121238MINUSES CITY COMMISSION, SANFORD, FLORIDA, December 12 at 7; 30 P A 9_8_ 1603 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida at 7:30 o'clock P.M. Dec.- 12, 1938. Present: Commissioner Edward Higgins, Mayor. " Walter S. Coleman. " A.N.Lee City Attorney Fred R. Nilson City Clerk F.S. Lamson Chief of Police R. G. Williams Absent: Commissioner W.R.Dupree ( Excused on account of sickness.) " M.J.Lodge Meeting called to order by the Chairman. Minutes of regular meeting of the City Commission and meeting of the Municipal Delinquent Tax Adjustment Board of November 28th., and special meeting of the City Commission of December 7th. 1938, read and approved. Current invoices and payrolls for the month of November, 1938 properly audited and vouchered as evidenced by vouchers Nos 437 thru 533, submitted, examined, approved and payment authorized. Monthly reports of the Streets, Sanitation, Health, Water, Police, Fire and Library Departments for the month of November, 1938, submitted and examined. Financial Statement and statement of revenues and expenditures during the month of November, 1938, submitted and examined. Bank statements in all accounts for the month of November, 1938, properly reconciled, submitted and examined. Ir. R.A.Smith, President of the Sanford Tennis Club, next presented a proposed project for rebuilding the two tennis courts adjacent to the Municipal Water Pumping Plant and building an additional one at the same location, the labor to be furnished by the National Youth Administration, a Federal Agency, and the materials and equipment jointly by the City and the Sanford Tennis Club, the principal item of expense to the City in addition to the use of a tractor, roller and truck, being $828.00 for flood lighting equipment for night playing. Thereupon after careful consideration and on assurance of Mr. Smith that the entire upkeep, light bills and expenses of the tennis courts would be taken care of by the Sanford Tennis Club , $500.00 was authorized to apply on the cost of the flood lighting equipment. Ordinance No. 276, entitled: ` AN ORDINANCE REGULATING SALES OF USED MOTOR CARS BY NEW CAR AND USED CAR DEALERS, DEFINING THE TERMS " NEW CAR DEALER" " USED CAR DEALER," " USED CAR SALESMAN," " AND NEW CAR SALESMAN," PRESCRIBING A LICENSE TAX FOR NEW CAR DEALERS AND AGENCIES, AND USED CAR DEALERS, AGENCIES AND SALESMAN, AND FOR SALESMEN OR REPRESENTATIVES Cr AGENCIES OR DEALERS IN NEW AND USED MOTOR CARS WHICH AGENCIES OR DEALERS ARE NOT LICENSED BY THE CITY OF SANFORD) AND PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE. placed on its first reading at the meeting of the City Commission of November 28th. 1938, was next presented for further consideration and after considerable discussion, Section 3 which reads " Every used car dealer shall pay a license tax of Six Hundred 10611akd (4644 OOper year." was ordered changed so as to read " Every used car dealer shall pay a license tax of Three Hundred Dollars ( $300.00) per year." Thereupon Commissioner Coleman re— introduced Ordinance No. 276 entitled AN ORDINANCE REGULATING SALES OF USED MOTOR CARS BY NEW CAR AND USED CAR DEALERS, DEFINING THE TERMS " NEW CAR DEALER," " USED CAR DEALER," " USED CAR SALESMAN," AND NEW CAR SALESMAN," PRESCRIBING A LICENSE TAX FOR NEW CAR DEALERS AND AGENCIES, AND 1603 44 MINUTES CITY COMMISSION, SANFORD, FLORIDA, 19 USED CAR DEALERS, AGENCIES AND SALESMAN, AND FOR SALESMEN OR REPRESENTATIVES OF AGENCIES OR DEALERS IN'NEN AND USED MOTOR CARS WHICH AGENCIES OR DEALERS ARE NOT LICENSED BY THE CITY OFSANFORDi AND PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE. and same was placed on its first reading with the change in Section 3 as authorized above, and read in full by the Clerk. Thereupon Commissioner Coleman moved that the rules be waived and said Ordinance No. 276 be placed on its final passage and adoption. Seconded by Commissioner Lee Thereupon the question recurred upon the waivure of the rules. The roll was called and the vote stands as follows: Commissioner Higgins Aye " Coleman Aye " Lee Aye Thereupon the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 276 entitled: