022739?2 MINUTES CITY COMMISSION, SANFORD, FLORIDA, rebruary 27 7!3Q R 139-39- The City Commission of the City of Sanford, Florida met in Regular Session at the City Hall in the City of Sanford, Florida, at 7:30 o'clock P.M. February 27, 1939. Present: Commissioner Edward Higgins, Mayor. " Walter S. Coleman " H* James Gut J " M..Lodge " G.E.Rolline City Attorney Fred R. Wilson City Clerk H N Sayer. Chief of Police R.G.Williams Meeting called to order by the Chairman. Mr. S D Highleyman then presented a petition from local merchants requesting the Commission to reconsider action taken in rescinding lease on City -owned property on the Lakefront for a trailer camp. 1ft0r.cckaeidextble discussion, the matter was taken under a 30 day advisement,and will be presented again for consideration at that time. A delegation from the local Sea Scout Troupe next appeared and requested permission to paint house numbers on the street curbs in the City. Thereupon, on motion duly carried, the Clerk was instructed to issue them a letter of authority for this work, provided they obtain the consent of residents before painting the numbers. Mr. J.N. Gillon next appeared with refernece to a fence being erected for pasturing a goat on the northeast corner of Twelfth street and Palmetto Avenue and requested the Commission to have this fence removed, it being very unsightly and not the required dis- tance from his property. Matter referred to Chief Williams and Inspector Paxton for investigation. Nathan Harris next registered further complaint against Herbert Reed for constructix a building too close.. to his property line, reporting that Reed had failed to comply with previous request of the Commission. Thereupon:, on motion duly adopted, Inspector Paxton was instructed to serve written notice on Herbert Reed to have this building moved to comply with building code within. thirty days. Application next received from Mrs Lydia TenEyck to purchase lots 25 and 26 of Block 3 Bel Air Subdivision at a price of $75.00 each, subject to any unpaid State and County Taxes, these lots having been acquired by the City through foreclosure of tax and street paving liens. This being the price of previous sales of lots in this section, same was approved. Application next received from Walter L Cooper to purchase lots 10, 12, 23, 24, 25 and 26 of Block S in this same subdivision. Thereupon, after careful consideration, the Commission authorized the sale to Mr Cooper of lots 10 and 12 at a price of $100.00 each, and lots 23, 242 25 and 26 at a price of $75.00 each, subject to any unpaid State and County taxes. Application next received from B.F.Whitner Jr. for permit to erect a galvanized sheet iron building in the Fire Limits on southwest cornerof Fulton St. and Laur6a Ave. Thereupon, after careful consideration and upon recommendation of Fire Chief e Cleveland, Inspector Paxton was authorized to issue a permit for a temporary building of this structure, with the proviso that this building be removed or re- constructed to comply with fire zoning code, upon the request of the City Commission. 1 1 [1 Ll MINUTES 73 CITY COMMISSION, SANFORD, FLORIDA, Feb. 27 at 7:30 P M 19 39 Estimate next presented for replacing electric service line from pole to City Hall building by using underground conduit at a price of $61.75, this line being necessary for furnishing service to engineering office. Thereupon, on motion duly carried, the Clerk was instructed to obtain price for an overhead service for comparison and have this line installed at the lowest cost. Consideration next given to liability and property damage insurance on the two street sweepers and one tractor mower owned by the City, this equipment not having been included in the Fleet Insurance Policy covering motor vehicles. Thereupon, after careful consideration, and on motion duly adopted, the Commission authorized that this equipment be insured and included in the Fleet Policy now in effect, and instructed the Clerk to secure license tags from the State Motor Vehicle Commissioner for same. Mr. 0 .P Herndon next appeared in behalf of the local lodge of the Woodmen of the World and requested permission to present a Bill for passage by the 1939 Session of the Legislature, cancelling all unpaid City taxes against Lot 5 Block 3 Tier 6,-Sanford, now owned by the lodge and on which a hall will be erected in the near future. Request approved. Engineer Williams next reported that sufficient brick was available for paving Fifth Street from Myrtle Avenue west to Elm Avenue, salvaged from the relaying of brick on Palmetto Avenue and also on the Oak Avenue project; advising that the original WPA project for paving Fifth Street was to be of a rock base, surface treated material to be furnished by the sponsor. Thereupon, in view of the fact that this would represent a saving of approximately $375.00 to the City, Commissioner Coleman moved that the brick be used for paving Fifth Street Seconded by Commissioner Rollins and carried. Mr. Williams next reported the need for five tons of asphalt paving filler and one car of sand for completing the repaving project of Oak Avenue and Sixth Street, and the paving of Fifth Street. needed. Thereupon, the Clerk was instructed to purchase this asphalt filler and sand as Commissioner Lodge next introduced Resolution No. 552 and moved its passage and adoption. A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, DETERMINING HOW CHECKS ON THE ACCOUNTS OF THE CITY IN THE CITY DEPOSITORY SHALL BE SIGNED. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA: That checks on the accounts of the City of Sanford, Florida., in the City depository, except checks in the petty cash, salary and meter deposit accounts, shall be signed by the City clerk and countersigned by the Mayor, and one City Commissioner, and checks on the petty cash, salary and meter deposit accounts shall be signed by the City Clerk, and checks not signed in accorance with this resolution shall not be honored. 74 MINUTES CITY COMMISSION, SANFORD, FL0RIDA,_._Jr1 rua 7: 30 192 BE IT FURTHER RESOLVED That a certified copy of this resolution be furnished to the Sanford Atlantic National Bank. WHEREAS, the City of Sanford, Florida, has rented Safe Deposit Box No 265 from the Sanford Atlantic National Bank, in which it has deposited for safe keeping certain Public Utility Bonds dated January 1, 1924, and certain Improvement Bonds, Series CC, dated June 1, 1926, issued by said City, and may deposit other records or property of the City therein, and has rented from Said Sanford Atlantic National Bank of Sanford, Florida, Safe Deposit Box No 1 77, in which it has deposited for safe keeping certain executed Refunding Bonds, Series A, and Refunding Bonds, Series B, dated March 1, 1937, and certain records in connection therewith, and may deposit other property or records of the City the in for safe keeping, and the City Commission of said City desires to determine how access on the part of the City to the contents of said Safe Deposit Boxes may be had: N0W THEREFORE, EE IT RESOLVED BY THE CITY COMMISSION CF THE CITY OF SANFORD,FLORIDA: THAT said Safe Deposit Boxes Nos. 265 and 177, rented by the City of Sanford, Florida, from the Sanford Atlantic National Bank of Sanford, Florida, shall be opened and access to the contents thereof had from time to time only upon authotization for such purpose by the City Commission of said City, and upon an order signed by a majority of the City Commission of said City. BE IT FURTHER RESOLVED that a certified copy of this resolution be furnished to said Sanford Atlantic National Bank of Sanford, Florida. ( Seal) 1 1 1 .I C 0 MINUTES 751 CITY COMMISSION,: SANFORD, FLORIDA, Feb. 27, 1939 at 7:30 P fla Communication next read from Miss Isabella Simon with reference to delinquent taxes against the S 112 of Lot 4 and N 2. ft of Lot 6 Block 3 Tier 1, requesting an extension of time for paying same. No action taken. Consideration next given to the need of repairs to grandstand at the Municipal Atletic Field. Thereupon, on motion duly carried, the expenditure of not to exceed $150.00 was authorized for this purpose, work to be under the supervision of Commissioner Gut and Supt. Moughton. City Attorney 'Nilson next reported on settlement of claim for damages of Mrs J.G. Waits against the City for injuries from a3legedssideiralktaccident on the west side of Maple Avenue between First and Second Streets, on date of December 16, 1938, advising that she would release the City of Sanford of this claim for the sum of $175.00. Thereupon, after careful consideration and on motion duly adopted, the Clerk was authorized to pay Mrs Waits the sum of $175.00 upon her signing release to the City of Sanford of all claims and damages resulting from said alleged accident. On motion duly adopted, the Commission next authorized the payment of $250.00 to City Attorney Wilson on account for services to complete ref un4ing of City's bonded indebtedness under the provision of the Wilcox Municipal Bankruptcy Act, as amended by the 1935 Congress. Consideration next given to further request from John Sahirard for an adjustment on water bill for month of January amounting to $17.12, and bill for month of February amounting to $6.05 , the excessive size of bills due to burst water pipe. Thereupon, after careful consideration, and in view of the policy the City has adopted in the past, no adjustment could be allowed on the bill of $17.12 but due to the intervening time from the discovery of this leak by the City until Mr. Schirard could be notified and have pipe repaired, the Commission authorized the adjustment of February bill to $2.00, his average monthly bill.
