042538MINUTES CITY COMMISSION, SANFORD, FLORIDA, April 25, 1938, 7:30 P 19-3-9 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Saford, Florida, at 7:30 O'Cloek P.M. April 25, 1939. Present: Commissioner Edgard Higgins, Mayor " Walter S. Coleman " W.R.Dupree " A.W.Lee it M.J.Lodge City Attorney Fred R.Wilson City Clerk, F.S. Lamson Chief of Police, R.G.Williams Meeting called to order by the Chairman. Minutes of regular meeting of the City Commission and meeting of the Municipal Delinquent Tax Adjustment Board of April 11, and adjourned meeting of the City Commission of April 14, 1938 read and approved. Complaint next received from C.W.Sullivan, owner of the Montezuma Hotel, to the nuisance created by smoke from the various dry cleaning establishments in that neighborhood. Matter referred to City Attorney Wilson to investigate smoke ordinances in effect in other cities. Petition next read from the Sanford Electric Contracting Co. and Randall Electric Co. and approved by Electrical Inspector Paxton and Fire Chief Cleveland, requesting the adoption of an ordinance governing the sale, installation, use, maintenance and repairs of electrical wiring, apparatus or equipment for light, heat or power within the limits of the City. Thereupon, after considerable discussion, the Chairman appointed Commissioners Lee and Dupree to represent the Commission on a Committee composed of E.C.Harper and E.B. Randall, Jr. representing the two electrical companies, City Attorney Wilson, Electrical Inspector Paxton, and two Commissioners, to draft an electric code for presentation to the Commission. Petition signed by numerous merchants and business men urging a more rigid check on itinerant peddlers and others who pay no license or taxes in the City or County, next presented. Thereupon, after careful consideration, the Clerk was instructed to assure the petitioners of the desire of the City to collect the proper license taxes wherever possible and to request better cooperation from the merchants and citizens in notifying the police department when such itinerants are discovered doing business without the proper license. Report of analysis of milk being furnished by dairies operating in the 0ity of Sanford as prepared by the Sanford Clinical Laboratories, next presented, such report showing all such milk being well within the requirements for Grade "A "milk. Invoice of the Seminole County Abstract & Mortgage Co. for $336.75, covering abstract information furnished on lots in Dreamwold lst, 2nd, 3rd and 4th Sections, needed in connection with foreclosure proceedings to be brought against such lots for delinquent taxes and special assessments, next presented, and on motion of Commissionet. Coleman, seconded by Commissioner Dupree and carried, same was approved and payment ordered. City Attorney Wilson was next authorized to obtain the same information on tax delinquent lots in the other subdivisions. 1 FJ 1 I. 1 1 1 i MINUTES CITY COMMISSION, SANFORD, FLORIDA, APTil 259 at 7!30 P_19--3$ Communication next presented from the various office employees and department heads thanking the Commission for the group life insurance recently taken out on the City employees. Communication next read from Ira D. Martin requesting a portion of the City's paint business, and same was referred to Supt. Houghton. Consideration next given to the claim of John Schirard,Jr. for doctor's bill of $28.00 for anti- rabies treatment to child bitten by a dog, the basis of the claim being that contrary to the doctor's orders the dog was burned when it died, thus making it impossible to examine the head for rabies and thereby making it necessary as a safety measure to have the anti- rabies treatment administered to the child, which treatment would not have been needed if an examination of the dog's head had shown no signs of rabies. Thereupon, in view of the foregoing and after careful consideration, Commissioner Coleman moved that the claim be allowed and the bill paid. Seconded by Commissioner Lodge and carried. Engineer Fred T. Williams next presented completed WPA project application covering the construction of a boat basin immediately east of the Municipal. Pier at the foot of Park Avenue, the total cost being $41,572.00 of which the City's share will be $15,309.00 and on motion of Commissioner Dupree seconded by Commissioner Coleman and carried, said application was approved and the Mayor and Clerk authorized to execute same on behalf of the City of Sanford. Applications next received from C.F.Newson at 1610 W. 13th St., Harley Lee at 508 Sanford Ave. and Emmett Head at 207 W. First St. for permit to sell beer and wines, and on recommendation of Chief of Police Williams, same were approved. Application next received from Dan Calhoun at 423 E. 5th St. for permit to operate a dance hall, and recommendation of Chief of Police Williams, same was approved. Bids next received from W.E.Watson, B.L.Perkins and the Yowell Company to furnish uniforms for the police and fire departments, and on motion duly adopted, same were referred to Fire Chief Clevelandand Police Chief Williams to tabulate and present recommendations at the next meeting of the Commission. Engineer Williams next presented completed WPA drainage and Street repaving project application, to be sponsored jointly by the City and County, located in the E. 1/2 of Section 35 Tp. 19 S.R.30. E. , the total cost being $28,956.00 of which the sponsors share wi will