0825391 L- C 1 n MINUTES CITY COMMISSION, SANFORD, FLORIDA, August 25 at 7 :30 P M 19 39 The City Commission of the City of Sanford, Florida, met in adjourned session at the City Hall in the City of Sanford, Florida at 7:30 o'clock P.M. August 25, 1939• Present: Commissioner Edward Higgins, Mayor. " Walter S. Coleman " H. James Gut " M.J.Lodge " G E Rollins City Attorney Fred R. Wilson: City Clerk H.N.Sayer. 147 Meeting called to order by the Chairman. City Attorney Wilson then presented lease prepared in accordance with instructions at the regular meeting of August 14th. of the E. 53.42 ft of the property bordering on: Lkke Monroe and embracing the concrete retaining wall along said lake, lying immediately west of the St. Johns River Line Company's dock, together with all riparian rights, to the St. Johns River Line Company. At this time the Chairman and City Attorney reported that Erskine W. Landis owner of certain property in Lake View Park Subdivision, had communicated with them by telephone and registered a protest against the City leasing this property, claiming that it will prevent the sale of his property to the St. Johns River Line Company. Thereupon, after considerable discussion and due to the fact that there is an alley between the property owned by Mr Landis and the St. Johns River Line Company's property which would prevent an addition adjacent to on the east of the existing dock building, Commissioner Gut moved that the lease be approved and the Mayor and Clerk be authorized to execute same on behalf of the City. Seconded by Commissioner Lodge and carried. Thereupon said lease was ordered spread on the minutes of this meeting when executed as follows: THIS INDENTURE OF LEASE Made and entered into in duplicate as and of the 31st. day of August, 1939, between CITY OF SANF ORD, FLORIDA, a municipal corporation, hereinafter called "Lessor" and ST JOHN'S RIVER LINE COMPANY, a corporation organized and existing under the Laws of the State of Florida with its principal place of business at Jacksonville, Florida, hereinafter called " Lessee ", WITNESSETH: That the said Lessor for and in consideration of the rentals to be paid and covenants to be performed by the Lessee as hereinafter set forth has leased and let 64d by these presents does lease and let unto the Lessee those certain premises situate in Seminole County, Florida, and described as follows, to— wit::: Beginning 76 feet west of the East line of Palmetto Avenue and 613 & 2/10 feet north of the South line of Commercial Street according to E.R.Trafford's Map of the Town of Sanford, Florida ( said point being on the southerl edge of a concrete retaining wall along the South Shore of Lake Monroe thence run north 69 degrees 17 minutes West 53 & 42/100 feet, thence run Northeasterly 140 & 1 /10 feet to a point 149 & 94/100 feet north of point of beginning, thence South to point of BEGINNING. TO HAVE AND TO HOLD the above described premises unto the Lessee for and during the term of twenty years from the 31st. day of August , 1939, subject to the terms and conditions hereinafter stated. The Lessee covenants and agrees to pay unto the Lessor as annual rental for the aforesaid premises the sum of $44.00 per year payable in advance, the first year's rental having been paid upon the execution and delivery of this lease, receipt of which is herehy acknowledged and to pay the remaining rentals on or before the 31st. day of August of each year during the term hereof, and does further covenant and agree as part of the consideration 14R MINUTES CITY COMMISSION, SANFORD, FLORIDA, August 25 at 7 :30 P M- 19 for making of this lease, to pay before they become delinquent all impositions upon the aforesaid premises and improvements thereon for State and County purposes during the term hereof. The Lessee further covenants and agrees as a part of the consideration for the making of this lease as follows: 1. That Lessee will erect and complete within six months from the date hereof upon the aforesaid land and premises a ware -house and dock extending from the aforesaid concrete retaining wall over the waters of Lake Monroe and adjoining the ware -house and dock of the Lessee now on its property immediately East of the above described land and premises, and according to specifications to be approved by the Lessor. In the event the Lessee is unable to procure from the United States War Department a permit to build said ware -house and codk it may surrender this lease and said premises without further liability on its part. 2. That all improvements erected on the aforesaid premises and the aforesaid ware -house and dock shall be assessible by the Lessor or its successors as personal property, and at the end of the term hereof said ware -house and dock including piling hereunder shall be immediately and completely removed by the Lessee, its successors or assigns at its or their expense. 