1230401 1 1 �1 MINUTES CITY COMMISSION, SANFORD, FLORIDA, Dec. 30 at 7.30 P M 19 40 The City Commission of the City of Sanford, Florida, met in adjourned Session at the City Hall in the City of Sanford, at 7:30 o'clock P.M December 30,1940 Present: Commissioner Walter S. Coleman, Mayor. " Edward Higgins " M.J.Lodge " G.E.Rollins City Attorney Fred R.Wilson City Clerk H N Sayer Chief of Police R.G.Williams Absent: Commissioner H. James Gut. Meeting called to order by the Chairman. MI„ T.H.Scovell next appeared and requested the Commission to allow him to pave 3( e 04 01 3 the driveways at the automobile service station located at the southwest corner of French Avenue and Seminole Boulevard with mixed -in -place asphalt instead of concrete six inches in thickness as required by City Ordinance No. 291, also requested an extension of time for paving said driveways, claiming he had leased this property without being advised that the driveways would have to be paved before the station could be operated. Thereupon after careful consideration, Commissioner Higgins moved that Mr. Soovell be granted permit to pave the driveways at the aforesaid automobile service station with mixed- in -plaos asphalt , said paving to be constructed within six months. Seconded by Commissioner Lodge and carried. Application next received from the Sanford Atlantic National Bank and the Florida State Bank of Sanford to be designated as Depositories of the City of Sanford funds for the year 1941, agreeing to furnish satisfactory security in Federal,State, County or Municipal bonds to be approved both as to amount and validity by the City to protect said funds. Thereupon Commissioner Higgins moved that the Sanford Atlantic National dank and the Florida State Bank of Sanford be designated as Depositories of City of Sanford funds for the year 1941. Seconded by Commissioner Rollins and carried. Request next received from the Florida Power & Light Company for an easement to install an anchor guy on City owned property, described as follows: Beg 10 feet north of the southeast corner of the N.E. 1/4 of the N. E 1/4 of the S.Wl /4 of 8 W 1/4 of Sec. 7 Township 20 South, Range 31 East, and extend west approximately 150 feet. Thereupon Commissioner Rollins moved that the aforesaid easement be granted the Florida Power & Light Company and the Mayor and Clerk be authorized to execute same on behalf of the City. Seconded by Commissioner Lodge and carried. Application next received from Packer Corporation of Florida for permit to erect a three panel frame structure billboard on Block 1N Tier 9, located on the west side of French Avenue between Fulton Street and Water Street. Thereupon after careful consideration, Commissioner Higgins moved that a permit be granted Packer Corporation of Florida to erect a frame structure billboard at the aforesaid location, subject to the approval of the adjacent property owners and residents. Seconded by Commissioner Lodge and carried. 39,4 MINUTES CITY COMMISSION, SANFORD, FLORIDA, December 30 7: 30 P 110 40 The Clerk next reported that Seminole County had agreed to pay one -half of the salary of the caretaker of the Armory property in Sanford from November 25, 1940 to June 1 1941, which is in accordance with the City's agreement authorized at the meeting of October 28, 1940, to pay the balance of such salary, and the City's half of the salary of $75.00 per month from November 25th thru December 31, 1940 amounts to $45.00 Thereupon Commissioner Higgins moved that the Clerk be authorized to pay James W.Spivey, caretaker of the Armory property, the amount of $45.00 for the City's half of his salary from November 25th thru December 31, 1940. Seconded by Commissioner Lodge and carried. On motion of Commissioner Higgins, seconded by Commissioner Rollins and carried, Supt. Moughton was next instructed to demolish and remove the dilapidated building located on Lot 16 Block 3 of Bel Air Subdivision in accordance with Resolution No. 585 passed and adopted by the City Commission at the meeting of December 9, 1940. Commissioner P4ollins next introduced Resolution No. 586 and after being read in full by the Clerk , moved its passage and adoption. Seconded by Commissioner Lodge and carried by the following vote of the Commission: Commissioner Coleman Aye M Higgins Aye Lodge Aye " Rollins Aye said resolution No. 586 being in words and figures as follows: RESOLUTION No. 596 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, AUTHORIZING THE EXECUTION Of A QUITCLAIM DEED BY THE CITY OF SANFORD TO .SEidINOLE COUNTY, FLORIDA, OF THE LAND HERETOFORE CONVEYED BY SAID CITY TO SEMINOLE COUNTY , FLORIDA, FOR USE AS A HOSPITAL SITE, SAID QUIT -CLAIM DEED TO BE MADE TO RELEASE, SATISFY AND DISCHARGE THE REVERTER CLAUSE CONTAINED IN SAID DEED OF CONVEYANCE. WHEREAS, by deed of conveyance dated June 12, 1940, and of record in the Public Records of Seminole County, Florida, in Deed Book 95, Page 419, the City of Sanford, Florida conveyed to Seminole County, Florida, the following described lot, piece or parcel of land situate in Seminole County, Florida, to -wit: BEGINNING at the Northwest corner of the intersection of Mellonville Avenue and 2nd. Street or Union Avenue, in the City of t$anf ord, Florida, and run North along the west line of Mellonville Avenue to the South line of First Street in said City of Sanford, Florida; thence along the South line of said First Street to the West line of Block 11 of