051136MINUTES 21 CITY COMMISSION, SANFORD, FLORIDA, May 11 at 7:30 P M 19 -36 The City Commission of the City of Sanford, Florida, met in Regular Session at the City Hall in the City of Sanford, Florida at 7:30 O'Clock P.M. May 11, 1936. Present: Commissioner S.O.Shinholser, Mayor. " W.A.Leffler " M.J.Lodge. M P.N.Whitehurst City Attorney F.R.Wilson City Clerk F.S.Lamson. Chief of Police R .G.Williams Absent: Commissioner W.R.Dupree. Meeting called to order by the Chairman. Minutes of adjourned meeting of the Municipal Delinquent Tax Adjustment Board held April 24th, and regular meeting of the City Commission of April 27th. 1936 read and approved. Current invoices and payrolls for the month of April 1936, properly audited and vouches- ed as evidenced by vouchers Nos 7783 through 7856, submitted, examined, approved and payment ordered. j Monthly reports of the Streets, Sanitation, Health, Water, Police , Fire and Library Departments for the month of April 1936, submitted and examined. Financial Statement and statement of revenues and expenditures during the month of April 1936,.oubmitted and examined. Bank Statements in all accounts, properly reconciled, submitted and examined. Communication next read from Municipal Judge Wilkinson recommending suspension of bal- ance of sentence of A.E.Griffith, sentenced in the Municipal Court under date of April 6th, to a fine of $200.00 or serve 60 days in jail for operating a motor vehicle while under the in- fluence of intoxicating liquor, the recommendation being made in order that Mr. Griffith may provide for his family who are destitute and in want. Thereupon Commissioner Leffler moved that the matter be referred to the Mayor for such handling as he thinks proper. Seconded by Commissioner Whitehurst and carried. Mr. Fred T.Williams, representing the Spanish American War Veterans, next presented request that additional lots in Evergree Municipal Cemetery be set aside f`or'war veterans, Lot 27 Section G set aside for this purpose under date of May 25, 1925 being deemed insufficient Thereupon, after careful consideration, Commissioner Leffler moved that Lots 21/26 and 28/32 of Section G of Evergreen Municipal Cemetery be set aside for war veterans. Seconded by Commissioner Lodge and carried. Marvin H Smith next appeared with further reference to his offer to lease the Municipal Airport as embodied in communication read at the regular meeting of April 23h. After careful consideration, matter referred to committee of local aviation enthAsiasts comprising R.B.Wight as Chairman, Volie Williams, George Deetch, and R.J.Reel, for investigation and recommendation. Request next received from members of the Church ofGod for overhead street light at the intersection of Holly Ave. and Fifth St., and same was taken under consideration. At the request of W.H.Sohmidt, Commissioner Whitehurst next moved that Mr. Schmidt be granted permit to locate truck on the West side of Magnolia Ave. at First St. on Wednesday Evening May 13th for public speaking purposes; to transport the benches from -the Ball Park at his own expense, to be used at this meeting , and that the Chief of_Police be authorized 22 MINUTES CITY COMMISSION, SANFORD, FLORIDA, May 11 at 7:30 P M 19 36 to block off Magnolia Avenue between First St. and Second St. at that time, if necessary. Seconded by Commissioner Lodge and carried. In accordance with informal agreement reached between the Commission and George A. DeCottes, as Attorney for Augustus T.Ashton, holder of Judgment against the City forcertain past due bonds and interest thereon, Commissioner Leffler next moved the payment of $3754.69 from the "bond purchase fund" to apply on this judgment, said amount representing one -half the balance due together with interest to April 29, 1936, computed in accordance with the following schedule, it being understood and agreed that the.City will pay the balance within six months after April 29th with interest on the deferred payment: Judgment rendered April 153, 1932, amount 17P996-35 Interest at 6% to April 19 1935, date of first Sheriff's sale) (Hotel Mayfair) 21,191.2 Credit net amount first Sheriff's sale 252.20 Balance of judgment with interest to April 12 1935 20 239.34 Interest on balance of principal of judgment of $17,043.45, from April lat., 1935 to June 3, 1935 1 9. 