061437MINUTES CITY COMMISSION, SANFORD. FFL.ORJDA, June 14 at 7:3o P M 19--3z The City Commission of theCity of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 7:30 O'Clock P.M. June 14, 1937. Present: Commissioner Edward Higgins, Mayor. N W.R.Dupree " W.A.Leffler " M.J.Lodge City Attorney Fred R. Wilson City Clerk F.S. Lamson,. Chief of Police R.G. Williams Absent: Commissioner A.w.Lee Meeting called to order by theChairman. Current invoices and payrolls for the month of May 1937, properly audited and vouchered as evidenced by vouchers Nos. 8516 through 9997, submitted, examined , approved and payment ordered. Monthly reports of the•streets, sanitation, health, water, police, fire and library departments for the month of May 1937, submitted and examined. Bank statements in all accounts for the month of May 1937, properly reconciled, submitted and examined. Financial Statement and Statement of revenues and expenditures during the month of May 1937, submitted and examined. Minutes of regular meeting ofMay 24, 1937, next read and approved. Mr H M Watson next appeared with reference to the proposed payments to be paid by theSanford Baseball Association to cover the cost of installation of the flood lighting system as well as the monthly bills for electric current. Thereupon, after careful consideration, it was agreed that the City should lease the Municipal Athletic Field to the Sanford Baseball Association, reserving the right to the City to the use of the park for any other purpose when not used by the Baseball Club, the Baseball Association agreeing to pay to the City $100.00 for each game played. Thereupon City Attorney Wilson was instructed to prepare lease along the lines of the foregoing agreement. The Clerk next presented letter agreement required by the Florida Power & Light Co. covering the rental of transformers used for the Flood Lighting System at the Municipal Athletic Field. Thereupon Commissioner Lodge introduced Resolution No. 511 and moved its passage and adoption. Seconded by Commissioner Dupree and carried by the following vote of the Commission: Commissioner Higgins Aye M Dupree Aye Leffler Aye a ;lodge Aye said resolution No. 511 being in words and figures as follows: RESOLUTION NO. 511. APPROVING A PROPOSED LETTER AGREEMENT BETWEEN THE CITY AND FLORIDA POWER & LIGHT COMPANY PROVIDING FOR THE RENTAL OF CERTAIN TRANSFORMERS AND ACCESSORY_FAWIPMENT BY THE CITY FAOM THE SAID COMPANY, AND SETTING OUT THE TERMS AND CbVDITIONS UNDER WHICH THE SAID TRANSFORMERS AND ACCESSORY EQUIPMENT SHALL BE RENTED TO THE CITY; AUTHORIZING AND DIRECTING THE MAYOR AND THE CITY CLERK OF AND-ON BEHALF OF THE CITY TO EXECUTE AND ENTER INTO THE SAID PROPOSED LETTER AGREEMENT WITH FLORIDA POWER & LIGHT COMPANY. That should it become necessary for us for any reason to furnish additional transformers or equipment of greater capacity at any time during the term of this Agreement, the annual rental charge will be based and adjusted upon the cost of the entire original and additional transformers and equipment as finally furnished , less the cost of any removed transformers and equipment, and you shall pay to us the adjusted rental charge in the same manner as hereinabove provided. 3. A more particular description of the said transformers and accessory equipment covered herein is as follows: 6 - 15 KVA 2400 - 4160Y - 120 -240 volt single phase, pole type distribution transformers. 2 - 37* KVA 2400 -4160Y - 120 -240 volt single phase, pole type distribution Company, hereinafter set forth in Section 2 hereof, be and the same is hereby approved transformers. 6. 50 ampere 5,000 volt expulsion type cut -outs. 2 - 150 ampere, 5,000 volt expulsion type out -outs. as to form and substance. g - 4 KV lightdtggarresters. 4. That the term of this agreement shall be for a period of one ( 1 ) year 2. That the Mayor and the City Clerk of and on behalf of the City of Sanford, or periods of one ( 1 ) year from the termination of said One ( 1 ) be and they are hereby authorized and directed to execute and enter into with Florida year or any extension thereof unless b written notice given by either party Power & Light Company the proposed Letter Agreement approved in Section 1 hereof, and before the date of termination of said one ( 1 ) year or any extension hereinafter set forth in form as follows: thereof either party shall have signified its desire to terminate this Miami , Florida If you agree to the foregoing, kindly so indicate by causing this letter June 14, 1937 and the attached copies to be executed by your duly authorized officials under City of Sanford Yours very truly Sanford, Florida. Gentlemen: This relates to your request for our service to your Municipal Baseball Field, located at the corner of Celery and Mellonville Avenue, in order that night baseball games may be held. In view of the fact that it is your desire , and to your advantage, to rent certain transformers and accessory equipment from us in order to improve your operations In connection with floodlighting your baseball field, it is mutually understood and agreed as follows: 1. That we shall own, furnish and maintain the necessary transformers and accessory equipment of 165 KVA capacity to transform the electric energy delivered to you at 2400/4160Y volts to approximately 115/230 volts, single phase 3 wire and 60 cycles, and that you, in consideration of your use of these transformers and equipment, will pay to us an annual rental of eighteen per cent ( 18 %) of the cost of these transformers and equipment, which cost is hereby agreed to be One Thousand six Hundred Fifty -one and 25/100 Dollars ($1,651.25) or an annual rental of Two Hundred Ninety -Seven and 23/100 Dollars ($297.23) The agreed annual rental charge of Two Hundred Ninety -Seven and 23/100 Dollars ( $297.23 is to be paid to us by ou in four ( 4) equal installments of Seventy -four and 31/100 Dollars ( $7V.31) during the months of June, July, August and September, of each year during the term of this agreement. 