding bonds to be effected until said bond No. 1 of each of said Series is returned, together with O 0 0 O C 0 said approving opinion of said attorneys on said issue of bonds. BE IT FURTHER RESOLVED, that upon the execution and delivery to said exchange agent of the aforesaid refunding bonds dated March 1st, 1941, and to be exchanged as aforesaid for the aforesaid bonds of the City, undelivered Refunding Bonds , Series A, of the City dated March let, 1937, numbered from 5017 to 5173 inclusive, maturing Seotember 1st, 1977, in the denomination of $1,000.00 each, aggregating the principal sum of 4157,000.00 with coupons appurtenant thereto and undelivered Refunding Bonds, Series B. of the City dated March let„ 1937, maturing September 1st , 1977, numbered from 612 to 626 inclusive in the denomination of $1,000.00 each and aggregating the principal sum of $15,000.00, and coupons appurtenant thereto, shall be canceled and destroyed by said exchan e agent and the City Clerk as required by Section 17 of said Resolution No. 601, and certificate of cancellation executed by them and incorporated in the minutes of the City Commission and certified copy of such minutes furnished to aforesaid bond counsel. BE IT FURTHER RESOLVED, that the Mayor and City Ulerk and the Cashier of the aforesaid exchange agent execute and deliver to the aforesaid bond counsel signature certificates for said refunding bonds dated March 1st, 1941, and that the Clerk of the Circuit Court of the Ninth Judicial Circuit of the State of Florida in and for Seminole County, Florida, execute and deliver to the City Attoreny for forwarding to bond counsel, validation certificate snowing the signing and sealing of the validation certificate, on said refunding bonds dated March let, 1941.
