The City Commission of the City of Sanford, Florida met in Regular Session at the City Hall in Sanford, Florida at 7:30 O'Clock P M February 23, 1931. Present : Commissioner T.L.Dumas, Mayor. " W.A. Minutes of Regular Meeting of February 9th, 1931 read and approved. The Committee appointed to investigate the request of the Sanford Gas Company to close the Gas Plant in Sanford and furnish this City with gas from the plant at Orlando, next recommended that the request be refused. Thereupon the request of the Sanford Gas Company , as aforesaid, was refused and the local manager notified to that effect. A delegation from the local units of the Florida National Guard next appeared and requested that past due taxes on 16 lots in Marvania lying East of Crescent Boulevard be cancelled, and that these lots be exempted from City taxes for the next four years, in ex- change for which the owner of these lots will allow their use by the National Guard as a target range. It appearing, however that a bulkhead lien against this property would pre- vent assistance by the Government in installing this range, the City then offered the use of Crescent Boulevard extending from the lake south the required distance, for this purpose, Crescent Boulevard at this point not being opened or used by traffic whatever. Action deferred pending consideration of this proposition. Petition next presented to the Commission by Mr. L P Hagan, requesting the re- appointment of former police officer J V Martin, who was released as of February 15th, 1931, in line with the City's policy of retrenchment in order to live within the budget for the current year. Commissioner Leffler moved that the commission accept this petition for con- sideration at an early date. Seconded by Commissioner Lehman and so ordered. Offer next received from Mr. L.Allen to rent the City greenhouse, including water, at a monthly rental of $6.25, payable in shrubbery at the market price. Commissioner Lehman moved that the matter be taken under consideration and answer given Mr. Allen at the next regular meeting of the Commission. Seconded by Commissioner Speer and carried. Communication next read from Mrs. Elsa Knight , Librarian at the Municipal Library, recommending that the morning hours of the Library be from 10 until 12 instead of from 9 to 12, in order to give her more time for repairing books and other duties which cannot be taken care of when the Library is open. Commissioner Lehman moved that the hours for the Library to be open in the mornings be changed to meet the recommendation of the Librarian. Seconded by Commissioner Byrd and so ordered. The Clerk next reported to the Commission the amount of additional revenue which will be derived by the Water Department through increasing the minimum charge for water ser- f] []I 1 MINUTES � 33� CITY COMMISSION, SANFORD, FLORIDA, February 23 7:30 P M 19_3_1 vice from $1.20 per month to $1.50 per month, allowing the consumer 1000 more gallons of water per month for this charge than was allowed for the minumum charge of $1.20 per month. Thereupon instructions were issued for the City Attorney to draw ordinance for presentation at the next regular meeting of the City Commission changing the minimum charge for water service per month to $1.50 , allowing for this charge 4333 gallons of water. Communication next read from Special Counsel DeCottes inclosing bill for $722.30 from the Hecla Press of New York City, same representing one half the cost of printing the transcript of Record in the appeal of the case of the City of Sanford, Florida, versus the Chase National Bank of New York, the balance of the cost of printing this Transcript of record to be borne by the Chase National Bank. ordered Commissioner Leffler moved that the bill as presented be approved and payment Seconded by Commissioner Lehman and carried. Communication next read from the Order of the Red Rose, the members of which are Past Presidents of the Sanford Woman'S Club, urging the adoption of a Sanford Municipal Flag am inclosing sketches for such a flag. Matter taken under consideration_. Commissioner Byrd next offered Resolution No. 405 and moved its adoption, said Resolution No. 405 having been prepared in accordance with instructions issued at the Special Meeting of the City Commission held February 11th, 1931. Keefe and Natt T.Wagner, were Plaintiffs and the City of Sanford, Florida, was defendant and designated as case No. 2351 -T; also that certain caus pending in said Court wherein Kenneth M. Keefe, C.T.Diehl, A.C.Mittendorf and Natt T.Wagner were Plaintiffs and the City of Sanford, Florida, was defendant and designated as case No. 2510 -T; and in that certain