The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 7:30 o'clock P. M., April 27th, 1936• Present: Commissioner S. O.Shinholser, Mayor, " W• R• Dupree " M. J. Lodge " P. N.Whitehurst City Attorney Fred R, Wilson City -Clerk F. S. Lamson Chief of Police R• G* Williams Absent: Commissioner W.A. Leffler Meeting called to order by the Chairman. Minutes of adjourned meetings of the Municipal Delinquent Tax Adjustment Board of March 24th and April 3rd; regular meeting of the City Commission of April 13th, and Special Meeting of the City Commission of April 15th, 1936, read and approved. L. F. Boyle, Commander of the Campbell Lossing Post, American Legion, next presented request that the—baseball diamond on the Park at 9th Street and French Ave. be placed in con- dition for use by the newly organized League sponsored by the American Legion, and same was referred to Supt. Moughton for attention. Committee from the Sanford Golf Club, comprising Otto Caldwell, Charles Dunn and A.C.Fort, next presented the needs of the Municipal Golf Course, the particular needs being some fertili- zer and a new motor and tank for the water system in the club house. Thereupon, after careful consideration and in view of the deteriorated condition of and immediate need for replacement of the motor and tank for the water system in the club house, Commissioner Dupree moved that the. offer obtained by Mr. Fort from the Sanford Machine Co. to furnish new motor and tank for $90.00 plus the salvage from the old plant, this:amount.to be applied on taxes, be accepted. Seconded by Commissioner Lodge and carried. Action on the request for fertilizer then deferred for further consideration. J. W. Knowles (colored) next requested quit claim deed to Lot'I Blk C, DeForrest's Additi due to the fact that this property, formerly owned by the City and included in the Sheriff's levy and sale to satisfy judgment of Augustus T. Ashton, had been erroneously advertised and sold to him as Lot One instead of Lot I (Eye). Matter referred to City Attorney Wilson for investigation. Mr. W. D. Hofmann, local radio dealer, next registered protest to the proposed licensing of Sound Trucks and same was taken under consideration. The Clerk next reported the receipt from the Bondholders Protective Committee of interest coupons and receipts for accrued interest on past due bonds, delivered to the City in accordance with agreement and based upon the following schedules. M., -19_36. Applications next received from A. E. Mallem, at 317 E. 1st St., Ai Menendez, at 1016 Orange Ave., and Ben Thomas, at 1121 W. 13th St., for permit to sell beer and wines, and on motion of Commissioner Dupree, seconded by Commissioner Lodge and carried, same were approved. City Attorney Wilson next reported alternative writ of mandamus secured by the Bond- holders Protective Committee requiring the payment of $11,990.00 from profits of the Department of Water Utility for the following past due Water Bond interest coupons: PUBLIC UTILITY BONDS, dated January 1, 1924. 31 Coupons Numbered 20, evidencing interest on bonds Nos. 345/375, both numbers inclusive. 276 coupons numbered 21, evidencing interest on bonds Nos. 1/12, 76/150, 153/185, 196/286,326/330, all numbers inclusive. i IMPROVEMENT BONDS SERIES "CC ", dated July 1, 192 . 129 Coupons Numbered 15, evidencin interest onbonds Nos. 124 128, 133/150, 160/171, 173/182, 184/214, 238/262, 288294, 304/315, 317/325, all numbers inclusive. Thereupon in view of the fact that all net profits of the Wate Utility Department have been appropriated to the payment of principal and interest on Water Bonds, Commissioner Whitehurst moved that the terms of the writ of mandamus be complied with and the Clerk be authorized to make payment immediately upon presentation of the aforesaid coupons. Seconded by Commissioner Dupree and carried. In order to remove a cloud from the title to Lots 8 & 9 Block 11 Tier 3, evidenced by old street paving liens of record in the public records of Orange County, Florida, but not shown on the City's books as being open and unpaid, Commissioner Whitehurst next introduced Resolution No- 486 and moved its passage and adoption. BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that that certain street paving lien for One Hundred and Twenty Dollars and Eight Cents ($120.08), dated March 10, 1910, and of record in the public records of Orange County, Florida, in Lien Book "K", Page 11 and against Lot 8, Block 11, Tier 3 of the City of Sanford, Florida for vitrified brick paving by the City of Sanford, Florida, and that certain street paving lien for Ninety -three Dollars and Seventy -five Cents ($93.75), dated March 10, 1910, and of record in the public records of Orange County, Florida, in Lien Book "K ", Page 11 and against Lot 9 of Block 11, Tier 3 of the City of Sanford,Florida, for vitrified brick paving, said street liens being in favor of the City of Sanford, Florida, be and the same are hereby canceled,- s4tisfied, released and discharged. First Street from in front of Lot 8 Blk Y St.Gertrude's Addition, due to the roots interfering with the drain tile and consequent proper drainage of the adjoining farm land. is MINUTES CITY COMMISSION, SANFORD, FLORIDA, April 27th, 7:30-P. M. , 19--3-6. Permit granted, it appearing in addition that the ornamental features of these trees had been destroyed through the necessity to out off the tops in order to allow passage of high tension electric wires. Request next received from A. Constantine for permit to erect fruit and vegetable stand on the SW corner of French Avenue and State Road No. 3 ( Semin6le: Boulevard) on property owned by Victor Check, it being specified that this structure will be located 42 feet West of French Avenue and 42 feet South of Seminole Boulevard in order not to restrict the view and thereby create a traffic hazard at the intersection. Thereupon the question arose as to the establishment of a building line on the South side J of Seminole Boulevard West of French Avenue. After careful consideration Commissioner Whitehurst moved that the building line along the South side of Seminole Boulevard, West of French Avenue, be placed at 12 feet South of the property line. Seconded by Commissioner Lodge and carried. Thereupon the permit as requested by A• Constantine was approved, subject to the foregoing action of the Commission. Request next received from Mr. M.T•Anderson for permit to demolish concrete building on the rear of Lot 10 Blk 12 Tr 6, and on recommendation of Building Inspector Paxton, due to the delapidated condition of this building, request approved. The Clerk next reported the following amounts on hand applicable to bond creditors: For Keefe, et al $7,286.00 For Onited Mutual Life Insurance Co. $ 120.00 Thereupon, on motion duly adopted, payment of same was authorized. 0n motion of Commissioner Dupree, seconded byCommissioner Lodge and carried, payment of $50.00 to the Seminole County Welfare Board for welfare work during the month April, 1936, was next authorized. Fire Chief Cleveland next advised the Commission of the Southeastern Fire Chief's Con- vention and School of Instruction to be held in Atlanta, Ga., on May 4th to 8th, 1936, and requested permission to attention. Thereupon Commissioner Whitehurst moved that Fire Chief Cleveland be authorized to attend this Convention and School of Instruction, the expenses,.estimated at $35.00, to be borne by City. Seconded by Commissioner Dupree and carried. The meeting then adjourned, to immediately re- convene as a.