the Subdivision known as " Mellonville ", according to plat thereof of record in the Public Records of Seminole County, Florida, in Plat book 1, Page 120; thence south to the North line of said 2nd. Street or Union Avenue; thence East along the North Line of said 2nd . Street or Union Avenue to the point of BEGINNING. to be used as a site for a hospital to be erected by said Seminole County Florida, under y a Works Progress Administration project applied for by said Seminole County, Florida, which said deed contained a reverter clause providing that if said hospital was not erected upon said property under said Works Progress Administration project, title to said prop. arty is to revert to the City of Sanford, Florida; and WHERZA89 the Works Progress Administration will not proceed with the erection of said hospital unless said reverter clause contained in said deed of conveyance be released by the City of Sanford, Florida, and the City Commission of said City deem it expedient and for the best interest of the City of 6anford that said reverter clause be releas NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Lanford, Florida, that the Mayor and City Clerk of the City of Sanford be, and they are hereby authorized to execute and deliver to Seminole County, Florida, a quit -olaim deed of the above described property stating therein that the purpose thereof is to release, satisfy and discharge the 1 1 1 1 MINUTES CITY COMMISSION, SANFORD, FLORIDA 19 reverter clause contained in the aforesaid deed of oonteyance to Seminole County. BE IT FURTHER RESOLVED that upon delivery of said quit -olaim deed the County Commissioners of said Seminole County, Florida, be requested to adopt a resolution provid - ing that if the aforesaid hospital is not erected under said Works Progress Adminis- tration:project said Seminole County Florida, will reoonvey the aforesaid lot, piece or parcel of land to the City of Sanford, Florida. ( Seal) On motion of Commissioner Lodge, seconded by Commissioner Higgins and carried, the Commission next approved the acceptance from the Florida State Bank of Sanford, of Florida National Bank of Jacksonville Safekeeping Receipt No. 6456 covering 51,000.00 Seminole County, Florida 5J% RIB Refunding Series A bond No 156, in exchange for Florida National Bank of Jacksonville, Safe- keeping Receipt No ".6119 covering $1,000.00 City of Sanford 5% Water Plant Revenue Certificates, these securities being deposited to protect City of Sanford deposits in said bank. Reports of first, second and third fall analysis of milk being furnished by dairies operating.i n the City of 0anf ord, as prepared by Dr. J.L. Ruble's Laboratories of Orlando, next presented, such reports showing all such milk well with the require- ments of Grade "A" milk. Communication next read from Ed.C.Wright & Company of St.Petersburg, Florida, acknowledging receipt of the Cityls counter proposal authortr -6d at the meeting of December 17th., for refunding theblalswe of Sanford's unrefunded indebtedness, also advising that they would come to Sanford within the next few days to confer with the Commission in regard to the proposal. Communication next read from Simeon T.Sistrunk of Ocala, Attorney for Mrs E.H.Camp, with ref enenoe to the conditions that exist on her property located at southeast corner of Ninth Street and Poplar Ave. , claiming that the City has neglected to furnish proper facilities for drainage of this property and is liable for damages to the building that has been caused thru such negligence of the City. Said property being described as the Northeast quarter of Block 11 Tier 13, Sanford. Thereupon, in view of the fact that the City has adequate drainage facilities at this location to drain the aforesaid property owned by Mrs Camp, and the existing conditions on the property is caused by the ground level of this property being lower than the surrounding properties, the matter was referred to City Attorney Nilson. On motion duly carried, instructions were next issued City Attorney Wilson_ to institute foreclosure proceedings against Lot 27 of Robinson's Survey of an Addition; to Sanford; taxes on this property being delinquent for over two years. e 9 P ) 39G, MINUTES CITY COMMISSION, SANFORD, FLORIDA, Doc • 30 at 7 -: 30 P M 19 Chief of Police Williams next reported that several offenses of breaking and entering and house robbery have been committed in the residential sections during the past few weeks, and that he had employed three extra men temporarily in the Police Department at a salary of $2.50 per night each, in .an endeavor to apprehend the thieves. Thereupon on motion duly carried, the temporary employment of three extra men in the Police Department was approved. . Consideration next given to trading the 1934 Model Ford Sedan used by Inspector Duncan for a later model oar, in view of the fact that this. oar is warn to such an extent as to cost considerable amount for repairs to place it in good condition for further service. Thereupon after considerable discussion, instructions were issued to obtain bids from the local automobile dealers , for consideration at the next meeting. Minutes of regular meeting of November 25th., adjourned meetings of November 29th, and December 2nd. Special Meeting of December 4th. adjourned meeting of December 6th., regular meeting of December 9th., adjourned meeting of December 17th. and regular meeting of December 23rd. 1940 read' and approved.
