The City Commission of the City of Sanford, Florida, met in adjourned regular
session at the City Hall in the City of Sanford, Florida at 3 o'clock P.M. September 30,1935.
Present: Commissioner Edward Higgins, Mayor.

Absent: Commissioner W.R.Dupree ( excused on account of sickness.)
Meeting called to order by the Chairman.
In accordance with the regulations governing the holding of Primary Elections, and
on motion of Commissioner Coleman, seconded by Commissioner Lodge and carried, the Mayor
was next authorized to issue an election proclamation calling a Primary Election to be held
on November 5th , 1935, for the purpose of selecting two nominees for the position of
City Commissioner, one to fill the vacancy to be created by the expiration of the term of
office of City Commissioner W.R.Dupree and the other to fill the vacancy to be created by
the expiration of the term of office of City Commissioner A.W. "es, the following being
designated as Clerk and Inspectors of said election:

For Inspectors: Mrs F.E.Roumi1lat, Jay, H.. Beck. and B..E.'Chapman
City Attorney Wilson next reported that as a result of a conference with R.E.Kurtz,
attorney for M.E.Smith, holder of a judgment in amount of $9034.59, obtained under date
of September 16, 1935, on various past due City of 6anf ord interest coupons and aecrued
interest thereon, the hoider or the judgment had agreed to accept payment in full on the
basis of fifty cents on the dollar, provided payments are made as follows:
such payments to be made through the First National Bank in Fort Myers, at Fort Myers,
Florida, as Escrow Agent:
1000.00 on or before October 6th. , 1935.
1000.00 on or before November let, 1935.
1000.00 on or before December 1st, 1935
1000.00 on or before January let, 1939•
517.29 on or before February let, 1939•
Thereupon,it appearing to be to the best interests of the City, Commissioner Coleman
moved that the proposal of M.E.Smith, as outlined, be accepted, that the Mayor and City
Clerk be authoritzed to execute the proper agreement, and that the Clerk be authorized and
instructed to make the various payments as outlined in said agreement, as they fall due.
Seconded by Commissioner Lodge and carried.
E.B.Randall, representing the Randall Electric Co., and E.C.Harper, representing the
Sanford Electric Contracting Company, next presented a proposed ordinance embodying an
electrical code for the City of Sanford, and same was referred to City Attorney to draft in
proper form for consideration by the Commission at the next regular meeting.
Communication next read from Jennings & Watts, attorneys for C.J.Root, requesting
information as to interest payment on Mr. Root's bonds during the next year, and same
was referred to City Attorney 'Wilson.
Notice next presented from the Sanford Atlantic National Bank of a payment due October
1st, 1935, on the principal of the contract covering the purchase of flood lighting equipment

at the Municipal Athletic Field, in an amount of $1963.33, together with interest in amount
of X40.28.
Thereupon the Clerk was instructed to pay the interest due October 1st, 1938, and
request andextension of time for the principal payments on the contract in view of the
intention to place this item in the 1938 -1939 budget in place of paying from revenues of
-the Municipal Athletic Field as originally intended.
Consideration next given to the plan of payment of delinquent taxes and special
assessments as embodied in Ordinance No. 269, adopted on August 26th, 1938, it appearing
that although many tax payers had availed themselxtes of this plan, many others although
desirous of adopting the plan had been unable to raise sufficient funds for the initial
payment in the time allowed.
Thereupon, on motion duly adopted, City Attorney Wilson was instructed to prepare
an Ordinance extending the time for accepting the plan for payment of delinquent taxes
as outlined in Ordinance No. 269, until October 31, 1939, the Clerk in the meantime to
continue accepting any payments made under such plan.
The'Clerk next presented City of Janf ord Refunding Bond Series A. Number 2702, with
interest coupons due March 1, 1938, and subsequent attached, together with check for
$22.35, both bond and check having been received from the Central Hanover Bank & Trust
Company, New York City, as Depository for the City of Sanford Bondholders Protective
Committee, in exchange for Certificate of Deposit No. 912, authorized to be purchased
from Mrs. Margaret Erickson at the meeting of September 21, 1938.
Thereupon, in view of the fact that the check for $22.35 represented distributions
made by the Bondholders' Committee and due the holder of this Certificate of Deposit
prior to its purchase by the Uity, and in view of the further fact that the amount of the
interest coupons payable March 1st, and September 1st, 1938, from Series A Refunding
Bond No. 2702, were also due the holder of this Certificate prior to its purchase by the
City, the Clerk was next instructed to remit $22.35 the amount received from the Central Hanover
Bank & Trust Company, and the interest coupons due March 1st, and September let, 1938,
from the Series A Refunding Bond No. 2702, to Mrs Erickson to whom they properly belonged.
Consideration next given to the tact that Mr. Hal Wight would not be able to
complete that part of the agreement approved at the meeting of August 16, 1938, in so
far as the payment of the balance due by September 30th. 1938 is concerned, due to
unforseen difficulties.
Thereupon an extension of 10 days was ordered allowed.
Further consideration next given to the matter of the Recreational Director for the
City, two plans having been previously submitted, one contemplating the furnishing of
a Director by the Recreational Division.of the Works Progress Administration, and the'
other, to employ W.R.McCracken, Physical Director of the Sanford schools, on a part time
basis during the school term and on a full time basis for the balance of the year, the
cost to the City under either plan to be $600.00 for the year.
Thereupon, after a decision by the Commission that it would be more advantageous to
have a full time Recreational Director, Commissioner Coleman moved that the offer of the
Recreational Divi,sion of the Works Progress Administration to furnish a recreational
director provided the City would provide room and meals for the director and some small
equipment, be accepted, and that $50.00 per month be appropriated for that purpose;