AN ORDINANCE,REGULATING SALES OF USED MOTOR CARS BY NEW CAR AND USED CAR DEALERS DEFINING THE TERMS " NEW CAR DEALER," " USED CAR DEALER," " USED CAR SALESMAN," AND " NEW CAR SALESMAN," PRESCRIBING A LICENSE TAX FOR NEW CAR DEALERS AND AGENCIES, AND USED CAR DEALERS, AGENCIES AND SALESMAN, AND FOR SALESMEN OR REPRESENTATIVES OF AGENCIES OR DEALERS IN NEW AND USED MOTOR CARS WHICH AGENCIES OR DEALERS ARE NOT LICENSED BY THE CITY OF SANFORD; AND PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE. On motion duly adopted, said Ordinance No. 276 was ordered POSTED at the front door of the City Hall in the City of Sanford, Florida, in accordance with the provisione of the Charter, as amended. Mr. S.D. Highleyman next appeared with further reference to his request for a lease to the City owned property fronting on Seminole Boulevard and lying between Cloud Branch and-the property of the Atlantic Coast Line Railroad Co., to be used as a combined automobile trailer and cabin camp and same was taken under further consideration. Mr. R.W. Lord next requested permission to sell Christmas trees during the Christmas season from the parkway on the East line of Palmetto Avenue north from First Street. Permission: granted provided adjoining property owners raise no objections. Petition next received from merchants and business men on Park Avenue between Commercial Street and Second Street that strings of colored lights similar to those now over First Street and Magnolia Avenue, be suspended over Park Avenue in these two blocks. Thereupon, after considerable discussion, Commissioner Coleman moved that four strings of colored lights be suspenced over Park Avenue in each of the two blocks covered by the petition.. Seconded by Commissioner Lee and carried. Mr M R Marshall next requested permit to erect gasoline service station at the northeast corner of Eleventh St. and Park Avenue. Request refused as being without the territory heretofore opened for business on Park Avenue. Consideration next given to agreement heretofore submitted by H H Coleman. Thereupon Commissioner Lee introduced Resolution No. 545, and after being read in full by the Clerk , moved its passage and adoption. Seconded by Commissioner Coleman and carried by the following vote of the Commission: Commissioner Higgins Aye If Coleman Aye If Lee Aye said Resolution No. 545 being in words and figures as follows: RESOLUTION- No. 545 APPROVING A STANDARD LARGE POWER AGREEMENT BETWEEN THE CITY OF SANFORD, FLORIDA, AND FLORIDA POWER & LIGHT COMPANY, PROVIDING FOR THE SUPPLYING BY THE COMPANY AND THE PURCHASING BY THE CITY OF ALL POWER AND ENERGY REQUIRED FOR AND IN CONNECTION WITH THE CITY'S CITY HALL AND POLICE STATION, AND SETTING OUT THE TERMS AND CONDITIONS UNDER WHICH THE FOREGOING SHALL BE EFFECTED; AUTHORIZING AND DIRECTING THE MAYOR AND THE CITY CLERK OF AND ON BEHALF OF THE CITY TO EXECUTE AND ENTER INTO THE SAID STANDARD LARGE POWER AGREEMENT WITH FLORIDA POWER & LIGHT COMPANY. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD , FLORIDA: 1. That the proposed Standard Large Power Agreement between the City and Florida Power & Light Company, set forth in form in Section 2 hereof, be and the same is hereby approved as to form and substance. 2. That the Mayor and the City Clerk of and on behalf of the City, be and they are hereby authorized and directed to enter into with Florida Power & Light Company the said proposed Standard Large Power Agreement approved in Section 1 hereof, and hereinafter set forth in form as follows: Standard Large Power Agreement. THIS AGREEMENT, made this day of 1935 by and between CITY Or SANFORD, FLORIDA, a municipal corporation.( hereinafter called the Consumer) and FLORIDA POWER & LIGHT COMPANY, a corporation organized and existing under the laws of the State of Florida ( Hereinafter called the Company.) WITNESSETH: THAT for and in consideration of the sum of One Dollar ( $1.00 )paid by each party hereto to the other, and of the covenants and agreements herein set forth, the parties hereto covenant and agree as follows: 1. That the Company shall supply and the Consumer shall receive and pay for all power and energy required for and in connection with the Consumer's City Hall and Police Station located onr'Noirth Park Avenue. Florida, in accordance with the terms and conditions of the Company's attached rate schedule #62 —A, marked Exhibit "A" and made a part hereof. 