04103999 MINUTES CITY COMMISSION, SANFORD, FLORIDA, April 10, 7 :30 P M 19--j9 The City Commission of the City of Sanford, Florida, met in Regular Session at the City Hall in the City of Sanford, Florida, at 7:30 o'Clock P.M. Williams Absent: Commissioner M. J. Lodge. Meeting called to order by the Chairman. Minutes of adjourned regular meeting of March 28, 1939, read end approved. Current invoices and payrolls for month of March 1939, properly audited and vouchered as evidenced by vouchers Nos. 849 thru 942, submitted, examined, approved and payment authorized. Monthly reports of Streets, Sanitation, Health, Water, Police, Fire and Library Departments.for the month of March 1939, submitted and examined. Financial statement and statement of revenues and expenditures during the month of March 1939, submitted and examined. Bank Statements in all accounts for the month of March 1939, properly reconciled submitted and examined. Mr. E.V.Turner , local manager of the Southern Bell Telephone Company next appeared and requested permission to trim several trees on Sanford Avenue that are interfering with the telephone lines. Request approved. On motion of Commissioner Coleman , seconded by Commissioner Rollins and carried, the Commission next approved the purchase from Ed. C.Wright4 Company of Refunding Bonds Series "A" , Numbers 3272, 3273,3274,327523441, 3442, 3443 ,3444,3445,3446,3447,3448,34490 3450, and 3451 with coupons due Sept 1, 1939 and subsequent attached, at a price of $270.00 per bond and accrued interest. The Clerk next presented letter from Cohu Brothers & Georgeson, New York City, submitting quotation of 26 -7/8 plus accrued interest on 13 Refunding Series "A" Bonds. Thereupon, in view of the fact that sufficient funds are on hand for the purpose, and on motion duly carried, the Clerk was authorized to communicate with Cohu Brothers & Georgeson and have the aforesaid Refunding Series "A" bonds forwarded to the Sanford Atlantic National Bank for purchase by the City at the price of 26 -7/8 plus accrued interest. Communication next read from S.D.Highleyman requesting payment of an enclosed bill of Engineer Fred T. Williams in the amount of $21.92, for surveying the proposed trailer camp on the Lakefront. Action deferred. Request from Hill Lumber & Supply Yard Inc. for payment of a bill in the amount of $132.94, and from W.J.King for a bill in the amount of $20.00 next presented, both bills covering materials and supplies furnished the Sanford Baseball Association 1 I 1 1 1 I� 1 MINUTES 9.5 CITY COMMISSION, SANFORD, FLORIDA, Apr 10; 1939- 7:30-19-39 for repairs to the Municipal Athletic Field while leased and operated by H.M.Watson. Thereupon, in view of the fact that the aforesaid bills were not itemized, and the purchases were made by the lessee of the Municipal Athletic Field, the Clerk was instructed to obtain itemized statements for verification by Supt. Moughton, and present at next meeting for further consideration. Petition next teceived from members of the Shiloh Missionary Baptist Church that all business houses in Goldsboro be closed on the Sabbath Day, same was referred to Chief of Police Williams Consideration was next given to increasing the Group Life Insurance on City employees from 4500.00 to $1,000.00 each. Thereupon, in view of the fact that no funds were appropriated in this year's budget for an increase in this insurance, action deferred until next fiscal year. Communication next read from The Sanford Insurors Exchange quoting the fleet rates for fire and theft insurance and comprehensive coverages, and the insurable values of the City —owned motor vehicles. Thereupon, after careful consideration, Commissioner Rollins moved that the trucks, street sweepers, fire trucks and motorcycle be insured against fire and theft and the passenger cars be insured for comprehensive coverages, and that this insurance be placed with The Sanford Insurors Exchange for one year at a total cost of $86.22 Seconded by Commissioner Coleman and carried. Commissioner Gut next introduced Resolution No. 555 and after being read in full by the Clerk, moved its passage and adoption. Seconded by Commissioner Rollins and carried by the following vote of the Commission: Commissioner Higgins Aye Coleman Aye Gut Aye " Rollins Aye Said Resolution No. 555 being in words and figures as follows: RESOLUTION NO. 555 • A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, IN REGARD TO THE CONSERVATION OF THE WATER SUPPLY OF THE STATE. WHEREAS many of the existing methods of artesian water consumption and development are wasteful and inefficient; and WHEREAS the above is substantiated by data collected by the Florida Geological Survey and the United States Geological Survey; and WHEREAS these data show beyond any doubt whatever that continued use of present wasteful methods of consumption and development will result in irreparable damage to large areas of the State; and WHEREAS the quality of the water in some areas is becoming such as to menace the health of many people using this water from both municipal and home water supplies; and WHEREAS the quantity and quality of the artesian waters is becoming such as to result in great damage to the agricultural and industrial interests of the State; and WHEREAS the Florida Academy of Sciences, having recognized that a serious artesian water problem exists, has appointed a committee which has carefully studied that problem; THEREFORE 96 MINUTES CITY COMMISSION, SANFORD, FLORIDA, April 10 at 7:,30_ P19 39 BE IT RESOLVED that the legislators are urged