CITY COMMISSION, SANFORD, FLORIDA, January 2 193 The City Commission of the City of Sanford, Florida , met in adjourned session at the City Hall in Sanford , Florida at 7 :30 O'Clock P.M. January 2, 1931: Present: Commissioner H.J.Lehman, Mayor. " W.A.Leffler " R.A.Newman. " V.A.Speer " F.L.Woodruff. City Attorney Fred R.Wilson Associate Counsel Cary D.Landis City Clerk F.S.Lamson Meeting called to order by the Chairman. The first matter for consideration was the proposed execution of a supplemental agreement with the Florida Power & Light Co. covering the discontinuance of certain street lights in the City of Sanford. Thereupon Commissioner Leffler moved the adoption of Resolution No. 397, providing for the change in the present street lighting contract with the Florida Power & Light Co. said resolution No. 397 being in words and figures as follows: RESOLUTION NO. 397• APPROVING A PROPOSED SUPPLEMENTARY AGREEMENT WITH FLORIDA POWER & LIGHT COMPANY WHICH PROVIDES FOR THE TEMPORARY DISCONTINUANCE AND THE TEMPORARY REDUCTION IN CANDLE POWER OF CERTAIN STREET LIGHTS NOW BEING OPERATED UNDER THE MUNICIPAL STREET LIGHTING AGREEMENT NOW IN EFFECT BETWEEN THE CITY AND THE SAID COMPANY AND DATED THE 1st DAY OF OCTOBER 1926; AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK OF AND ON BEHALF OF THE CITY OF SANFORD TO EXECUTE AND ENTER INTO THE SAid SUPPLEMENTARY AGREEMENT WITH FLORIDA POWER & LIGHT COMP, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA: 1. Thus that certain proposed Supplementary Agreement with Florida Power & Light Company which is hereinafter set forth in full in Section 2 hereof, be and the same is hereby approved as to form and substance. 2. That the Mayor and the City Clerk of and on behalf of the City of Sanford, be and they are hereby authorized and directed to execute and enter into with Florida Power & Light Company the proposed Supplementary Agreemtn approved in Section 1 hereof and herein- X, after set forth in form, words and figures as follows: THIS SUPPLEMENTARY AGREEMENT ( Designated for convenience, "SUPPLEMENTARY AGREE NO. 2 ") made this 2nd day of January 1931, by and between the CITY OF SANFORD, a municipal corporation organized and existing under the laws of the State of Florida ( Hereinafter called the "City "), and FLORIDA POWER & LIGHT COMPANY, a corporation organized and. existing under the, laws of the State of Florida, (hereinafter called the "Company ") . WITNESSETH: That for and in consideration of the sum of One Dollar ($1.00) paid by the City to the Company, and of the covenants and agreements hereinafter set forth, the parties here covenant and agree as follows: 1. That the Company as of the let day of December 1930, at the request of the City 301.. will temporarily reduce the candlepower of seventeen (17) street lights now being operated under the said Street Lighting Agreement dated the let. day of October., 1926, and which are described as to number, type, burning schedule and location, together with present 3. That the Company will not bill the City and the City shall not be obligated to pay for the operation of the street lights temporarily discontinued or permitted to remain dis- continued hereunder while the same remain so temporarily discontinued. That While the street lights described in Section 2 hereof remain reduced in candle- power as in the said Section 2 provided, the Company will bill the City and the City will pay therefor in accordance with the rates set forth in the said street lighting agreement dated the let. day of October , 1926, and which are applicable to street lights of the candlepower to which the said lights are reduced in accordance with the said Section 2 hereof. 4. That the Company will from time to time, at its expense, at the request of the City, restore to service and /or to original candlepower any or all of the street lights des - cribed in this Supplementary Agreement No. 2 and after such restoration- to service and/ or original candlepower, the Company will bill the City and the City will pay therefor 'in accordance with the Street Lighting Agreement now in effect between the City and the Company and dated the let day of October 1926. candlepower and reduced candlepower as follows: "White Wag" - Dusk to Dawn. That while any of the street lights temporarily discontinued and/ or reduced as to candlepower hereunder remain so temporarily discontinued or reduced in candlepower, the City shall not regUire the Company and the Company shall not be obligated to install addit4 al street lights except as provided in Section 2 of Article 1 of said contract dated October 18t, 1926, provided, however, the Company at the request and expense of the City will relocaa any of the lights discontinued hereunder and, at new location or locations , will restore the same to service and thereafter serve them in accordance with the said street lighting agreement dated the 1st day of October 1926. 6. That this Supplementary Agreement No. 2 shall inure to the benefit of and shall be binding upon the successors of the City and the successors and assigns of the Company. IN WITNESS WHEREOF, the parties hereto have caused this Supplementary Agreement No. 2 to be signed in duplicate by their duly authorized officers and their official seals to be hereunto affixed the day and year first above written. Lehman-. n Leffler " Newman " Speer Woodruff Aye Aye Aye Ay e Not voting. ■ 1 II 1 1 MINUTES CITY COMMISSION, SANFORD, FLORIDA, January 2 19 31 The complaint of Mr.I.B.Davis against the action of Police Officer Shaffer in arrest- 303 ing him on the night of October 29th., last , was next brought to the attention of the Commission again for further consideration, and after considerable discussion, Commissioner Newman moved that the report of the Committee appointed to investigate this complaint and presented at the meeting of December Sth., be accepted and approved and no further action. be taken in this matter. Seconded by Commissioner Woodruff and carried by the following vote: Commissioner Lehman Nay a Leffler Aye " Newman. Aye Speer Aye Woodruff Not voting . The matter of need for new uniforms for the police and fire departments next was brought to the attention of the Commission, and bids received from the following were submitted for consideration by the Commission: Woodruff & Watson_, Ed Randall S.W.Bradford Yowell Company. Thereupon Commissioner Speer moved that the Mayor be appointed a committee of one to determine to whom the order for six uniforms for the fire department and seven uniforms for the police department should be awarded. Seconded by Commissioner Leffler and carried -by the following vote: Commissioner Lehman Nay Leffler Aye Newman Aye " Speer Aye Woodruff Aye Commisioner Newman next introduced Resolution No. 399 and moved its adoption, said Resolution No. 399 being in words and figures as follows: RESOLUTION NO. 398 A RESOLUTION AUTHORIZING THE PAYMENT WITH MATURED BONDS OF THE CITY OF SANFORD, FLORIDA BY THE OWNERS OF PROPERTY OR HOLDERS OF LIENS THEREON, OF TAXES ASSESSED BY SAID CITY OF SANFORD FOR ANY YEAR PRIOR TO THE YEAR 1930. BE IT RESOLVED BY THE CITY COMMISSION of the City of Sanford, Florida, that any owner of property or holder of a lien thereon, assessed for taxes by said City of Sanford, for any year prior to the year 1930 and which taxes have not been paid, may pay such taxes with matured bonds of the City of Sanford, Florida, of any issue, which bonds shall be accepted by the City Tax Collector or Deputy Tax Collector of the City of Sanford, Florida, at par without acoTued interest, and proper receipts issued therefor. Be It Further Resolved that this Resolution shall become effective immediately upon its passage and adoption. Adopted this 2nd day of January , 1931. Request next received from Mr. F.L.Woodruff for reduction in the 1930 valuation of house on the corner of Eighth Street and Elm Avenue, due to it being practically worthless and the City having asked that it be torn down. Commissioner Leffler moved that the City contribute $50.00 towards the cost of the destruction of the building referred to.
