042340�I �J u 1 1 1 MINUTES It CITY COMMISSION, SANFORD, FLORIDA, April 23 at 7: 30 P 14 Q40 2'9 The City Commission of the City of Sanford, Florida, met in adjourned session at the City Hall in the City of Danford, Florida., at 7:30 o'clock P.M. April 23, 1940. Present: Commissioner Walter S. Coleman, Mayor. " H James Gut " M.J. Lodge " G.E.Rollins City Attorney Fred R. Wilson " Cleft, H.N. Sayer. Absent: Commissioner Edward Higgns. Meeting called to order by the Chairman. On motion of Commissioner Rollins, seconded by Commissioner Gut and carried, the Commission next approved the purchase from Mrs. Margaret Kirtley of 3,000. azalea plants, 250 dogwood plants and 250 gardenia plants at a cost of $540.71, that were sold to citizens of Sanford and Seminole County thru the Sanford Garden Club on April 16th., the proceeds of said sale having been returned to the City for reimbursement of the purchase of the plants. On motion duly adopted, the Clerk was next instructed to write a letter to Mr. R.L. Dean,, editor of the Sanford Herald, and the Sanford Garden Club expressing the appreciation of the City Commission for their support and services rendered in handling the flower plant sales for the City on April 5th and 16th. Communication next read from Mrs. Elizabeth F Welden, guest of the Mayfair Hotel, bringing to the attention of the City Commission of the number of heavy trucks using East First Street and Seminole Boulevard. Thereupon, after careful consideration, the Commission instructed that Seminole Boulevard and First Street be closed to truck traffic from Sanford Avenue east to Mellonville Avenue and that all truck traffic thru this section be routed over Union Avenue and Celery Avenue. A letter of appreciation on behalf of theBoy Scouts next read from Herman Morris, thanking the City Commission for the use of the grounds for the Boy Scouts Camporee and their cooperation in making it a success. The Clerk next informed the Commission that a number of property owners who are paying delinquent taxes under authority of 'Jrdinences Nos. 269 and 275 ( 7 year instalment plan) Nave not paid the instalment and current taxes due April 1, 1940. Thereupon, after careful consideration Commissioner Gut moved that 90 days extension . be granted for the payment of instalments and current taxes due and payable under the provisions of Ordinances No. 269 and 275, and that after the expiration of this extension. the authority for payment of such taxes on the adjusted basis be revoked on all unpaid instalments due April 1, 1940, in accordance with the provisions of the aforesaid ordinances. Seconded by Commissioner Lodge and carried. Commissioner Gut next introduced Resolution No. 573 and after being read in full by the Clerk moved its passage and adoption. A RESOLUTION OF THE CITY C09MISSION OF THE CITY OF SANFORD , FLORIDA, PROVIDING FOR THE ADJUSTMENT OF CERTAIN DELINQUENT TAXES AND /OR SPECIAL ASSESSMENTS AGAINST UNIMPROVED REAL PROPERTY IN THE CITY OF SANFORD, FLORIDA. WHEREAS, the City Commission of the City of Sanford, Florida, pursuant to the provisions 12SO MINUTES of Chapter CITY COMMISSION, SANFORD, FLORIDA, __._ —April 23 7:30 P M-19 40 ,Laws of Florida, Acts of 1939, has adjusted certain delinquent taxes and /or special assessments against reel property situate in the City of Sanford, Florida but there are many unimproved lots, pieces and parcels of land in said City against which delinquent taxes and /or special assessments exist and are subject to adjustmant, and which delinquent taxes and /or special assessments have not been adjusted, and such property is burden with delinquent taxes and /or special assessments to such extent that it is not probable that such delinquent taxes and /or special assessments would be redeemed for the full amount thereof within any reasonable time, and the City Commission deems it advisable, expedient. and for the best interests of said City that such delinquent taxes and /or special assessments be adjusted under the terms and provisions hereof: N0' +d, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA: That delinquent taxes and /or special assessments held by the City of Danford, Florida, against unimproved real property in:said City, and which delinquent taxes and / or special assessments are subject to adjustment, but have not been adjusted, shall, until further order of the City Commission , be considered as having been adjusted in accordance with the plan of adjustment now in operation by said City, but the total amount due on said delinquent taxes and /or special assessments, as adjusted, shall be paid in full prior to the insti- tution of suit for foreclosure by the City of such delinquent taxes and /or special assessments, or before the right herein granted is rescinded; provided , however, that such adjustment of delinquent taxes and /or special assessments shall not become effective until said delinquent taxes and /or special assessments are actually paid in full, and nothing herein contained shall prevent the City from instituting suit to foreclose any of said delinquent tax liens and /or special assessment liens at any time, if it desires, for the full amount of said delinquent taxes and /or special assessments, including interest and penalties. BE IT FURTHER RESOLVED that the City Tax Collector be and she is hereby authorized to accept payment in full of said adjusted taxes and /or special assessment liens, in accordance with tais resolution until further order of the City Commission. Moughton oe instructed to demolish and remove the dilapidated building located on the following described property, in accordance with Resolution No. 572, passed and adopted by the City Commission at the meeting of April 8, 1940. Beginning 15.59 chains East of Southwest corner of Section 31, township 19, south, -range 31, run North 3.18 chains, west 1.59 chains, south 3.1$ chains, E. 1.59 chains to beginning. Seconded by Commissioner Rollins. and carried. The Clerk next reported that for the years 1937,1938 and 1939 Lot 2 Block 14 Tier 6, had been assessed as improved property, whereas the house on this property burned in March 1936 and should have been assessed as unimproved for these years. Thereupon in order to correct this error in assessment, Commissioner Gut moved that the taxes be adjusted to $6.25 for the year 1937, to 6.60 for 1938 and to $2.70 f for the year 1939. Seconded by Commissioner Rollins and carried. �>n motion of Commissioner Gut, seconded by Commissioner Rollins and carried, the Mayor and Clerk were next authorized to execute satisf actiDn of an old paving lien dated March 10,1910 in amount of $106.93 standing open on Lien Book K, page 36 of the records of Orange County against Lot 1 Block 8 Tier 4, due to there being no record on the books of the City of such lien being unpaid. Dr. C M Mitchell next submitted an offer of $750.00 as full settlement of delinquent taxes thru 1939 in amount of $871.09 under the adjusted basis, against Lot 2 Block 13 Tier 1; the W. 6b ft, of Lots 9 and 10 Block 5, Tier 1; and the W. 45 f t of IN. 120 f t of: Beg. 100 ft. ( Less N. 30 ft for street) Off er ref used. 2R1 Communication next read from the Sallie Harrison Chapter of Daughters of the American Revolution offering to present the City with the Historic Sanford bell to be erected in Fort Mellon Park. Thereupon the Clerk was instructed to acknowledge acceptance of the Historic Sanford bell for the City Commission, and to express their appreciation for this contribution to the City for Fort Mellon Park. City Attorney 'Wilson next reported that D.F. Joy had accepted the City's proposition of deeding him the east 100 ft. of that part of Block 14 of Chapman & Tucker's Addition lying south of First Street, in exchange for deed of conveyance to the City of Lots 14 and 15 of Block A, and lots 16 and 17 of Block D, First Street Extension, provided the City will reimburse him for the payment of 1939 State & County taxes on the aforesaid lots in amount of 413.16. Thereupon Commissioner Gut moved that the Yayor and Clerk be authorized to execute deed of conveyance of the East 100 ft. of that part of Block 14 of Chapman & Tucker's Addition lying south of First Street to D.F.Joy in exchange for a deed of conveyance to the City of lots 14 and 15 of Block A, and Lots 16 and 17 of Block D, First Street Extension and that the City reimburse .fir. Joy for the 1939 State & County taxes paid on the aforesaid lots in First Street Extension in amount of 13.16. Seconded by Commissioner Rollins and carried. 2S 2 MINUTES CITY COMMISSION, SANFORD, FLORIDA, Ari1 23., at 7:30 P 19 4Q_ Consideration next given to remunerating S.M.RiChard, City Employee, for the extra services rendered by him in the installation of the new water supply main from the wells to the water pumping station and the connection of the well pumps to the new main, which included several hours of work on his own time. Thereupon Co_r:missioner Gut moved that the City pay Mr. RiChard $50.00 for this extra service. Request next received from Dr. Douglass M Scott for the following adjustment of the assessed valuation of his personal tax assessments. Household goods 1937 assessment $200.00 , request reduction to :150.00 1938 " 200.00 If it if 150.00 1939 " 200.00 it if " 150.00 Office Equipment 1936 " 300.00 it " " 150.00 1939 " 250.00 if " ++ 150.00 Thereupon, after comparing the assessed valuation of this property with other assessed valuation on the tax rolls of property with equal vague, the Commission felt that the above assessments are well in line and no adjustment could be allowed. On motion duly adopted, the Commission next authorized the purchase from Rogers, Torrey Cohu, New York City of five Refunding Series "A bonds with coupons due dept- 10 1940, and subsequent coupons attached, at a price of $277.50 per bond and interest.
