032839o MINUTES CITY - COMMISSION, SANFORD, FLORIDA, March 28, at 7:30 &-19 -39 The City Commission of the City of Sanford, Florida, met in adjourned regular sessi at the City Hall in the City of Sanford, Florida, at 7:30 P.M. March 28, 1939• Present: Commissioner Edward Higgins, Mayor. " Walter S. Coleman " H. James Gut " M. J Lodge It G.E. Rollins City Attorney Fred R. Wilson City Clerk, H.N. Sayer Chief of Police R.G.Williams Meeting called to order by the Chairman. A committee ;f rom the American Legion, with George Weinstein as spokesman next outlined the activities of the Sons of American Legion Drum & Bugle Corps and requested som financial assistance toward expenses of Corps attending the State Convention at Fort Lauder dale on April 13th, 14th and 15th. 1939• Thereupon, after considerable discussion and in view of the benefits to accrue to the City through the publicity to be gained, Commissioner Coleman moved that $165.00 be donated towards expenses of sending this Corps to the State Convention,in Fort Lauderdale. Seconded by Commissioner Gut and carried. Request next received from the St. Johns River Line Company that the six -inch water main on Palmetto Ave. between Commercial St. and Seminole Blvd. be replaced with an eight inch,main so as to provide an adequate water supply for the Automatic Sprinkler System contemplatfd.beiiag installed in the dock building, advising that this six -inch main would not furnish sufficient water according to the insurance requirements. After considerable discussion and in view of the St. Johns River Line Co. being the only service on the aforesaid main, the Commission decided that the City would not be justified in bearing the expense of making this change but agreed to allow a credit for all usable six -inch pipe salvaged at the regular second hand value, provided the St,. Johns River Line Company replaced this water main at their own expense. Commissioner Gut next reported the need of repairs to the Fire Station building before having it painted. Thereupon, Supt. Moughton was instructed to obtain the cost of making the afore- said repairs, and also -the needed repairs to the library building. Application next received from C.W.Sullivan, proprietor of the Montezuma Hotel for permit to erect a sign on the parkway at the northeast corner of Park Ave. and Third Street. Request refused, due to this location not being in front of his property. The Clerk next presented WPA project proposal covering the paving of Fifth St. from Myrtle Ave. to Elm Ave. and the repaving and widening of Union Ave. from Sanford Ave. east 955 ft.; Palmetto Ave. from First St. to Co=iercial St.; Commercial St. from L. Park Ave. west to-Railroad; Railroad Ave. from Commercial St. to First St.;'Magnolia Ave. from Fifth St. to Tenth St. ; sixth St. from Oak Ave. west 131 ft.; Ninth St. from Park Ave. west to railroad; Tenth St. from Park Ave. east to Sanford Ave.; and Oblery Ave. from Locust Ave. east to Mellonville Ave.; the total cost of the project being $36,642.00 of which the City's share is X13,293.00. Thereupon Commissioner Coleman moved that the project be approved and the Mayor and Clerk be authorized to execute same on behalf of the City. Seconded by Commissioner Rollins and carried. Cook & Company, West Palm Beach, Florida, bond brokers, to be allowed to secure a copy of the last audit report of the City thru rentland, Gray & Moore, Certified Public Accountants. Request approved. Application from'Fred Sims next presented again for permit to sell beer and wines at 207 W. First St. a,1a.,i..on r.ezflmmendar iron mf Chief of Police, same was approved. On motion duly carried, the Clerk was next authorized and instructed to secure combination robbery insurance covering "Safe Burglary, Inside Hold -up and Outside Hold -up" up to $1,000.00 on the daily collections and transporation of funds of the City of Sanford at the City Hall, the cost of this insurance for one year being $35.00. On motion of Commissioner Gut, seconded by Commissioner Lodge and carried, the Commission next authorized a donation of $125.00 towards the purchase of a bus for the Seminole County Baseball Association. Consideration next given to redeeming 14/15 of Certificate #330 of 1925 State & County Taxes purchased by Frank Evans against the property around Lake Ada, this property having since been purchased by the City and now a part of the Water Utilittes, R9 said certificate being sale of June 7, 1926 and redeemable at a cost of 127.07. Thereupon Commissoner Coleman moved that the aforesaid State & County Tax Certificate be redeemed from Mr. Evans at a price of $27.07. Seconded by Commissioner Lodge and carried. Further consideration next given to request from the adjacent property owners in Rose Court Subdivision that the City furhish water for beautifying the park at inter- section of Grandview Ave. and Hibiscus Court. Thereupon, on motion duly adopted the Clerk was instructed to notify them that the City would repair the water pipe and furnish a meter for the aforesaid park, provided they pay for the water used. On motion duly carried, the Commission next authorized the execution of the lease of*the Municipal Athletic Field for one year to the Seminole County Baseball Association dated February 1, 1939. Request next received from Dr. A C Kirk that the 1935 Personal Tax of $9.00 assessed against his office equipment be cancelled, having been employed by the County while in Sanford and this equipment not used for private practice. Thereupon, after careful consideration and in view of the fact that tOis equipment was used entirely for charitable purposes for both county and city patients, Commissioner Coleman moved that the 1935 Personal Tax assessed against Dr. Kirk in the amount of $9.00 be canceled. Seconded by