cause pending in said Court wherein C.T.Diehl, A.C.Mittendor Kenneth M. Keefe and Natt T.Wagner, were Plaintiffs, and the City of Sanford, Florida., was defendant and designated as case No. 2511 -T., Judgment was obtained upon the bonds, certificates of indebtedness and /or coupons involved in said suits and the City Commission of the City of Sanford, Florida, has heretofore passed resolutions authorizing the payment by the owner of any real property or holder of a lien thereon of any taxes due the City of Sanford, Florida, for any years prior to the year 1930, with Bonds or certificates of Indebtedness, of said City without accrued interest and without restriction as to maturity or kind, pro- vided taxes for the year 1930 are paid in cash at the time said taxes for any year previous 332 MINUTES CITY COMMISSION, SANFORD, FLORIDA,_ _ February 23 19 31 to the year 1930 are paid in bonds or Certificates of Indebtedness, and authorizing the payment by the owner of any real property in said City or holder of a lien thereon, or any special assessment thereon with general bonds, certificates of indebtedness or gecial assessment Bonds and matured coupons thereon of the City of Sanford, Florida, without restril as to maturity or kind of bond or certificates of indebtedness, and the Plaintiffs in the above entitled causes will issue to the owners of any of the bonds, certificates of indebt- edness or coupons involved in said suits, receipts for any of said bonds, certificates of indebtedness or coupons, which the owners thereof prior to the entry of said judgments desire to sell, said bonds, certificates of indebtedness and coupons now being on file in the office of the Clerk of the United States Court in and for the Southern District of Florida, at Tampa, Florida. NOW THEREFORE, Be It Resolved by the City Commission of the City of Sanford, Florida, that any owner of property or holder of a lien thereon assessed for taxes by said City of Sanford, Florida, for any year prior to the year 1930, and which laxes have not been paid may pay such taxes with receipts issued by the Plaintiffs in any one or more of the suits against the City of Sanford, Florida, hereinbefore described, to the owners of any of the bonds, or certificates of indebtedness involved in said suits without restriction as to maturity or kind of bonds or certificates of indebtedness, which receipts shall be accepted by the City Tax Collector or Deputy Tax Collector of the City of Sanford, Florida, at par without accrued interest and proper receipts issued for such taxes, provided that the 1930 taxes shall be paid in cash at the time any of said taxes for any year prior to the year 1930 are paid with receipts as aforesaid. Be It Further Resolved, that the owner of any real property in the City of Sanford, Florida, or holder of a lien thereon.may pay any Special Assessment thereon with receipts issued by the plaintiffs in the foregoing causes to the owners of any of the bonds, certif- icates of indebtedness or coupons thereon, involved in said suits, and such receipts shall be accepted by the City of Sanford, Florida without restriction as to maturity or kind of bond or certificate of indebtedness, and proper receipts issued for such special assessment Paid with such bond, certificate of indebtedness and re tured .Coupons thereon. Commissioner Lehman next introduced Ordinance No. 189 entitled: AN ORDINANCE PRESCRIBING THE TIME OF HOLDING REGULAR , SPECIAL AND ADJOURNED SESSIONS OF THE MUNICIPAL COURT OF THE CITY OF SANFORD, FLORIDA." and same was placed on its first reading and read in full by the Clerk. 333 Thereupon Commissioner Lehman moved that the rules be waived and that said Ordinance No. 199 be placed upon its final passage and adoption. Seconded by Commissioner Leffler. Thereupon the motion recurred upon the waivure of the rules. The roll was called and the motion. was unanimously carried by the following vote: Commissioner Dumas Aye if Leffler Aye if Lehman Aye If Speer Aye of Byrd Aye Thereupon said Ordinance No. 189 was placed upon its final passage and adoption, those voting for the adoption of said Ordinance No. 189 being Commissioner Dumas " Leffler " Lehman " Speer " Byrd. Thereupon the Chairman announced that the City Commission of the City of Sanford, Florida, by unanimous vote , had passed and adopted said Ordinance No. 189 entitled: AN ORDINANCE PRESCRIBING THE TIME OF HOLDING REGULAR, SPECIAL AND ADJOURNED SESSIONS OF THE MUNICIPAL COURT.OF THE CITY OF SANFORD, FLORIDA. On motion unanimously adopted , Ordinance No. 189, passed this 23rd day of February 1931, was ordered POSTED at the front door of the City Hall, as required by the Charter.
