070840304 MINUTES CITY COMMISSION, SANFORD, FLORIDA,— July ( FOR MEETING OF 8 at 7:30 P M 19 JULY 1st. See Page 310 40 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida., at 7:30 o'clock P.M. July 8, 1940. Present: Commissioner Falter S. Coleman, Mayor. " H James Gut " Edward Higgins " M J Lodge Absent " G E Rollins Present: City Attorney Fred R. Wilson " Ci ty Clerk H N Sayer " Chief of Police R.G.Williams Meeting called to order by the Chairman. Minutes of regular meeting of June 10th , adjourned meeting of June 12th, and regular meeting of June 24th. 1940 next read and approved. Current invoices and payrolls forthe month of June 1940, properly audited and vouchered as evidenced by vouchers Nos 2282 thru 2373 submitted, examined, approved and payment authorized. Monthly reports of the streets, sanitation, health, water, police, fire, library, golf and recreation departments for the month of June 1940 submitted and examined. Financial statement and statement of revenues and expenditures during the month of June 1940, submitted and examined. Bank statements in all accounts for the month of June 1940, properly reconciled, submitted and examined. Mrs Helen Schultz next appeared on behalf of the Seminole County Welfare Board and requested that the City's monthly contribution of $50.00 to the Board for welfare work be increased to $100.99 per month during July, August and September, stating that the additional funds are needed to help defray the increased expenses of the Seminole County i Welfare Board in view of its having to take over the work that has previously been handle by the State Welfare Department, also advising that the County will appropriate sufficient funds in their next fiscal year's budget to take care of this additional expenses, beginning October 1, 1940. Matter taken under advisement. The Clerk next reported that for the year 1939 Block 6 Tier 16 had been assessed as improved property, whereas the house on this property was torn down and removed by the owner in 1938 without obtaining a permit. Thereupon in order to correct this error in assessment, Commissioner Higgins moved that the taxes for year 1939 be adjusted to $7.20. Seconded by Commissioner Gut and carried. On motion of Commissioner Higgins, seconded by Commissioner Gut and carried, the Commis ion next approved the purchase from Baynard Brothers Realty & Insurance Co., St. Petersburg, Florida, of 20 Refunding Series A Bonds Nos. 173/182 and 214/223 with coupons due September 1, 1940, and subsequent coupons attached, at a price of $260.00 per bond and interest. Report of fourth spring analysis of milk being furnished by dairies operating in the City of �anf ord, as prepared by the X —Ray and Clinical Laboratores, next presented, such reports showing all such milk well within the requirement of Grade "A" milk. 1 1 1 1 1 MINUTES CITY COMMISSION, SANFORD, FLORIDA,_ Jam_ l � -7:30 P M 19 -40 eln 5 Communication next read from the X -Ray & Clinical Laboratories advising that effective June 1, 1940 , their fee for making milk examinations will be $2.00 for each sample of milk tested, instead of $1.00 as heretofore charged. The Clerk then advised the Commission that Dr. J.L.Ruble of Orlando will make each examination for a fee of $5.00 , which will include as many samples of milk as the City desires to have tested. Thereupon Commissioner Gut moved that the Clerk be instructed to send all samples of milk to be analyzed to Orlando and have it examined by Doctor Ruble, beginning with the next analyses. Seconded by Commissioner Higgins and carried. Commissioner Higgins next introduced Ordinance No. 296, entitled: " AN ORDINANCE PROVIDING FOR THE REGISTRATION OF BICYCLES AND LICENSING, TAXING AND REGULATING THE USE THEREOF IN THE CITY OF SANFORD, FLORIDA, AUTHORIZING THE REVOCATION OF LICENSES, and PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE." and same was placed on its first reading and read in fullby the Clerk. Thereupon Commissioner Higgins moved that rules be waived and said Ordinance No.296 be placed on its final passage and adoption. Seconded by Commissioner Gut. Thereupon the question recurred upon the w$ivure of the rules. The roll was called and the vote stands as follows: Commissioner Coleman Aye " Gut Aye " Higgins Aye " Lodge Aye Thereupon the Chairman announced that the City Commission of the City of Sanford, Florida, by unanimous voted had passed and adopted said Ordinance No. 296, entitled: ORDINANCE NO. 296 AN ORDINANCE PROVIDING FOR THE REGISTRATION OF BICYCLES AND LICENSING, TAXING AND REGULATING THE USE THEREOF IN THE CITY OF SANFORD, FLORIDA, AUTHORIZING THE REVOCATION OF LICENSES, AND PROVIDING A PENALTY FOR THE VIOLATION] OF THIS ORDINANCE. On motion duly adopted, Ordinance No. 296 was next ordered PUBLISHED in the Sanford Herald. Request next received from the Sanford State Farmers' Wholesale Market for the City to give them 200 feet of the old second -hand redwood water pipe, to be used for drainage purposes on the market grounds, and on motion duly adopted, same was authorized. The Clerk next reported that the ninety days extension allowed for payment of the instal- ment and current taxes due April 11 1940, as required by Ordinances Nos. 269 and 275 had expired and that several property owners paying delinquent taxes under the provisions of these ordinance had failed to pay the instalment due Apr 1,1940 and current taxes. Thereupon, after careful consideration Commissioner Gut moved that an additional 60 days extension be granted for the payment of the instalments due Apr 1, 1940, providing the current taxes are paid now, and that after the expiration of this extension of time, the authority for payment of such taxes and /or special assessments on the adjusted basis be revoked on all unpaid delinquent instalments in accordance with the provisions of Ordinances No. 269 and No.275, and that all property owners effected be duly notified. 