2. That the minimum quantity of power contracted for hereunder and to be received and paid for by the Consumer shall be 5000 Contract Watts. 3. That the point of delivery for the electric power and energy delivered here- under shall be on the Company's line used for supplying service hereunder at the pole thereof nearest to and not more than 100 feet from Consumer's premises used for and in connection with operations hereunder. 4. That the electric power and energy delivered hereunder shall be of the character commonly known as alternating current of approximated 115/230 volts and approximately sixty cycles 1 phase, and three wire, and shall be metered at 115/230 volts. 5. That the term of this Agreement shall be , for five ( 5 ) years from 1938• and shall extend for -a further period or periods of five ( 5) years from the terminative of the said period of five (5) years or any extension thereof, unless by written notice given by either party to the other not more than ninety ( 90) nor less than thirty(30) days before the date of termination of the said five ( 5) years or any extension thereof either party shall have signified its desire to terminate this Agreement. 7. That if, during the term of this Agreement, the Company makes effective any other rate schedule applicable to the class of service rendered hereunder, it will give the Consumer notice thereof within thirty ( 30 ) days thereafter and such schedule shall apply , at the consumer's option, to service rendered hereunder from the date of receipt by the Company of written notice of the Consumer's intention to exercise said option. 8. That it is mutually agreed , should the Consumer fail at any time or from time to time, to make payment as provided for herein for the power and energy furnished hereunder or otherwise fail to perform any of the terms and conditions of this Agreement, that the Company, at its option, may cease to supply power and energy to the Consumer hereunder, it being understood and agreed, however, that such discontinuance of the supply- ing of power and energy by the'Company shall not be a breach of this Agreement by the Company nor shall cancel any of the terms and conditions of this Agreement. 9. That this Agreement supersedes all previous agreements or representations, either written or verbal, heretofore in effect between the Company and the Consumer, made with respect to matters herein contained, and when duly executed, constitutes the Agreement between the parties hereto. 10. That this Agreement shall inure to the benefit of and be binding upon the respective heirs, legal representatives, successors and assigns of the parties hereto, but the Consumer shall not assign this Agreement without first having obtained the written consent of the Company. Coleman A.W.Lee "City of ,.$an4rd, Florida. 17 MINUTES CITY COMMISSION, SANFORD, FLORIDA, December :12 7:30 P M-19 39 Application next received from the Sanford Atlantic National Bank to be designated as depository of the City of Sanford funds during the year 1939, agreeing to furnish satisfactory security in Federal, State, County or Municipal bonds, to be approved both as to amount and validity by the City, to be deposited with the Federal Reserve Bank to the credit of the City, to protect said funds. Thereupon Commissioner Coleman moved that the. Sanf ord Atlantic National Bank be designated as a depository of City of Sanford funds during the year 1939 under the terms and conditions as outlined in said letter of application. Seconded by Commissioner Lee and carried. In accordance with the terms of Section -4.) of Ordinance No. 274, Commissioner Lee next moved that E.B.Randall, Jr. be appointed as the Master Eleetrici and D. C. Stafford as the Journeyman Electrician on the Board of Examiners of Electricians as provided by said ;Ordinance. Seconded by Commissioner Coleman and carried. Communication