On motion duly adopted the Clerk was next authorized to transfer $1758.73
from the Sinking Fund to the Ordinary Fund, to re- imburse the Ordine -ry Fund for
Debt Service expenses paid by the Ordinary Fund; $3714.12 from the Sinking Fund to
the Ordinary Fund to apply on cost of bonds purchased for the Sinking Fund by the
Ordinary Fund; $300.00 from the Department of Water Utility revenues to the Sinking
Fund for interest on unexchanged Series B Refunding Bonds, and $1550.00 from Debt
Service collections of current taxes to the Sinking Fund for interest on unexchanged
Series A Refunding Bonds.
Request next presented from Crooms Academy, colored high school, for permission
to use the Municipal Athletic Field for foot ball games., provided provision is made
that no damage be done to the baseball diamond.
Request granted.

APPROPRIATING ANY UNEXPENDED CASH SURPLUS ON HAND AT THE END OF THE
FISCAL YEAR 1937 -1938 TO THE DEPARTMENT OF THE GENERAL GOVERNMENT
OF SAID CITY, FOR THE FISCAL YEAR 1935 -1939, FOR USE FOR THE ORDINARY
PURPOSES AND OPERATING EXPENSES OF SAID CITY.
WHEREAS the City Commission of the City of Sanford , Florida , deems it
necessary, expedient and for the best interests of said City that any unexpended
cash surplus as of September 30, 1935, of the operating revenues of,said City for
the fiscal year 1937 -1935 be appropriated for the ordinary purposes and operating
expenses of said City in the budget for the fiscal year 1938 -1939 •
NOW , THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford,
Florida, that any unexpended cash surplus as of September 30, 1938, of the operating
revenues of said City for the fiscal year 1937 -1938 be and the same is hereby
appropriated to the Department of General Government of said City for the ordinary
purposes and operating expenses of said City for the fiscal year 1938 -1939, and
said cash surplus shall be incorporated in the budget of revenues and expenditures of
said City for said fiscal year 1938 -1939 for the ordinary purposes and operating ex-
penses of said City.

BE IT FURTHER RESOLVED that this Resolution shall become effective immediately
upon its passage and adoption.

City Clerk to the City Commission: be and the same is hereby adopted as the budget of
the City of Sanford, Florida, for the fiscal year beginning the first day of October,
1938, and ending the 30th day of September , 1939•
BE IT FURTHER RESOLVED, that upon the collection of any revenues of said City
the City Clerk shall allocate from each dollar collected.and received the several
amounts to the respective funds or purposes for which the same are hereby authorized
and appropriated.
BE IT FURTHER RESOLVED, that this Resolution shall become effective immediately
upon its passage and adoption.

door of the City Hall in the City of Sanford, Florida, in accordance with the terms of
the Charter, as amended.

CITY COMMISSION, SANFORD, FLORIDA, September 30 at 3 P M-19-38
Thereupon the Chairman announced that the City Commission of the City of Sanford,
Florida, by unanimous vote had passed and adopted said Ordinance No.272 entitled: AN ORDINANCE
ENTITLED:AN ORDINANCE DETERMINING THE AMOUNT AND FIXING THE RATE OF TAXATION AND MAKING
THE ANNUAL TAX LEVY OF THE CITY CF SANFORD, FLORIDA, FOR THE YEAR 1938.
On motion duly adopted, Ordinance No. 272 was then ordered POSTED at the front
door of the City Hall in the City of Sanford, Florida, in accordaiace with the terms
of the Charter, as amended.
There being no further business, the meeting then adjourned.
