030837WKIM MINUTES CITY COMMISSION, SANFORD, FLORIDA, March ..8 at 7:30 P M 19_33 The City Commission of the City of Sanford, Florida met in regular sessiom at the City Hall in the City of Sanford, Florida, at 7:30 O'Clock P.M. March 8, 1937. Present: Commissioner Edward Higgins, Mayor. If W.A.Leffler, . If M.J.Lodge City Attorney Fred R. Wilson City Clerk F.S. Lamson Chief of Police R.G.Williams Absent: Commissioner W. R. Dupree ( who appeared later) Commissioner P.N.Whitehurst. Meeting called to order by the Chairman. Current invoices and payrolls for the month of February 1937, properly audited and vouchered as evidenced by vouchers nos., 8577 through 8647, submitted, examined, approved and payment ordered. Monthly reports of the streets, sanitation, health, water , police, fire and library departments for the month of February, 1937, submitted and examined. Bank statements in all accounts for the month of February, 1937, properly reconciled, submitted and examined. Financial statement and statement of revenues and expenditures during the month of February 1937, submitted and examined. Mr. B.E.Purcell of the Purcell Company next appeared with reference to a purported unpaid account of some City employee and was advised to furnish the City Clerk with full information for presentation to the City Commission at the next regular meeting. Communication next read from City Commissioner P.N.Whitehurst submitting his resignation as a City Commissioner of the City of Sanford, Florida., as follows: Adel, Georgia. February 22, 1937. Dear Mr. Higgins: — It is with the keenest regret that I tender you herewith my resignation as a member of your honorable body of City Commissioners. This action has been made necessary because of my recent employment by the Sowega Melon Growers Association as Secretary — Manager, which will of necessity require my full time here. It has been a pleasure indeed to have had the honor and privilege of working with you and other members of the City Commission during these past several months. With kindest personal regards to each of you, I am Yours very truly, Perry N. Whitehurst. WHITEHURST, CITY COMMISSIONER. WHEREAS, A vacancy has occurred in the office of City Commissioner of the City of Sanford, Florida, by reason of the resignation of Honorable P.N.Whitehurst, City Commissi of said City, and there will be more than sixty days between the happening of such vacancy and a general election in said City, and it becomes necessary to hold a special election to fill said vacancy in the office of City Commissioner: NOW , THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that a special election be and the same is' hereby called to be held on the 13th day of April , 1937, to fill the vacancy in the office of City Commissioner of said City caused by the resignation of the Honorable P.N. Whitehurst, City Commissioner. BE IT FURTHER RESOLVED that the Mayor of the City of Sanford, Florida, shall issue his proclamation giving notice of such special election, the date and purpose thereof and place where the same will be held , and the time of opening and closing of the polls, and stating therein the names of the inspectors and clerk who are designated in this resolution for such election. BE IT FURTHER RESOLVED that the notice of election provided for in the neat preceding paragraph shall be published once a week for four consecutive weeks in a newspaper published in the City of Sanford, Florida, and proof of publication thereof filed with the City Clerk. BE IT FURTHER RESOLVED, That J.H.Tillis, W.M.McKinnon and H.J.Wilson, who are three intelligent, discreet and fair — minded citizens, and residents and registered voters of the City of Sanford, Florida, are hereby appointed as inspectors, and E.F.Lane, who is a resident and registered voter of the City of Sanford., Florida, is hereby appointed as Clerk of said Special Election. BE IT FURTHER RESOLVED That the aforesaid special election shall be held in the City Commissioners' room in the City Hall of the City of Sanford, Florida, and the polls shall be opened at seven — thirty A.M. Eastern Standard Time, and shall close at sundown on said date. BE IT FURTHER RESOLVED That the City Clerk of the City of Sanford, Florida, shall open the registration books of said City, as provided by the charter of said City, and shall prepare ballots for the holding of said electio n in accordance with Ordinance No. 212 of said City, and do all things necessary and required in and about the holding of said special election and as required in and by Ordinance No. 212 of said City. Commissioner Leffler next introduced Ordinance No. 254 entitled: AN ORDINANCE AMENDING SECTION 13 OF ORDINANCE NO 212 OF THE CITY OF SANFORD, FLORIDA, ENTITLED, " AN ORDINANCE TO PROVIDE FOR AND REGULATE THE HOLDING OF REGULAR AND SPECIAL MUNICIPAL ELECTIONS IN THE CITY OF SANFORD, FLORIDA." and moved that it be placed on its first reading. Seconded by Commissioner Lodge and carried by the following vote of the Commission: Commissioner Higgins Aye " Leffler Aye " Lodge Aye Thereupon said Ordinance No. 254 entitled: AN ORDINANCE AMENDING SECTION 1:3 OF ORDINANCE NO 212 OF THE CITY OF SANFORD, FLORIDA ENTITLED, " AN ORDINANCE TO PROVIDE FOR AND REGULATE THE HOLDING OF REGULAR AND SPECIAL MUNICIPAL ELECTIONS IN THE CITY OF