041138MINUTES CITY COMMISSION, SANFORD, FLORIDA, April 11. 7:30 P M. -19-3-8 The City Commission of the City of Sanford, Florida, met in Regular Session at the City Hall in the City of Sanford, Florida, at 7:30 o'clock P.M. April 11, 1939- Present: Commissioner Edward Higgins, Mayor. " falter S. Coleman " W.R.Dupree " A.W.Lee " M.J.Lodge 'City Attorney Fred R. Wilson City Clerk F.S. Lamson Chief of Police R.G.Williams. Meeting called to 'order by the Chairman. Minutes of regular meeting of the City Commission and meeting of the Municipal Delinquent Tax Adjustment Hoard of March 25th.1935, read and approved. Current invoices and payrolls for the month of March, 1935, properly audited and vouchered as evidenced by vouchers Nos. 9701 through 9790, submitted, examined, ap- proved and payment authorized. Monthly reports of the streets, sanitation, health, water, police, fire and library departments for the month of March, 1935, submitted and examined. Bank statements in all accounts for the month of March, 1935, properly reconciled, submitted,and examined. Financial Statement and Statement of revenues and expenditures during the month of March, 1935, submitted and examined. Mr. Peter A Lever next appeared with reference to the sewer conditions in Buena Vista Subdivision and same was referred to Supt. Moughton for investigation. Consideration next given to the agreement with the Atlantic Coast Line R.R. Co. that upon the completion of the widening of Oak Avenue between First and Second Streets, the Commission would pass an ordinance prohibiting the parking of motor vehicles or other vehicles on nest side of Oak Ave. from First St. south to point where the curb intersects the right of way of the Atlantic Coast Line Railroad Co. Commissioner Lodge then introduced Ordinance No. 265 entitledz AN ORDINANCE OF THE CITY CF SANFCR D FLORIDA MAKING IT UNLAWFUL TO PARK ANY MOTOR VEHICLE OR OTHER VEHICLE ON THE WEST SIDE OF THE PORTION OF OAK AVENUE IN THIS ORDINANCE DESCRIBED, AND PROVIDING A PENALTY FOR THE VIOLATION HEREOF. and same was placed on its first reading and read in full by the Clerk.. Thereupon Commissioner Lodge moved that the rules be waived and said Ordinance No. 265 be placed upon its final passage and adoption. Seconded by Commissioner Dupree. On motion duly adopted Ordinance No. 265 was next ordered POSTED at the fr)nt door of the City Hall in the City of Sanford, Florida, in accordance with the terms of the Charter, as amended. The Clerk next presented the following Federal Reserve Bank of Atlanta, Jacksonville Branch, Safe Keeping Receipts, covering securities deposited therewith by the Sanford Atlantic National Bank as security for City ofSanford deposits: Receipt No 5754, dated 3 /23/38, covering $50,000.00 l-y1fc Home Owners' Loan Corporation Bonds of 1939• Receipt No. 5755, dated 3/28/38, covering $33,000.00 22% United States Treasury Notes, Series D -1938. Receipt No. 5756, dated 3 /23 /38,covering $12,000.00 1�f United States Treasury Notes, Series C-1940. Receipt No 5757, dated 3/28/38, covering $10,000.00 1 -3/8 % United States Treasury Notes, Series B -1941. Thereupon, on motion duly adopted, said Security was approved and the Clerk authorized to return to the Sanford Atlantic National Bank the Depository Receipts of the Atlantic National Bank of Jacksonville heretofore delivered to the City as security for City deposits in said Sanford Atlantic National Bank. City Attorney Wilson next presented form of agreement to be executed by property owners who request permission to pay their taxes,as adjusted by the Municipal Delinquent Tax Adjustment Board, in installments, under the terms of which the property owner agrees that if the entire amount necessary, as adjusted, is not paid by January 1, 1939, such sums as have been paid may be applied by the City on payment of the taxes as though the same had not been adjusted by the Adjustment Board. Thereupon said form of agreement was approved. Dilapidated condition,of old frame building located on the E. 1/2 of Lots 9 and 10 of Block-11 Chapman & Tucker's Addition next brought to the attention of the Commission, after which the matter was referred to City Attorney Wilson to establish ownership with a view to having the building either repaired or demolished. Consideration next given to the fact that the City sold to William Clark on January 12, 1935, the property described as: Beg. 280 ft. W. of N E. Corner of Lot 4 Robinson's Survey, run W. 36.6 ft S. 117 ft. E. 36.6 ft N. 117 ft. to Beg. for $100.31 inCity of Sanford bonds and $32.53 in cash; that William Clark failed to have the deed recorded until the following November; that in the meanwhile this property was included in Sheriff's levy and sale to satisfy judgment of Augustus T.Ashton and was purchased at such sale by V.A. Speer, and that Hr. Speer, in order to clear title to this property has agreed to execute quit -claim deed upon receipt- of amount actually expended, to -wit $6.00 for the property and $2.00 for the Sheriff's deed. MINUTES CITY COMMISSION, SANFORD, FLORIDA, April 11 at 7 :30 P M 19-30, Thereupon, in view-of the fact that the "ity was actually paid twice for this property, first in the form of bonds and cash, and then in the form of credit on the Ashton judgment, Commissioner Coleman moved that 13r. Speer be re- imbursed for the amount actually expended, upon the execution of quitclaim deed to the present owner. Seconded by Commissioner Dupree and carried. On motion duly adopted, the Commission next authorized the Water Utility Department to place in effect as of meter readings of May 15th., and to extend through the month of September, the same rate for homes, 'lodges and churches as was in effect during the summer of 1937, to wit: $.15 per thousand gallon for all water consumed in excess of $2.50 per month as calculated at the present rates. Communication next received from Charles T. Davies, Wyomissing, Pa. requesting advice as to whether the City will pay at this time Certificate Of Indebtedness Igo. 6 for $50.00, payable on or before July lst.,1938, this certificate having been issued as part settlement of past due interest on his bonds which were refunded. Thereupon, in view of the fact that funds for this purpose-are on hand the Clerk was authorized to redeem this certificate of Indebtedness when presented for payment. On motion of Commissioner Dupree, seconded by Commissioner Lee and carried, the Commission next approved the payment of $41.67 to the Sanford Atlantic National Bank as interest to April 1, 1938, on contract with the Randall Electric Company for purchase of the flood lighting equipment for the Municipal Athletic Field, said contract having been assigned to the Sanford Atlantic National Bank. Request next received from Mrs. Frances Hayman at S.E.Corner of Third St. and Elm Avenue for permission to remove two trees from the parkway at this location, and on recommendation of Inspector Paxton, same was approved. Communication next read from O.P.Herndon, Clerk of the Board of County Com- missioners, advising that it will be ag2eeable for the City to use the County -owned roller and scarifier on the French Avenue repaving project. Request next received from Fire Chief Cleveland for permission to purchase 4 chairs and a settee for the Fire Station at a cost of $70.00, and on motion of Commissioner., Coleman, seconded by Commissioner Dupree and carried, same was approved. On motion duly adopted, prices were next ordered obtained for summer uniforms for the police and fire departments, consisting of trousers and shirts. Consideration next given to the need for a better water supply for the Lake View Cemetery, after which the matter was referred to Commissioner Lee for investigation. On motion duly adopted Fire Chief Cleveland was next authorized to attend the Convention of the State Firemen's Association to.be held at Fort Lauderdale on April 18th and 19th., the City to pay all expenses. There being no further business, the meeting then adjourned until 10 o'clock A.M. April 14th, 1938, after which the Board immediately re- convened as a Municipal Delinquent Tax Adjustment Board.