6 7-30 Credit net amount of second levy ( sale of foreclosed property) 13,120.44 Total balance of judgment with interest figured to June 3, 1935 7 296.96 Interest on balance of principal of judgment of $2,923.01 from June 3, 1935 to April 29, 1936 2 Total balance of judgment with interest figured to April 29, 1936 7,509.36 Seconded by Commissioner Whitehurst and carried. Commissioner Leffler then moved payment of $43.79 to Sheriff J.,F. McClelland, representing costs on the foregoing payment on the Ashton judgment. Seconded by Commissioner Whitehurst and carried. Request next received from H C DuBose, Agent for permit to demolish building on the east half of Lots 1 and 2 of Block 5 Tier 9 , and on motion of Commissioner Whitehurst, seconded by Commissioner Lodge and carried, same was approved, it appearing that this building is dilapidated to such an extent as to,be a nuisance and a fire hazard. Application next received for permit to erect a gasoline service station.oA Lot 6 Block 12 Tier S. located at the southeast corner of Tenth St. and French Ave.; also application for permit to erect gasoline service station on Lots 3 and 4 of Block 4 Tier 9, located on the West side of French Ave. between Second and Third Streets. Both applications referred to City Planning Commission. Communication signed by twelve property owners living within two blocks of the north- east corner of Ninth St. and Laurel Ave., protesting against the issuance of a permit to the Rev. W.S.Queen for the construction of a church at this location, next read and referred to the City Planning Commission for recommendation. Communication next read from the Florida Power & Light Co. advising that-the request that all changes in street lights during each year be handled on memorandum, such changes to be confirmed at the end of the year by one resolution, cannot be acceded to. Thereupon the Clerk was instructed to handle further with a view to obtaining this much desired result. Consideration next given to the matter of three bonds Series A -1 Nos 546, 547, and 549, owned by J.S.Todd & Co, it appearing that these bonds had been originally stolen from W.S.Dickey Clay Mfg. Co. and subsequently acquired by Todd & Co, as an innocent purchaser. 1 i U 1 1 MINUTES CITY C.OMMISMON, SANFORD, FLORIDA, May 11 at 7 :30 P M 19_ 36 Thereupon, after being advised by City Attorney Wilson that proper notice had been served on W.S.Diokey Clay Mfg. Co., Commissioner Leffler moved that the offer of Todd & Co. to sell these bonds at the price paid, to -wit: 15 flat , be accepted. Seconded by Commissioner Whitehurst and carried. Consideration next given to the matter of reconstruction of the driveway of the Atlantic Refining Co on Park Ave. at Third St., it appearing that this driveway was built to the grade of Park Avenue existing at that time but that the widening of Park Avenue now leaves this driveway approximately six inches above grade at the curb line. Thereupon in view of the fact that this driveway was constructed to grades furnished by the City and the present difference in grade is through no fault of the property owner, instructions were issued that the cement needed to reconstruct the driveway to conform to present grades be furnished by the City, the necessary labor being furnished through the WPA. Report next read from Fire Chief Cleveland upon his attendance at the South Eastern Fire Chief's Convention and Georgia State Fire School at Atlanta Ga., the total cost being W.OS Thereupon the report was accepted and the $9.09 difference between the estimated cost of $35.00 and the actual cost was ordered paid by the City. The.,Clerk next presented standard form of agteement required by the Works Progress Administration of the Federal Government in all cases where lighting equipment is installed at airports by the said Works Progress Administration, said agreement referring to the Sanford Municipal Airport and being in words and figures as follows: A G R E E M E N T Date' W I T H Director of Aviation Florida State Road Department Tallahassee,_Florida. Night lighting equipment on airports improperly or irregularly operated constitutes a dangerous hazard to night flying, often endangering the lives of pilots and passengers, who rely on thbir operation for navigation and landing during the hours of darkness. Therefore the undersigned officials hereby agree that the City of Sanford will, upon completion of the installation of this equipment, operate and maintain said lighting equipment in a safe and satisfactory manner, in compliance with such regulations, as are now in effect or may in the futUme be promulgated by the Aviation Division, Florida State Road Department or the U.S.Bureau of Air Commerce. It is further agreed that any or all of the above mentioned lighting equipment may be removed from