3. That Lessee will promptly pay the rental aforesaid when and as the same bec due and payable and will also pay before they become delinquent all impositions for State and County purposes against the aforesaid premises and improvements thereon. 4. That Lessee will make no unlawful or offensive use of said premises, and that all improvements upon the above premises shall be used exclusively for facilities for water transportation. Lessor. 5. That Lessee will not assign this lease without the written consent of the 6. That Lessee will keep the aforesaid dock and warehouse to be erected as afore. said insured to its full insurable value against all risk of damage or destruction by fire or windstorm with loss payable to the Lessor, but in the event of damage or loss by fire or windstorm the proceeds of said insurance shall be used to repair or restore such dock or warehouse as the case may be. 7. That Lessee will keep and maintain all improvements made upon said premises including the aforesaid dock and warehouse in a state of good and sound repair during the term hereof. S. That Lessee will surrender the aforesaid premises to the Lessor and remove the improvements therefrom as required by Paragraph 2 above at the end of the term hereof. 9. That default for a period of thirty days in the payment of any of the of ores annual rentals or in the payment before they become delinquent or impositions for State and County purposes as hereinbef ore required or in keeping the aforesaid dock and ware -house isured as aforesaid or in the performance of any of the other covenants by the Lessee herein contained, shall cause this lease immediately to become null and void and of no effect and the Lessee shall surrender the said premises to the Lessor without the necessity for the Lessor to resort to process of law for the recovery of possession thereof, and immediately remove at its own expense said wareouse and dock and piling. 10. '( SEAL) Communication next read from the Central Hanover Bank & Trust Company, New York, advising that they can secure the names and addresses of the holders of the Refunding Series "A" and "B" bonds dated March 1, 1937, by returning upon the first presentation, for paygtent, all coupons No. 5 due September 1, 1939 from the aforesaid bonds, together with notice and ownership certificates advising the bondholders that sufficient funds are on deposit in the bank for payment of the coupons when the ownership certificates are properly executed and returned with the coupons, also, stating that the Bank's fee for this service would not exceed $100.00. Thereupon, after careful consideration and upon the opinion of the City Attorney that this information will probably be needed in the endeavor to complete the refunding of the City's bonded indebtedness under the provisions of the Municipal Bankruptcy Act, Commissioner Coleman moved that the Clerk be authorized and instructed to have the neces- sary notice and ownership certificates printed and forward to the Central Hanover Bank & Trust Company, with instructions to said bank to secure the names and addresses of the holders of the Refunding Series "A" and "B" Bonds dated Mar 1, 1937 in accordance with the procedure outlined above. Seconded by Commissioner Gut and carried. The Clerk next presented the following request for cancellation of personal taxes with sworn affidavits for the reason as follows: Tracey D McCuller Year: Amount :Sworn Affidavit for reason 1937 X__15.00 1935 15.00 Disabled War Veteran with 25% dis- ability allowance since 1931. Thereupon after careful consideration, Commissioner Coleman moved that these sworn affidavits be accepted and that the personal property taxes as listed above be canceled, due to errors in assessing. Seconded by Commissioner Lodge and carried. Application next received from Harold J. Powers for position as Deputy Tax Collector, Thereupon, after a careful examination and study of the application, Commissioner Coleman moved that it be accepted, and that Harold J. Powers be employed as Deputy Tax Collector at a salary of $100.00 per month and $15.00 per month for car expenses, effective September 1, 1939, or as soon thereafter as he is available. Seconded by Commissioner Lodge and carried. The Clerk -was next instructed to notify Mr. Ernest Krupp now employed as Deputy Tax Collector, that due to the above action, his services will no longer be required after a period of Thirty Days.