SANFORD, FLORIDA." was placed on its first reading and read in full by the Clerk. Consideration next given to the need for repairs to the roof of the Chamber of Commerce' Building, also to the piling beneath and adjoining the building. Thereupon bid was presented from W.F.Ravenel for removing, driving and cutting off and capping piling in front of and under Chamber of Commerce building as follows: Pulling 47 piles from Chamber of Commerce Building at $2.00 each $94.00 Cutting off and capping 22 piles under Chamber of Commerce Building at $7.00 each. 154.00 Driving 9 fender piles at $7.00 each 63.00 Thereupon in,view of the necessity for this work and no other bids having been presented, Commissioner Lodge moved that the bid of W.F.Ravenel as outlined be accepted and the work authorized. Seconded by Commissioner Leffler and carried. Bids next considered for reroofing the Chamber of Commerce Building but in view of the fact that the Board of Directors of the Chamber of Commerce had appropriated $250.00 for such repairs, same were referred to the Chamber of Commerce for attention. Consideration next given to possible sites for an authomobile 11 Trailer Camp" in Sanford. Thereupon Commissioner Leffler moved that the City Attorney be instructed to pro- ceed with foreclosure proceedings against vacant lots in Bel =Air Subdivision which are tax delinquent over two years, the majority of these lots being tax delinquent since 1927. Seconded by Commissioner Lodge and carried. Communication next read from the Civic Department of the Sanford Woman's Club requesting an investigation of the charges made by the 11100 taxi - cabs" , claiming that the charges actually made are in excess of the amount as advertised on the out- side of the cabs. Matter referred to City Attorney Wilson for investigation and report. 1 1 1 FJ 1 1 U 1 Ll .. 01 MINUTES CITY COMMISSION, SANFORD, FLORIDAMarch 9 at 7: P M i --- 7 Request next presented from J.F.Rogers for permission to remove an oak tree in the parkway in front of his home at 910 Myrtle Avenue, and on recommendation of Inspector Paxton_" same was granted. Communication next read from A.P.Michaels, waterworks engineer making appli- cation to be retained as the engineer to prepare plans and specifications for the installation tiro -150 HP Diesels at the Municipal Water Pumping Station, the construction of an electric line from the pumping station to the well location, and the installation of deep well turbine pumps at the wells; the fee to be based upon the minimum per- centage and the amount of $500.00 previously paid to be credited to this engineering work. At this time the Mayor reported that Mr. Michaels had refused to consider the proposition heretofore authorized of $200.00 to prepare the plans and specifications for this work, but that Mr. J.E.Craig, waterworks engineer who originally designed and installed the Municipal Mater Plant had agreed to do this work at the figure authorized. Thereupon, on motion duly carried, Mr. J.E.Craig was authorized to prepare the plans and specifications, as outlined, at a price of $200.00. The Clerk next reported that under the terms of the agreement dated December 10th, 1934, between the City and W.E.Kirchhoff Jr. and extension of time granted by the Commission under date of Lecember 14th, 1936, Mr. Kirchhoff remitted to the City under date of January 20th, 1937 check for $1500.00 as full payment for the personal property in the Mayfair Hotel as covered by said agreement dated December 10th, 1934, and that bill of sale for such personal property had not been obtained from Dofnos Corporation, to whom this property was transferred under authority of Resolution No. 471, adopted March 27, 1935, for delivery to Mr. Kirchhoff. Bill of the Sanford Electric Contracting Co. for $49.45 , covering electric wiring at the Municipal Athletic Field club house, not included in th* original project next presented, and on motion duly carried, approved and payment ordered. On motion duly carried, the Clerk was next authorized to purchase three dozen American Flags at $15.00 per dozen, for display on holidays and during celebrations. Request next received from Mrs Mattie Hester for widow's exemption allowance on her property described as Lot B Block 12 Tier S for the year 1933 and subsequent, her husband having died in 1932 and application for widow's exemption having been neglected through oversight. Thereupon Commissioner Lodge moved that the exemption be allowed.. Seconded by Commissioner Leffler and carried. The Clerk next presented Atlantic National Bank of Jacksonville Depository Receipt No. A -1177, dated Feb. 20, 1937, covering $25,000.00 H.O.L.C. lj� Series F Bonds, said Depository Receipt having been delivered to the City by the Sanford Atlantic National Bank as additional security for City funds on deposit in said baAk. Security approved. Mr. G W Spencer next appeared with further reference to his request for a permit to erect store building at the N.W. corner of Thirteenth St. and Park Ave., and at the same time requested re- consideration of his application to erect automobile service station at this location. 