the above mentioned airport by the Aviation Division of the Florida State Road Department after thirty (30) days notice delivered in writing to the Mayor 24 MINUTES CITY COMMISSION, SANFORD, FLORIDA, May 11 at 7 :30 P M —19-36 of the City of Sanford, should this city or its designated representatives -fail to maintain and operate said equipment in such a manner as-will safely and efficiently serve the purpose for which it was installed. As the City Commigsion of the City of Sanford, Florida. Thereupon, in view of the fact that this agreement is a standard form, required by the Government in all such cases before the lighting equipment will be installed, Commissioner Whitehurst moved that it be approved and executed. Seconded by Commissioner Lodge and carried. Request next received from D.L.Ha.rper for permission to pay the 1934 and 1935 taxes against Lot 2 Normany Square without being required to pay at the same time the taxes for 1933 and prior. Thereupon in view of the fact that such action will not affect the City's lien -tjas evidenced by the 1933 and prior taxes, Commissioner Whitehurst moved that the Tax Collector be authorized to accept the 193+ and 1935 taxes against Lot 2 Normany Square without requiring the payment of the prior year's taxes at the same time. Seconded by Commissioner Leffler and carried. On motion duly carried, the Commission next approved the following suspensions of sentence, recommended by theChief of Police: Cleve Alexander, Case No 22057, sentenced in the Municipal Court under date of Feb. 17, 1936, to a fine of $50.00 or serve 100 days. Served 10 days and paid $25.00. Balance to be suspended. Rosa Bolar, case No 22065. Sentenced in the Municipal Court under date of Feb. 17, 1936, to a fine of 50.00 or serve 50 days. Served part time and paid $35.00. Balance to be suspended. Willie Hail, Case No 22171, sentenced in the Municipal Court under date of March 23, 1936 to a fine of $15.00 or serve 50 days. Served 13 days and paid $10.00 . Balance to be suspended. A J Boyd, Case No 21653. Sentenced in the Municipal Court under date of Sept. 3, 1935 to a fine of $10.00 or serve 30 days. Released on order of Commission to pay. Paid $5.00 , balance to be suspended. Thereupon Engineer Fred T.Williams was requested to prepare a schedule of worth while projects for consideration by the Commission. In connection with the efforts being made to obtain a PNA grant and loan from the Federal Government to be used in repairing and making needed additions to the Fernald Laughton Memorial Hospital, Commissioner Whitehurst next offered Resolution No. 4-97 and moved its passage and adoption. mission: Seconded by Commissioner Leffler and carried by the following vote of the Com- Commissioner Shinholser Aye N Leffler Aye a Lodge Aye N Whitehurst Aye said resolution No. 497 being in words and figures as follows: RESOLUTION NO. 4970 A RESOLUTION AUTHORIZING THE APPLICATION FOR A LOAN AND GRANT FROM THE PUBLIC WORKS ADMINISTRATION TO BE USED IN IMPROVING THE PRESENT PACILITIES AND MAKING ADDITIONS TO THE FERNALD LAUGHTON MEMORIAL HOSPITAL. WHEREAS, the present facilities of the Fernald Laughton Memorial Hospital are totally inadequate to properly care for the present available patronage of this hospital, and, WHEREAS, this lack of facilities will become more and more acute as the population of theCity and County increases, and WHEREAS, the financial condition of the City of Sanford is such as to make it impossible to provide the necessary improvements and additions to the Fernald Laughton Mem- orial Hospital, the lack of which creates a serious handicap, and WHEREAS, according to estimates prepared by Architect E.J.Moughton, the cost of such needed improvements and additions will be $36,217.90. NOW ,THEREFORE BE IT RESOLVED, that application be made to the PUBLIC WORKS ADMINISTRATION of the FEDERAL GOVERNMENT for a loan and grant in accordance with the regulations of said PUBLIC WORKS ADMINISTRATION sufficient to make the necessary repairs and additions to the facilities of said Fernald Laughton Memorial Hospital as outlined in the plans and specifications as prepared by architect E.J.Moughton. BE IT FURTHER RESOLVED by this Commission that the City of Sanford shall always stani ready and willing and recognize same as a moral obligation of the greatest importance to meet the expense of such charity cases as have been handled in the past. BE IT FURTHER RESOLVED that the Mayor and City Clerk be and they are hereby authorized to execute any and all necessary papers in connection with said application.