306 MINUTES CITY COMMISSION, SANFORD, FLORIDA, J 1 S at 7:30 P M 19!0 Seconded by Commissioner Higgins and carried. Inspector Duncan next reported that the buildings located on the following described properties are in a dilapidated unsafe condition and fire hazards., Lot 6 Block 2 Tier 9, Sanford. Lot 7 Block 11 Tier H. Sanford N 112 of Block 11 Tier 11 ( Less E. 50 ft.) and ( Less W. 50 ft of E. 150 ft.) Lot 42 Block G, Chappell s Subdivision. Thereupon the City Attorney was instructed to notify the owners of the aforesaid properties to make such repairs as are necessary to place these buildings in a safe condition, and to inform them that in the event of their failure to do so the City will condemn and remove said buildings. On motion duly adopted, the City Attorney was next authorized to employ Mrs W E Varn t assist with the foreclosure proceedings against the vacant lots in San Lanta 2nd . Secti and Magnolia Heights, at a salary of x$3.00 per day. Commissioner Higgins next introduced Resolution No. 577 and moved its passage and adoption. DAY OF APRIL , 1940. WHERLAS, on the 23rd. day of April , 1940 the City Commission of the City of Sanford, Florida,. adopted resolution No. 573 entitled, " A resolution of the City Commission of the City of Sanford, Florida, providing for the adjustment of certain delinquent taxes and /or special assessments against unimproved real property in the City of Sanford, Florid:: and, WHEREAS, the City Commission of the City is of the opinion that said resolution should be rescinded: NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford,Florida: That resolution No. 573 entitled: " A resolution of the City Commission of the City of Sanford, Florida, providing for the adjustment of certain delinquent taxes and/ or special assessments against unimproved real property in the City of Sanford, Florida," adopted by the City Commission on the 23rd. day of April , 1940, be and the same is hereby rescinded. WHEREAS, the City Commission of the pity of Sanford, Florida, pursuant to the provisions of Chapter Laws of Florida, Acts of 1939, has adjusted certain delinquent taxes and/ or special assessments against real property situate in the City of "anf ord, Florida, but there are many unimproved Lots, pieces and parcels of land in said City against which delinquent taxes and /or special assessments exist and are subject to adjustment, and which delinquent taxes and /or special assessments have not been adjusted, and such property is burdened with delinquent taxes and / or special assessments to such extent that it is not probable that such delinquent taxes and / or special assessments would be redeemed for the full amount thereof, within any reasonable time, and the City Commission deems it advisable , expedient, and for the best interests of said City that such delinquent taxes and /or special assessments be adjusted under the terms and provisions hereof: NOWITHEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that delinquent taxes and /or special assessments held by the City of Sanford, Florida, against unimproved real property in said City, which delinquent taxes and /or special assessments have been subject to adjustment, but have not been adjusted or paid as adjusted, shall until further order of the City Commission, be considered as having been adjusted in accordance with the following plan: 1. All taxes on said property prior to the year 1934 shall be canceled. 2. All taxes against said property subsequent to the year 1933, and to and including the year 1938, may be paid on the basis of the assessed valuation of said property for the year 1939. 3. That taxes for the year 1939 shall be paid at the time said adjusted taxes are paid. 4. That special assessments for street paving, sidewalks and bulkhead improvements may be paid for 5A of the principal amount of said special assessment. 5. That taxes and /or special assessments, as adjusted hereunder, shall be paid in cash. That said taxes and /or special assessments shall not be considered as having been ad- justed until paid in full in accordance with said adjustment as above set forth, and shall be paid in full as adjusted, prior to the institution of suit for foreclosure by the City of such delinquent taxes and /or special assessments, or before the right herein granted is rescinded. Be IT FURTHER RESOLVED that nothing herein contained shall prevent the City from in- stituting suit to foreclose any of said delinquent tax liens and / or special assessment liens at any time, if it desires, for the full amount of said taxes and /or special assess- ments, including interest and penalties. ( Seal) On motion duly carried, the Mayor, Commissioner Gut and Commissioner Higgins were next authorized to attend a meeting with the State Administrator of the Works Projects Adminis- tration at Jacksonville on July 10th.,with a view to expediting approval of the project application for construction of a hospital in Sanford, which is being sponsored by Seminole County. Application next received from F.L.Boyd for permit to remove the two story frame dwelling house located on Lot 12 Block 4 Tier 2 and construct thereon a concrete block office building and metal automobile shed ;-same being in the fire zone. After careful consideration, and on motion duly adopted, the aforesaid permit was authorized.