to give special consideration to this very pressing statewide problem; and BE IT FURTHER RESOLVED that the Legislature is urged to pass control measures which will ensure the prolonged usefulness of the artesian waters of the State; and BE IT FURTHER RESOLVED that a copy of this resolution be placed in the hands of the Honorable H.J. Lehman and John G. Leonardy, Representatives from Seminole County, Florida, in the legislature of the State of Florida, and Honorable J.J. Parrish, Senator of the Thirty - seventh Senatorial District of the State of Florida. BE IT FURTHER RESOLVED that this resolution shall become effective immediately upon its passage and adoption. As the City Commission of the City of Sanford, Florida. The Clerk next reported that Herbert Reed had failed to comply with the orders of the City Commission of Feb. 27th. 1939, to have the building that was erected on the prop- erty line of Nathan Harris moved within 30 days. Thereupon, on motion duly adopted, instructions were issued to the City Attorney and Chief of Police to take such legal action as necessary against Herbert Reed to have this building moved. co Consideration next given to changing the parking lines on the streets in the business sections, it appearing that the present markings are causing some confusion in the parking of cars. Thereupon on motion duly carried, Supt. Moughton was instructed to extend the present parking lines about three feet farther out in the streets. The Chairman next read a copy of Resolution adopted by the Seminole County Bar Association on March 30, 1939 , disapproving and condemning and their intention to prevent the passage thereof by the 1939 Legislature, the proposed Bill to amend Section 7 of Chapter 9897, Laws of Florida, Acts of 1923, and to provide for the imposition of fines to the maximum amount of $500.00 and imprisonment for the maximum sentence of six months. Chief of Police Williams then presented a. list of Florida cities having charter provisions for penalties similar to those in the proposed amendment. Thereupon after considerable discussion, and in view of the fact that this imposi- tion of penalties would not be establishing a precedent for Florida cities, instructions were issued that the Seminole County Bar Association be advised that the Commission would seek the passage of this Bill. Supt. Moughton next submitted estimates of the necessary repairs to public buildings as follows: Labor and material for outside repairs to Library Building 120.00 30 Window Shades, assorted sizes for Library building 46.65 Labor and material for painting Fire Station building 350.00 Labor and material for repairs to City Hall building 5 5 1 1 I 1 1 1 J In I' MINUTES CITY COMMISSION, SANFORD, FLORIDA, April 10 at 7:30 P M 1 g 39 Thereupon after careful consideration, Commissioner Coleman moved that an expenditure of $566.65 be authorized for the aforesaid repairs to public buildings. Seconded by Commissioner Gut and carried. Application next received from Mrs. A E Mallem to sell beer and wines at 317 E. First St. and on recommendation of Chief of Police Williams same was approved. Application next received from Mrs J 3 Elliott to purchase lots 21 thru 25 of Block 13 , Bel Air Subdivision, this property having been adquired by the City thru foreclosure of City tax and street paving liens. Thereupon, after careful consideration and on.motion duly adopted, the Commission authorized the sale to Mrs Elliott of the aforesaid lots in Bel —Air Subdivision at a price of $60.00 each. The Clerk was next instructed to again notify R.J.Pa.lmer, agent for the Sinclair Refining Co., to have the driveways on the southeast corner of French Ave. and Seventh 97 St. repaired immediately, he having failed to comply with the recent orders of the Commission to have this work done. City Attorney Wilson next reported on the claims filed by Creditors for hearing on the Petition in Bankruptcy filed by the City to complete the refunding of its bonded indebtedness, and requested authority to consult with Attorney Robert J. Pleas, Orlando, on this matter, and same was approved. Request next received from N.J. Duggar to be allowed to pay delinquent taxes for the years 1931/34 & 1937, under the adjusted basis, against Lot 3 Block 12 Tier 6, amounting to $100.25. Request approved. Request next received from Harvey Vieno to be allowed to pay delinquent taxes for years 1931 thru 1938 under the adjusted basis, against the N. 112 of Lot 22 Block B, South Sanford, amounting to $171.42. Request approved. Request next received from R.L. White to be allowed to pay the paving assessment under the adjusted basis without paying the delinquent taxes for the years 1935 thru 1938 against: Beg. 95 ft N. of S.W.Cor of Blk 3 Tr. 12, Run E. 100 ft N. 41.2 ft W. 50 ft. N. CD 17 ft. W. 50 ft S. 58.2 ft to Beg. Request refused , as delinquent taxes must be paid also in order to allow adjustment on paving assessment. On motion duly adopted, Tax Collector Ellen Hoy was next instructed to hold the 1938 Tax Sale on the first Monday in July , 1939• The Clerk next reported that several requests had been made by those paying delinquent taxes under authority of Ordinance No. 269 ( 7 instalment plan), that an extension of time be allowed for payment of the second instalment and current taxes due April 1, 1939. Thereupon, after careful consideration and on motion duly adopted, the Commission authorized an extension of 90 days for the payment of the seond instalment and current taxes, due and payable under the provisions of Ordinance No. 269.