next read from the Sallie Harrison Chapter, Daughters of the American Revolution:, requesting a contribution towards the cost of a marker to be plat in Fort Mellon Park on Sanford Founder's Day, February S, 1939, and on motion of Commissioner Coleman, seconded by Commissioner Lee and carried $10.00 was authorized for this purpose. Bids next presented for 1 year subscriptions to 43 magazines for the Sanford Public Library, as follows: Mrs E.L.Morrow $115.00 Allan I. Moseley 100.00 Coleman's Office Equipment Company 59.70 Thereupon, on motion duly adopted, the lowest bid, that of Coleman'a Office Equipment Co. of $55.70 was ordered accepted. On motion duly adopted, the Commission next approved recommendation of the Chiefs of the Police and Fire Departments, that the bid of Yowell & Co. to furnish uniforms at $39.00 each, and that of W.E.Watson:at $39.75 each, be accepted, the business to be divided as follows: Yowell $ Co. to furnish uniforms for the Police Department and W.E.Watson to furnish the uniforms for the Fire Department. Also that 6 overcoats be purchased from W.E. Watson for the Police Department at $25.00 each. be purchased Also that 4 dozen shirts /for the Police Department from Yowell & Co. at a total cost of $96.14, and 2j dozen shirts for the Fire Department from W.E.Wat.son at a total . cost of $ 60.00. Consideration next given to the difficulty in obtaining quarters for the WPA Sewing Room, Mrs. Carrie Smith, the local supervisor, having advised that it would be necessary to pay a rental of $15.00 per month in order to remain in the present location at the N.W. corner of First St. and Park Ave., and requesting that theCity bear this expense. The Clerk then advised the Commission that the County had apeed to bear half of this expense. Thereupon Commissioner Coleman moved that the City pay $7.50 per month to apply on'the rental of the rooms used as a WPA Sewing Room. Seconded by Commissioner Lee and carried. On motion duly adopted $2.20 was next authorized to be refunded to J.A. Estridge for reconsideration of her request to remove two oak trees from the parkway at the N.W. corner of Seventh St and-Oak Ave., one on the Oak Avenue side and the other on the Seventh St. side, and after further oonsid— oration, permission was ;ranted to remove the tree on the Oak Avenue side of this property. Communication next read from the Meisch Realty Co. offering to sell to the iC04 City all of Block 5 Tier 12 ( Less R.R. R /W) and ( Less the W. 100 ft of the-E. 158.5 ft. Cif the N. 133.3 ft.) Lots 6,7 end 8 Block 1 Tier 6; all of Block 5 Tier 18; and all of Block 9 Tier 19 Seminole Park for tax and paving credit sufficient to cancel the taxes thru 1937 on the W. 100 ft of the E. 158.5 ft of N. 133.3 ft of Block 5 Tier 12, and the S. 23.3 ft. of Lot 7 all Lots 8, 9-and 10 , Block 2 Chapman & Tucker Addition, the State and County taxes on the property proposed to be _deeded to the City to be paid through the year 1938. Thereupon, after careful consideration particularly as to the value this prop- erty will be to the City, Commissioner Coleman moved that the offer of the Meisch Realty Co. be accepted. Seconded by Commissioner Lee and carried. City Attorney Wilson next reported that over 51 percent of the owners of City of Sanford refunding bonds had assented to the completion of the plan of composition of the City's bonded indebtedness as provided by Resolution No. 535, adopted on the 26th day of August 1938, this amount being neces$ary before a petition can be presented to the Court. Thereupon:Mr. Wilson was instructed to immediately proceed with the filing of the proper petition.. Consideration next given to the position of Special Sanitary Inspector, it being considered advisable to discontinue this position and combine the work with that of the Department of Inspection. Thereupon Commissioner Coleman moved that the position of Special Sanitary Inspector be abolished effective as of January 15, 1939. Seconded by Commissioner Lee and carrieinere being no further business the meeting then adjourned, after which the Board immediately re— convened as a Municipal Delinquent Tax Adjustment Board.
