0413361 1 1 M I N U T E S CITY COMMISSION , SANFORD, FLORIDA -- APRIL 13, 1936 ,7 :30 P.M. MINUTES OF REGULAR MEETING OF CITY COMMISSION APRIL 13, 1936. THE CITY COMMISSION of the City of Sanford, Florida, met in Regular Session at the City Hall in the City of Sanford, Florida at 7 :30 O'Clock P.M. April 13, 1936. Present: Commissioner S.O.Shinholser, Mayor. " W.R.Dupree " W.A. Leffler " P.N.Whitehurst City Attorney Fred R.Wilson- City Clerk F.S.La.msoa. Chief of Police A.G.Williams Meeting called to order by the Chairman. Minutes of Regular Meeting of March 23rd. 1936, read and approved. Current invoices and payrolls for the month of March 1936, properly audited and vouchered as evidenced by vouchers Nos. 7704 through 77$2, submitted, examined, approved and payment ordered. Monthly reports of the streets , sanitation, health, water, police, fire, and library departments for the month of March 1936, submitted and examined. Financial statement and statement of revenues and expenditures during the month of March 1936 submitted and examined. Bank statements in all accounts, properly reconciled, submitted and examined. Consideration next given to matter of need for a new f ence around the Municipal Athletic Field, it appearing that the present fence has deteriorated to such an extent as to require extensive repairs if the field is to be used.During the discussion, it was brought out that the present Field is muc# larger than is necessary and that considerable saving could be effected by constructing the fence the regulation distances from home plate. Thereupon Commissioner Whitehurst moved that the reconstruction of the fence as outlined be authorized, using salvaged lumber from the old fence wherever possible, at an estimated cost of $150.00 Seconded by Commissioner Leffler and carried. Communication next read from WPA Engineer Earl advising that Mr. F.A.Dyson had been ruled ineligible to act as Superintendent of the WPA Street Paving Projects, 0 even though paid by the City as authorized by the City Commission under date of March 23rd. The Clerk then advised that in accordance with the foregoing ruling, Mr Dyson had been laid off after two days work. Another communication next read from Engineer.Earl requesting -the advice as to whether the City would furnish the cement needed to continue the construction of concrete gutters on the West First Street Paving Project from French Avenue West to Mill Cieek, this work requiring approximately 500 sacks. After careful consideration and in view of the fact that the construction of con- orete gutters on this project will result in the salvaging of sufficient brick to com- plete the paving of the French Avenue entrance to the Lake Shore Boulevard, Commissioner Whitehurst moved that the City f urhish the cement necessary for this work. Seconded by Commissioner Dupree and carried. Applications next received from Geo. W.Gray, at 215 E. First St. and W. George at 121 W. First St. for permit to sell beer and wine, and on recommendation.of the Chief of Police, same were approved. 5 Q CITY COMMISSION MIND TES SANF ORD, FLORIDA - APRIL 13, 7:30 P M. 1936. Communication.next read from Mrs Rosamond Chapman, Head Teacher at the WPA White Nursery School, requesting a further appropriation to cover water used by this school, and on motion duly carried, an additional $20.00 was ordered appropriated for this purpose. Resolution and letter agreement, prepared by the Florida Power & Light Co., covering discontinuance of three white way lights, one at the southwest corner of Park Avenue and Second Street, one at the Southeast corner of Sanford Ave. and Eleventh St. and one on the east side -of Sanford Ave -at the S & E crossing of the A.C.L.R.R. and the placing in service in lieu of these lights of three lights recently installed on the south side of Seminole Boulevard between Park Ave. and Myrtle Ave. next presented. Action deferred, the Clerk being instructed to request the Florida Power & Light Co. to handle all such changes in street lights during each year on memorandum, all such changes to be confirmed at the end of the year by one resolution. The Clerk next advised the Commission that the $100.00 appropriated for use by the Salvation Army in furnishing beds and meals for indigent transients had been expended. Thereupon Commissioner Whitehurst moved that an additional $50.00 be appropriated for this purpose. Seconded by Commissioner Dupree and carried. Commissioner Whitehurst next introduced Resolution No. 485 and moved its passage and adoption. Seconded by Commissioner Dupree and carried by the following vote of the Commission:: Commissioner Shinholser Aye " Dupree Aye " Leffler Not voting " W#itehurst Aye said resolution being in words and figures as follows: RESOLUTION N0. 