Commissioner Lodge and carried. Request next received from Scott- Carraway, Inc. for an adjustment of the 1939 Personal Tax assessment against stock and fixtures on a $1600.00 valuation, claiming this assessed valuation being far in excess of actual inventory of Jan 1,1935 which was $725.00 Thereupon, after careful consideration and on comparing this assessment with assessed valuations on other merchants in same business, the Commission authorized this assessment adjusted to $725.00. On motion of Commissioner Gut, seconded by Commissioner Coleman and carried the Commission next authorized the payment of $25.00 to Engineer Fred T. Williams for services rendered in making sounds and preparing blue - prints of Lake Front property in connection with City's endeavor to locate an industrial site for the Merry Bros.Brick & Tile Company. Thereupon after considerable discussion and view of the efficient services rendered from the recent installation of a Transmitter for the night patrol car, Commissioner Lodge moved that Chief of Police Williams be authorized to purchase a Two -way Mobile Radio Transmitter from the R.C.A. Manufacturing Company at a price of $425.00 Seconded by Commissioner Coleman and carried. Commissioner Lodge next introduced Ordinance No. 280 entitled: AN ORDINANCE REGULATING SALES COMMONLY KNOWN AS " RUMMAGE SALES" IN THE CITY OF SANFORD FLORIDA, AND IMPOSING A LICENSE TAX FOR THE CONDUCT THEREOF,AND PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE. and same was placed upon its first reading and read in full by,1the Clerk. Thereupon Commissioner Lodge moved that the rules be waived and said Ordinance No.280 be placed upon its final passage and adoption. Seconded by Commissioner Gut. Thereupon the question recurred upon the waivure of the rules. On motion duly adopted, Ordinance No. 281 was then ordered PUBLISHED in the Sanford '92 MINUTES CITY COMMISSION, SANFORD, FLORIDA, March 29 at 7: 30 P M 1 9_39 In accordance with agreement with W.D.Bradford authorized at meeting of July 29th. 1939, covering the obtaining of assents to the completion of the plan of refunding of the City's bonds, the Clerk was next authorized and instructed to pay Mr. Bradford $250.00, representing final amount due upon obtaining 66-2/3 percent of such assents and $30.29 for expenses in connection therewith since Jan 1, 1939• Request next received from members of the First Baptist Church that a bench be placed in front of their church on Park Ave. and same was granted. Instructions were next issued to the Clerk to notify R.J.Palmer, local agent for the Sinclair Refining Company to have the driveways on the southeast corner of French Ave, and Seventh St. concreted to comply with the regulations of tthe City and inspector Paxton was instructed to investigate all other driveways that are not constructed in compliance with the ordinance regulating same. 0n motion duly adopted, the Commission next authorized the Dater Utility Depart- went to place in effect as of April lst, and to extend through the month of September, the same rate for homes, lodges and churches as was in effect during the summer of 1938, to wit: .15 per thousand gallons for all water consumed in excess of $2.50 per mon as calculated at the present rates. Request next received from Mrs Eva Minatik to be allowed to pay the street paving assessment on the adjusted basis against Lot 5 Block 15 Tier 4, amounting to $12.29, all taxes being paid in full. Request approved. Request next received from Charles B. Tyler to be allowed to pay delinquent taxes for the years 1927 thru 1937 and special assessments on the adjusted basis, against Lots 18 and 19 Wellington's addition, amounting to $372.77. Request approved. v Request next received from F.L.Miller to be allowed to pay delinquent taxes for the years 1929 thru 1937 on the adjusted basis, against the E. 112 of Lot 10 Block 4 Tier 6, amounting to $296.28. Request approved. Request-next received from Roy Tillie to be allowed to pay delinquent taxes for the years 1931 thru 1934 on the adjusted basis, against Lot 3 Block 5 Tier 7, amounting to $67.75, all subsequent taxes being paid in full. Request approved. At this time further consideration was given to the request of S.D.Highleyman presented at meeting of Feb. 27, 1939 for reconsideration of previous action taken in rescinding lease of City -owned property on the Lake Front for a trailer camp. No action taken. Communication next read from Mr. Hal Wight requesting the cancellation of the 1938 tax assessment against Lots 3,4,7 & 8 Block 2 Tier 4, E R Traff ord's Map of Sanford, due to title being vested in the Spanish - American War Veterans Local Camp on January 1 1938, but now owned by him. Thereupon after careful consideration and on advice of City Attorney Wilson that this was a just assessment and the taxes collectable, request refused and Clerk instructed to notify Mr. Night to that effect. S. 104.2 ft to Beg. of Block 2 Tier 2, E R.Trafford's Asap of Sanford, and Lot 4 and N 1. ft of Lot 5 Block 3 Tier 1, E R Trafford's Map of Sanford, taxes on the properties being tax delinquent for over two years. On motion duly carried, instructions were next issued to advertise notice of intention to present Bill for passage by the 1939 Session of the Legislature as follows: To enlarge, re- define and declare the corporate boundaries of the City of Sanford, Florida, and preserving the lien of said City upon real and personal property for unpaid taxes and special assessments heretofore levied and assessed by said City thereon and declaring the jurisdiction and powers of said City over the territory within the boundaries thereof as so defined and declared to be as defined by Chapter 9597, Laws of Florida, Acts of 1923, and Acts amendatory thereof and supplemental thereto.