2. Ridge, Executive Secretary, Seminole County Welfare Board, reporting on the ease of Walter Trapp who applied to the Commission at the meeting of May 24th, for financial assistance to the extent of $25.00 to help defray his expenses for treatment of arthritis at a hospital at Dayton, Ohio. Thereupon in view of the information as contained in the letter from Mrs. Ridge, Commissioner Leffler moved that $25.00 be donated for this purpose. Seconded by Commissioner Dupree and carried. The Clerk next reported on the progress of the Refunding of the City bonded Indebtedness, to date as follows: Refunding Bonds delivered to the City of Sanford Bondholders Protective Committee, in exchange for like amount of bonds to be refunded, also satisfactions of judgment covering bonds reduced to judgment: Series A Refunding Bonds, dated Marghl, 1937 ( with September 1, 1937 coupons detached) numbers 1 to 4503 , inclusive 14,503,000.00 Series B Refunding Bonds, dated March 1, 1937 ( with September 1, 1937 coupons detached) numbers 1 to 549 , inclusive 549,000.00 5, , Refunding Bonds delivered to holders of a like amount-of bonds not deposited with the City of Sanford Bondholders' Protective Committee; including satisfaction of judgment covering bonds reduced to judgment: Series A Refunding Bonds, dated March 1, 1937, numbers 4504 to 4911, inclusive 409,000.00 Series B Refunding Bonds, dated March 1,'1937, numbers 550 to 5559 inclusive 6 000.00 4140000.00. Seconded by Commissioner Lodge and carried. Thereupon one diaphragm pump, as specified in bids, was ordered purchased from Lee Brothers at,a price of $329.75 Communication next read from Bert Fort, manager, Sanford Country Club outlining the need for installing new fence posts on the Golf Course property facing Chase Grove, Paola Road, and part of Lake Mary Road, and same was taken under con- sideration. Communication next read from R.L. Glenn, Chairman, Seminole County Plan- ning Council, requesting the City to pay.one -half the May telephone bill for WPA telephone No. 456W, totalling $9.96 and on motion duly adopted, payment of one -half of this bill was approved. On motion duly adopted, an additional $19.00 for water to be used by the WPA Sewing Room was next authorized. On motion duly adopted, the authorization for meals and beds to be furnished Indigent Transients through the Salvation Army was ordered limited to $5.00 per month until further notice. Consideration next given to the request of Mr. F.T.Williams, Chairman of the Seminole County Board of Public Instruction, that theCity assist in the cost of running a sanitary sewer from Crooms Academy to the nearest City sewer, Supt. approximately Moughton estimating the entire cost to be %$1200.00 Thereupon, upon motion duly carried, $200.00 of the cost of the project was authorized to be borne by the City and Supt. Moughton was instructed to super- vise the work. Consideration next given to the request of Keswick Corporation, by R.H. Ela.rbee, that the City cancel of record an old paving lien dated Dec. 26, 1913 for paving on Ninth Street adjacent to Lot 6 Block 11 Tier 6, the contention being. that the lien is uncollectible. At this time City Attorney Wilson advised the Commission that the Courts had ruled in a case similar to this that the lien was not collectible. Thereupon, upon motion duly adopted, the b6lan a of the street paving lien dated Dec. 26, 1913, against Lot 6 Block 11 Tier 6 for paving on Ninth Street, amounting to $129.94 , was ordered cancelled of record. Applications next received from E.Z.Irwin at 1216 W. 13th St. and Stinson Kinlaw at 321 E. lst. St. for permit to sell beer and wines, and on motion duly carried, same were approved. Consideration next given to the inability of some few property owners to finaftee the cost of installing sanitary pit type toilets as required by the State Board of Health. ffJ 1 1 [1 Thereupon, in view of the fact that practically all bucket type sanitary S toilets have been replaced by the pit type toilet specified by the State Board of ,. Seconded by Commissioner Lodge and carried. The Clerk next presented bill from Thomson,Wood & Hoffman, Attorneys & Counsellors at Law, New York City, for $908.00, covering approving opinions rendered in the case of $398,000.00 Refunding Bonds,Series A, and$6,000.00 Refunding Bonds, Series B. exchanged for bonds not deposited with the City of Sanford Bondholders' Protective Committee, and bill from Central Hanover Bank & Trust Co. New York City for $245.10 covering fees for cancellation of bonds and coupons received for the City from the Bondholders' Protective Committee, and on motion duly carried, same were approved and ordered paid, examination of Final report o?7milk furnished by dairies operating in Sanford, as prepared by The Sanford Clinical Laboratories next presented, all being well within the requirements for Grade "AN milk. Request next received from the WPA officials for permission to use 42 feet of concrete sewer pipe, heretofore manufactured as a part of the WPA Sewer Project but rejected due to being defective, on a County ,Project where this pipe can be utilized.
