062837252 MINUTES CITY COMMISSION, SANFORD, FLORIDA, June 28th, 1937 at 7:30 P.M. The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 7:30 o'clock P. M., June 29th, 1937. Present: Commissioner Edward Higgins, Mayor. if W. R. Dupree " A. W. Lee " W. A. Leffler " M. J. Lodge City Attorney Fred R.Wilson City Clerk F• S. Lamson Chief of Police R. G. Williams. Meeting called to order by the Chairman. Consideration then given to proposed lease with the Sanford Baseball Association for the Municipal Athletic Field, the basis of the rental to be 100.00 per game played at night and on Sundays and $1.00 per game played at other times, the lease to be dated as of June 11, 1937, and to extend until December 31, 1938. Thereupon Commissioner Lee moved that the Mayor and City Clerk be authorized to execute said lease on the part of the City of Sanford. Seconded by Commissioner Dupree and carried. Mr. Nelson of Champaign, Illinois, next appeared with reference to purchasing the City -owned concrete pipe plant formerly known as the McCracken Concrete Pipe Plant, but in view of the possible need for this plant by the City at some future time, the Commission suggested that he submit a proposal for leasing the plant, which he agreed to do. The Clerk next presented tentative budget of revenues and expenditures for the fiscal year 1937 -1939, and same was taken under consideration and study. In view of the condition of the old three inch water line extending South in Magnolia Avenue from let Street to 6th Street, instructions were next issued that all water services connected to this line be changed to the water mains in the alleys between Magnolia Avenue and Park Avenue and between Magnolia Avenue and Palmetto Avenue, this work to be done in conjunction with the`-MA project for widening and relaying the brick paving on Magnolia Avenue, the expense of such changes to be borne entirely by the Water Utility Department. Planting Plan prepared by Landscape Architect Herbert L. Flint, covering the proposed park between Sanford Avenue and the Mayfair Hotel, next presented and in view of the fact that this completed the work to be performed by Mr. Flint under his agreement, final payment to him of $200.00 was authorized. TheClerk next reported the receipt from the City of Sanford Bondholders' Protective Committee of $3775.00, this amount being refunded by the Committee to be used to pay interest falling due on September let, 1937, on all Refunding Bonds Series A outside the Committee. On motion of Commissioner Dupree, seconded by Commissioner Lodge and carried, the Commission next approved the purchase of certain past due City of Sanford interest coupons as follows: Coupons Nos. 3 thru 18, from Bonds Nos. 71/75, Series A -2 Par Value $2400.00 Amount paid $240.60 Coupons Nos. 10 & 11, from Bond No. 36, Series G, Coupons Nos. 6 & 7, from Bond No. 50, Series DD, Coupons Nos. 6 & 7 from Bonds Nos. 466/68, Series KK Par Value $275.00 Amount paid $41.25 w 1 1 1 1 1 1 1 J MINUTES CITY COMMISSION, SANFORD, FL.ORIDA,June 28th, at 7:30 P.M. 1937, The Clerk next reported the receipt of $50.00, representing the Cityts share of the proceeds of sale under foreclosure of State and County Tax Certificate against Lot 102 Rose Court, Thereupon Commissioner Leffler moved that after applying this payment to 1936 and prior taxes as far as it would go, the balance of the taxes and the street paving lien against this lot be cancelled. Seconded by Commissioner Dupree and carried. City Attorney Wilson next reported that the State Board of Education was ready to exchan its Public Utility Bonds dated January 1, 1924 (Water Utility), for a like amount of the new Refunding Bonds Series B. Thereupon Commissioner Lodge introduced Resolution No. 513 and moved its passage and adoption. Seconded by Commissioner Dupree and carried by the following vote of the Commission: Commissioner Higgins Aye Dupree Aye " Lee Aye " Leffler Aye " Lodge Aye said Resolution No. 513 being in words and figures as follows: RES OLUT I ON NO. 513. A RESOLUTION AUTHORIZING THE EXCHANGE OF CERTAIN REFUNDING BONDS OF THE CITY OF SANFORD, FLORIDA,' FOR CERTAIN OUTSTANDING BONDS HELD BY THE STATE BOARD OF EDUCATION OF FLORIDA, AND DIRECTING THE MAYOR AND CITY CLERK OF THE CITY OF SANFORD, FLORIDA, TO GO TO THE CITY OF TALLAHASSEE, FLORIDA, FOR THE PURPOSE OF EFFECTING SUCH EXCHANGE. WHEREAS, the State Board of Education of Florida is the owner and holder of Bonds Nos. 326 to 375, both inclusive, of the series designated "Public Utility Bonds ", dated January 1, 1924, of the City of Sanford,Florida, and said State Board of Education of Florida has signified its willingness to exchange the aforesaid bonds and attached coupons for Refunding Bonds, Series B. of said City, numbered from 556 to 605, both inclusive, dated March 1, 1937, with coupons maturing September 1, 1937, and thereafter, attached; and WHEREAS, said Refunding Bonds, Series B, Nos. 576 to 605, both inclusive, dated March 1, 1937, have been executed by the Mayor and City Clerk of said City, and the City Commission of said City deems it expedient end for the best interests of said City to effect such exchange: NOW, THEREFORE, be it resolved by the City Commission of the City of Sanford, Florida, that Edward Higgins, as Mayor, and F. S. Lamson, as City Clerk of the City of Sanford ord,Florida, be and they are hereby authorized and directed to proceed to the City of Tallahassee, Florida, and effect an exchange of the aforesaid Refunding Bonds, Series B, dated March 1, 1937 ) Nos. 556 to 605, both inclusive, with coupons maturing September 1, 1937, and thereafter, attached, for the aforesaid Public Utility Bonds of said City, dated January 1, 1924, and numbered 326 to 375, both inclusive, to whichBonds Nos, 326 to 373, both inclusive, shall be attached coupons maturing January 1, 1935, and all subsequent coupons, and to which Bonds Nos. 374 and 375 shall be attached coupons maturing July 1, 1934, and all subsequent coupons, and held by the State Board of Education of Florida, which said bonds and coupons shall be canceled by said Mayor and City Clerk or under the authority of said Mayor and City Clerk, and returned to said City. BE IT FURTHER RESOLVED that the aforesaid Mayor and City Clerk of said City are authoriz- ed to execute and obtain all necessary receipts and other papers in and about the exchange of the aforesaid refunding bonds, and do all things necessary and proper to effect said exchange. Lamson, as City Clerk, in and about the exchange of the aforesaid Refunding Bonds, Series A and Series B, dated March 1, 1937, for outstanding bonds and certificates of indebtedness and judgments against the City of Sanfore and the payment of the aforesaid cash and execution and delivery of the aforesaid certificates of indebtedness in payment and satisfaction of interest on certain bonds and certificates of indebtedness and bonds reduced to judgment against the City be and the same are hereby ratified, approved and confirmed, and BE IT FURTHER RESOLVED that any variations from the aforesaid Resolutions Nos. 509 and 510, as indicated onthe aforesaid schedules designated as Exhibits A, B, C, and D, and hereto attached, be and the same are hereby ratified, approved and confirmed in all respects. Thereupon, in view of the fact that this injury was caused while he was an employee of the City, the expenses of such treatment which can be handled largely by City Physician Tolar, were authorized.