198 MINUTES CITY COMMISSION, SANFORD, FLORIDA, March _A at 7 :30 P M 19__3T Thereupon careful consideration was given to the matter, Mr Spencer assuring the Commission that the cost would not be less than $4,000.00 and presenting picture of service station similar to that proposed to be constructed. Thereupon Commissioner Leffler moved that Mr. Spencer be granted permit to service erect an automobile/station on Lots 4 and 5 of Block 14 Tier 4, located at_ the northwest corner of Thirteenth Street and Park Avenue , with the understanding that the building would cost not less than $4000.00 , would be Of the type as shown on the picture presented, and would conform to the City Engineer's requirements . Seconded by Commissioner Lodge and carried. Commissioner Leffler next introduced Resolution No. 501, entitled A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, ADOPTING A NEW SEAL FOR USE BY SAID CITY. and same was read in full by the Clerk. Thereupon Commissioner Leffler moved that said Resolution No. 501 be passed and adopted. Seconded by Commissioner Lodge and carried by the following vote of the Commission Commissioner Higgins Aye ' " Leffler Aye " Lodge Aye said resolution No. 501 being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA , ADOPTING A NEW SEAL FOR USE BY SAID CITY. WHEREAS, the seal heretofore employed by the City of Sanford, Florida., for use in the execution of instruments required to be executed under seal by said City has become worn and out of repair and the impression made thereby illegible, and the City Commissioners directed the City Clerk of said City to procure a new seal, which has been done, said seal having in the circumference thereof the words " CITY OF SANFCRD SEMIN OLE COUNTY, FLA." and in the center thereof the likeness of an Indian head, all as shown by the following impression of said seal , to —wit: NOW, THEREFORE, BE IT RESOLVED by the City Commission: of the City of Sanford Florida, that the aforesaid seal purchased by the City Clerk of the City of Sanford, Florida, at the direction of the City Commission; of said City, be and the same is hereby adopted as the Seal of the City of Sanford, Florida, for use in the execution of all instruments required to be executed under seal by said City. Markham Park Heights, for the years 1935 and 1936, application for such exemption at the proper time having been neglected through an oversight. Request approved. Applications next received from Mike Saus at 804 Locust Avenue, and Josh Nelson at 818 Pecan Ave. to sell beer and wines , but due to both of the applicants having been convicted in the Municipal Court for the illegal sale of liquor, applications denied. At this point Commissioner Dupree appeared and took his seat with the Commission. Upon recommendation of municipal Judge Miller and Chief of Police Williams, the Commission next approved suspension of $10.00 of the fine of Bernice Scott, alias " Chuckie" Hatcher, sentenced in the Municipal Court under date of January 4, 1937, to pay a fine of $25.00 or serve fifty days, case No 22870. Further consideration. next given to the matter of price to be paid for a fifty foot strip running north and south across the property of F.W.Bender Jr. and immediately adjacent to the E. line of the Catholic and Lake View Cemeteries, said strip to be used as a highway in lieu of the road now being used across the Municipal Cemetery. Thereupon, in view of the disagreement between the City and owner of this property as to the price, Mr Bender and the Commission agreed to refer the matter to an arbitration. board to be composed of one member appointed by Mr. Bender, one member tp be appointed by the Commission and these two to select a third. On motion duly carried, instructions were next issued to advertise notice of intention to present Bills for passage by the 1937 Session of the Legislature as follows: "To validate, ratify and confirm all levies of taxes, tax assessment rolls and tax sales by the City of Sanford, Florida, subsequent to the enactment of Chapter 9897, Laws of Florida, Acts of 1923, as amended." iTo authorize said City to provide for life and disability insurance for its officers and employees upon a group insurance plan, and to pay in whole or in part premiums therefor, and to levy and collect such taxes as may be necessary for such purposes. To amend Section 64 of Chapter 9897, Laws of Florida, Acts of 1923, which is the charter of said City, said Section relating to the assessment of property by the City of Sanford, Florida, so as to provide that several parcels of property owned by one party or owned jointly by more than one party may be assessed together, unless request is made in writing by the owner to assess the same separately. To authorize said City to use for its operating fund certain revenues deriked from the operationgg of its water plant, as provided by sub — paragraph (b) of Section 7 of Resolution No. x+99 adopted February 1, 1937, providing f orthe refunding of the City's bonded indebtedness. To amend section 59 of Chapter 9897 , Laws of Florida, Acts of 1923, as amended by Chapter 13389 Laws of Florida, Acts of 1927, said section relating to an annual estimate or budget of expenses of said City and to provide for the annual levy of taxes for two purposes, namely , one tax for the funded indebtedness of the City, and one tax for the operating expenses of the City subject to the limitations prescribed by Section 61 of Chapter 9897, Laws of-Florida, Acts of 1923.