485. A RESOLUTION AMENDING RESOLUTION NO 483 ADOPTED BY THE CITY COMMISSION OF THE CITY OF SANFORD$ FLORIDA ON THE 27th DAY OF JANUARY 1936, ENTITLED AS FOLLOWS: " A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, RESOLVING ITSELF INTO A MUNICIPAL DELINQUENT TAX ADJUSTMENT BOARD UNDER CHAPTER 17,405 LAWS OF FLORIDA, ACTS OF 1935." WHEREAS, Resolution No. 483, adopted January 27, 1936, and entitled as follows" RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, RESOLVING ITSELF INTO A MUNICIPAL DELINQUENT TAX ADJUSTMENT BOARD UNDER CHAPTER 17,405, LAWS OF FLORIDA ACTS OF 1935," did not provide for the adjustment of special assessments due the City of Sanford, Florida, as authorized by Chapter 17,405, Laws of Florida, Acts of 1935, and the City Commission of said City deems it expedient and proper to adjust special assessments as well as delinquent taxes due said City: NOW,THEREFORE, BE IT RESOLVED That said Resolution No. 483, adopted January 27, 1936, be and the same is hereby amended so as to read as follows: WHEREAS, The City of Sanford, Florida, has delinquent taxes due it at this time of approximately $7662953.38 and delinquent special assessments in a large amount, and much of the jr operty against which such delinquent taxes and special assessments exist is burdened to such an extent with delinquent taxes and special assessments that the redemptiom thereof within any reasonable time is not probable, and the City Commission. deems it advisable, expedient and for the best interest of the City for the City Commission C 1 1 1 1 1 C 1 M I N U T E S CITY COMMISSION , SANF ORD, FLORIDA - APRIL 13, at 7:30 P M. 1936. to resolve itself into a MUNICIPAL DELINQUENT TAX ADJUSTMENT BOARD, as provided by Chapter 17,405, Laws of Florida, Acts of 1935: NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida: That said City Commission does hereby resolve itself into a MUNICIPAL DELINQUENT TAX ADJUSTMENT BOARD under Chapter 17,405 , laws of Florida, Acts. of 1935, for the purpose of adjusting delinquent taxes for 1933 and prior years and special assessments due said City upon any property within the City upon principles of fairness to the City and the property owners. BE IT FURTHER RESOLVED that said MUNICIPAL DELINQUENT TAX ADJUSTMENT BOARD Shall meet immediately following the regular meetings of the City Commission at the Council Chambers in the City Hall on the second and fourth Mondays of each month, for a period of twblve months, for the purpose of receiving and considering applications for adjust- ment of taxes and special assessments due said City, as provided by said Chapter 17,405. BE IT FURTHER RESOLVED that all applications for tax and special assessment adjust- ments hereunder shall be in writing upon forms furnished by the City Clerk for that purpose and filed with said City Clerk for presentation by him to said Board for its consideration. BE IT FURTHER RESOLVED that the City Clerk stall advertise in a newspaper published in the City of Sanford, Florida, that a MUNICIPAL DELINQUENT TAX ADJUSTMENT BOARD has been created and the times and places that meetings will be held for theerpurpose of considering applications in writing for the adjustment of taxes and special assessments. BE IT FURTHER RESOLVED THAT this Resolution shall become effective immediately upon: its passage and adoption. Passed and adopted this 13th day of April 1936. Attest: F S Lamson City Clerk. Leffler As the City Commission of the City of Sanford, Florida. • Communication next read from Central Truck Lines Inc. by J.F.Smalley, Treasurer, advis_. ing that the cancellation of the lease of the River Valley Line, Inc. for the City dock at the foot of Myrtle Avenue, meets with the approval of this Company, backer of said River Valley Line. Thereupon said lease was ordered canceled. Considerable discussion next given to disposition to be made of said dock, especially in view of its dilapidated condition. Thereupon instructions were issued to Supt. Moughton to demolish and remove said dock, together with piling and barge as soon as possible. On motion duly carried, the Commission next authorized acceptance of $75.00 and suspension of the balance of the sentence against Tom Scott, Case No. 21540, sentenced in the Municipal Court under date of Nov. 13, 1935, to a total of $125.00 or serve 210 days; also suspension of balance of sentence of Ben Johnson , Case No 22015, dentenced in the municipal court under date of Feb. 3, 1936, to a total of $150.00 or serve 140 days. The Commission next discussed the advisability of an Advisary Committee of Citizens 7. M I N U T E S CITY COMMISSION - SANFORD FLORIDA APRIL 13, 7:30 P M 1936. being appointed to promote interest in the beautification of the cemetery lots, after which the Mayor was authorized to appoint such a committee. The meeting then adjourned to immediately re- convene as a Municipal Delinquent Tax Adjustment Board, which then adjourned to meet again at 7:30 O'Clock P.M. April 24, 1936.
