123138MINUTES CITY COMMISSION, SANFORD, FLORIDA, December 31 at 4 -P M 19_38 The City Commission of the City of Sanford, Florida, met in Adjourned Session at the City Hall in the City of Sanford, Florida, at 4 o'clock P.M. December 31, 1939. Present: Commissioner Edward Higgins, Mayor. If Walter S. Coleman If A.W.Lee If M.J.Lodge City Attorney Fred R. Wilson City Clerk F. S Lamson Absent: Commissioner W.R.Dupree ( Excused on account of sickness.) Meeting called to order by the Chairman. Thereupon the Board resolved itself into a combined meeting of the City Commission- and meeting of the Municipal Delinquent Tax Adjustment Board. Commissioner Lodge next introduced Resolution No. 547 and after being read in full by the Clerk, moved its passage and adoption. Seconded by Commissioner Coleman and carried by the following vote of the Commission: Commissioner Higgins, Aye If Coleman Aye If Lee Aye If Lodge Aye said Resolution No. 547 being in words and figures as follows: RESOLUTION NO. 547. A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, PROVIDING FOR THE ADJUSTMENT OF CERTAIN DELINQUENT TAXES AND /OR SPECIAL ASSESSMENTS AGAINST UNIMPROVED REAL PROPERTY IN THE CITY OF SANFORD, FLORIDA. WHEREAS, the City Commission of the City of Sanford, Florida, pursuant to the provisions of Chapter 19,547, Laws of Florida, Acts of 1937, has adjusted certain delinquent taxes and /or special assessments against real property situate in the City of Sanford, Florida, but there are many unimproved lots, pieces and parcels of land in said City against which delinquent taxes and /or special assessments exist and are subject to adjustment, and which delinquent taxes and /or special assessments have not beenadjusted, and such property is burdened with delinquent taxes and /or special assessments to such extent that it is not probable that such delinquent taxes and /or special assessments would be redeemed for the full amount thereof within any reasonable time, and the City Commission deems it advisable, expedient, and for the best interests of said City that such delinquent taxes and /or special assessments be adjusted under the terms and provisions hereof; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA: That delinquent taxes and /or special assessments held by the City of Sanford, Florida, against unimproved real property in said City, and which delinquent taxes and /or special assessments are subject to adjustment, but have not been adjusted, shall, until further order of the City Commission, be considered as having been adjusted in accordancewith the plan of adjustment now in operation by said City, but the total amount due on said delinquent taxes and /or special assessments, as adjusted, shall be paid in full prior to the foreclosure by the City of such delinquent taxes and /or special assessments, or before the right herein granted is rescinded, provided, however, that such adjustment of delinquent taxes and /or special assessments shall not become effective until said delinquent taxes and /or special assessments are actually paid in full, and nothing herein contained shall prevent the City from instituting suit to foreclose any of said delinquent tax liens and /or special assessment liens at any time, if it desires, for the full amount of said delinquent taxes and /or special assessments, including interest and penalties. BE IT FURTHER RESOLVED that the City Tax Collectcrbe and she is hereby authorized to accept payment in full of said adjusted taxes and /or special-assessment liens, 451 MINUTES CITY COMMISSION, SANFORD, FLORIDA, December 31 at 4 P M. 19 38 #n accordance with this resolution until further order of the City Commission. If the delinquent taxes and /or special assessments hereby adjusted shall not be paid in full as adjusted by the time herein required, said adjustment shall be null and void, and said delinquent taxes and /or special assessments enf orcible for the entire amount thereof, including interest and penalties. BE IT FURTHER RESOLVED that the City Tax Collector be and she is hereby authorized to accept payment of said adjusted taxes and /or special assessment liens in full, in accordance with this resolution. Lamson City Clerk. to Ninety K, Request next presented from S.O.Shinholser to be granted an extension of sixty4days to pay the one - seventh of the taxes through 1937 and special assessments , as adjusted, as provided by Ordinance No. 275, provided the 1938 taxes are paid at once, against the following described properties: Lots 1 through 10 Block 1 Tier 10 ; W 1/2 of Lot 1 Block 4 Tier 6,; Lots 1,2,6 and 7 Block 16 Tier 5 and Lot 14 Keiley's Addition. ; Lots 4 & 5 Block 4 Tier 3. Request approved, 60 days grace being allowed for the payment of the one - seventh of such taxes and special assessments, as adjusted. Request next received from A.L.Rosier to be allowed to pay $25.00 at once, the balance of $26.22 due as initial payment under the 7 payment plan authorized by Ordinance No. 275, to be paid within thirty days, against Lot 13 Block K, Garners 2nd. Addition to Markham Park -"eights. Request approved. k-- Request next received from Charles Kanner to be allowed to pay $200.00 at once, the balance of $60.47 due as initial payment under the 7 payment plan authorized by Ordinance No. 275 to be paid within thirty days, against Lot 2 and N. 53.4 ft of Lot 3 Block 4 Chapman & Tucker's Addition. Request approved. Request next received from Edward Higgins to be allowed to pay $100.00 at once, the balance of $119.21 due as initial payment under the 7 payment plan authorized by Ordinance No. 275, to be paid within 60 days, against Lot 1 Block A Spurling's Addition, and Lots 6 and 7 Block 12 Tier 4 . Request approved. On motion duly adopted, the payment of $25.00 to each of the employees in the Clerk's office for extra - ordinary services in connection with the adjustment of taxes under the provisions of Ordinance No. 275, was next authorized and approved. In connection with the unsigned, unexchanged, Refunding Bonds, Series A and B, the Mayor and Clerk were next authorized end instructed to sign sufficient of. these bonds as will be required to refund unref unded bonds still outstanding,ha.ve same signed by the Clerk of the Circuit Court, and stored in a Safety Deposit Box at the Sanford Atlantic National Bank, access to such box to be then made only upon authorization of the City Commission and upon order signed by at least a majority of the City Commission. Instructions were next issued that the balance of the Refunding Bonds Series, A originally printed but no longer needed , be destroyed. The meeting then adjourned. Attest: City Clerk.