be $7853,00, and on motion duly adopted, same was approved with the understanding that the City's share will be only as heretofore authorized. Communication next presented from H. James Gut, inclosing a short paper " A Study of the Artesian Mater Supply of Seminole County, Floridan as prepared by Sidney A.Stubbs, Geologist, the information for this paper having been obtained after an investigation of the underground water resources of the County conducted by both Mr. Stubbs and Mr. Gut and financed by the City, County and private sources. Also requesting financial assistance in order to complete the report of this investigation, it appearing that this report has been written but due to lack of finances not published. Thereupon, in view of the value of the information to be contained in the published report of this investigation, $25.00 was authorized to be paid to be applied on the cost of publishing this report. MINUTES CITY COMMISSION, SANFORD, FLORIDA, April 25, at 7 :30 P 9-39- In view of the fact that the City taxes against lots 4 & 5 of Block 4 Tier 1 have been paid to date, Commissioner Lee next moved approval of the sale to G.E.Slack, as mortgagee, of State & County Tax Certificates, sales of 1929 and 1933, including subsequent taxes, against Lots 4,5 & 6 Block 4 Tier 1, at the price paid by the City under the Murphy Act, plus interest. Seconded by Commissioner Dupree and carried. On motion duly adopted, Tax Collector Ellen Hoy was next instructed to hold the 1937 Tax Sale on the first Monday in July 1935. On recommendation of Fire Chief Cleveland, and on motion duly adopted, the Commission next approved payment of two weeks salary in lieu of notice to J.R.Tatum, dismissed from the Fire Department by the Fire Chief under date of February 10,1935. Consideration next given to the need for a revision of the various traffic ordinances now in effect, and on motion duly-adopted,, City Attorney Wilson, Chief of Police Williams and Municipal Judge „Miller were appointed a committee to prepare one combined traffic ordinance for submission to the Commission. Instructions next issued to City Attorney Wilson to prepare a resolution dedicating Lots 48 to 54 Incl. and Lot H, Lake View Park, for park purposes, these lots being a part of the newly created Fort Mellon Park, Commissioner Lee next reported that the cost of new pipe and fittings needed to im- prove the water supply in Lake View Cemetery would be approximately $94.00 Thereupon Commissioner Lodge moved that this work be done, under the supervision of Supt. Moughton. Seconded by Commissioner Dupree and carried. In connection with the Short Course in Water Treatment to be held in Daytona Beach, May 23 and 24, 1935, J.D.Abrahams, Engineer in charge of the Water Pant was next authorized to attend this course, the expenses incurred to be borne by the City. Request next received from R.J.Palmer, Sinclair Oil Co. agent, for permit to operate gasoline service station at 917 W. First St. , and on motion duly carried, same was approved with the proviso that if it gets to be a nuisance, the operation of a service station at this location will be discontinued. Consideration next given to the matter of Bonds Nos 121 to 130, both numbers inclusive, Series A -2, with coupons due July 1, 1929 and subsequent attached, forwarded to the Sanford Atlantic National Bank with draft attached for $5000.00 by W.V.Torhune of Orlando. Thereupon , in view of the refusal of the owner of these bonds to refund, Commissioner Coleman moved that the City purchase all past due coupons from these bonds, par value $5400 ©0 for $1500.00 and that arrangements be made with the Bank to purchase the bonds with all unmatured coupons for the balance, to -wit $3200.00, the City to then purchase the bonds at the same price from the bank as funds become available therefor. Seconded by Commissioner Lee and carried. Commissioner Dupree then introduced Resolution No. 525 and moved its passage and adoption. April 25 at 7:30 P M -19--38- RESOLUTION NO. 529 A RESOLUTION OF THE, CITY C011MISSION OF THE CITY OF SANFORD, FLORIDA, AUTHORIZING THE PURCHASE BY THE CITY OF SANFORD, FLORIDA, OF CERTAIN BONDS OF SAID CITY FROM THE SANFORD ATLANTIC NATIONAL BANK OF SANFORD, FLORIDA, AND PLEDGING THE COLLECTION OF DELINQUENT TAXES FOR DEBT SERVICE TO THE PAYMENT OF THE PURCHASE PRICE OF SAID BONDS. WHEREAS, the SANFtRD ATLANTIC NATIONAL BANK of Sanford, Florida, holds bonds numbered 121 to 130, both inclusive, of Refunding Bonds, Series A -2, dated January 1, 1928, with interest coupons maturing July 1, 1938, and subsequent coupons thereto attached and has offered to sell said bonds with said coupons attached to the City for the sum of $3200.00 to be paid out of the collection of delinquent taxes for debt service. NOW , THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that the City purchase of and from the Sanford Atlantic National Bank of Sanford, Florida, the above described bonds with the aforesaid coupons attached at and for the sum of' 3200.00 and for the payment of said sum of $3200.00 and interest thereon the collection of delinquent taxes for debt service of said City is hereby pledged, said sums so collected to be paid to Sanford Atlantic National Bank until said sum of $3200:00 and interest thereon is paid in full, said bank to hold said bonds until said purchase price and interest are paid, said purchase price to be paid on or before ninety days from date hereof.
