01093952 MINUTES CITY COMMISSION, SANFORD, FLORIDA, January 9 at 7: 30 P M 19-39— The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 7 :30 o'clock P.M. January 9, 1939. Present: Commissioner Edward Higgins, Mayor. " Walter S. Coleman " H.James Gut " M.J.Lodge " G.E.Rollins City Attorney Fred R. Filson. City Clerk F. S Lamson Chief of Police R.G.Williams Meeting called to order by the Chairman. Minutes of regular annual meeting of January 3rd. and special called meeting of January 5th. 1939, read and approved. Current invoices and payrolls for the month of December, 1935 , properly audited and vouchered as evidenced by vouchers Nos. 534 thru 635, submitted, examined, approved and payment authorized. Monthly reports of the Streets, Sanitation, Health, Water, Police, Fire and Library Departments for the month of December, 1935, submitted and examined. Bank Statements in all accounts for the month of December , 1935 , properly reconciled, submitted and examined. Seconded by Commissioner Lodge and carried. received Request next from the Sanford Shuffleboard Club for the installation of sanitary conveniences adjacent to the shuffleboard courts at Second St. and Palmetto Avenue. Action deferred pending preparation of cost estimates by Supt. Moughton. A small delegation from the Sanford Business and Professional Men's Association next urged reconsideration of the request of W.L. Cooper to lease some City owned property on 1 1 1 1 MINUTES CITY COMMISSION, SANFORD, FLORIDA, Jan 9at7:30PM 1939 the Lake Shore to be used for a combined cabin and trailer camp, but no action was tkken Paul Biggers, Special Sanitary Officer, next requested that his employment in such capacity, heretofore ordered discontinued as of January 15, 1939 be continued until February let., 1939, and on motion of Commissioner Lodge, seconded by Commissioner Coleman and carried, request granted and so ordered. Bids next presented for lumber required to construct the bleachers for the Diamond Ball Park being financed by the City , as follows: United Lumber Company 285.29 Hill Lumber & Supply Yard 310.79 Security Lumber Company 315.00 Thereupon Commissioner Gut moved that the low bid, that of United Lumber Co. for $285.28, be accepted. Seconded by Commissioner Rollins and carried. Request next received from the heirs of W.B.Ballard for permit to tear down house located on Lot 9 Block S Tier E, against which there are unpaid City of Sanford taxes, and also one from James Dekle to tear down house on Lot 4 Block 24 Clark's Subdivision, also with unpaid City taxes against it. Both requests referred to Commissioner Gut for recommendation. Application next received from Richard Hoolihan and M.R Marshall for appointment to the position being vacated by Paul Biggers, but as this position is being discon- tinued, application ordered filed. Consideration next given to a lien held by 9.A.Speer against Lots S and 9 of Block C. First Street Extension, now a part of Fort Mellon Park, said lien being State & County Tax Certificate , sale of 1928, together with taxes for the years 1928, 1929 and 1930. Thereupon, in order to remove this lien against the part of Fort Mellon Park embraced 513 by these lots, Commissioner Coleman moved that the aforesaid State and County Tax Certificate together with the 1928,1929 and 1930 taxes, be redeemed. Seconded by Commissioner Rollins and carried. Further consideration next given to standard form of Agreement required by the Atlantic Coast Line Railroad Company under the terms of which the City is granted the right to lay and maintain a 21 inch concrete sewer ])ipe encased in concrete under their tracks at Elm Avenue and Commercial Street in place of the 21 inch terra cotta sewer pipe at the same location, this replacement being a part of a WPA sewer project now in process. Thereupon Commissioner Coleman introduced Resolution No. 549 and after being read in full by the Clerk, moved its passage and adoption. Seconded by Commissioner Gut and carried by the following vote of the Commission: Commissioner Higgins Aye if Coleman Aye If Gut Aye of Lodge Aye If Rollins Aye said Resolution No. 549 being in words and figures as follows: MINUTES CITY COMMISSION, SANFORD, FLORIDA, January 9 at 7 :30 P V9 39 _ RESOLUTION NO. 549. BE IT RESOLVED by the City Commissioners of the City of Sanford, Florida., in meeting assembled, that the Mayor- Commissioner be, and he hereby is, authorized to enter into an agreement with the Atlantic Coast Line Railroad Company, and to sign same on behalf of said City, whereby the said Railroad Company gives and grants unto the said City the right and privilege to lay and maintain, to the purpose of a sewer, a line of 21 -inch concrete pipe, encased in concrete, across the right -of -way and underneath the tracks of the Railroad Company at the intersection of Elm Avenue and Commercial Street in said City of Sanford, said line of pipe to be parallel with and 13 feet northeastwardly, measured at right angles, from the southwest line of Elm Avenue, if produced; as more particularly described in said agreement dated January 9th, 1939• BE IT FURTHER RESOLVED that this resolution shall become effective immediately upon its passage and adoption. Farrell protesting against the construction of a gasoline service station at the N.W. corner of Thirteenth St. and Park Ave., and same was ordered filed, as the permit for the construction of this station has already been given. Consideration next given to the condition of the City -owned clay pits opposite the Municipal Golf Course property, it appearing that much of this clay is being taken without permit or authority. Thereupon Commissioner Rollins moved that this property be fenced and " Posted." Seconded by Commissioner Coleman and carried. Fire Chief Cleveland next outlined the necessity for an automobile in connection with his duties as Fire Chief and requested that one be furnished the Department for that purpose.
